For the last six years extreme PROFILING of BLACK Passengers and BLACK Travelers has increased.
TSA Personnel, Airport Security, Train Station Security and Bus Station Security Personnel appear to be practicing extreme PROFILING of BLACK citizens in the United States, even when those BLACK citizens are dressed in normal, regular attire.
Regardless of how Courteous, Polite and Hospitable BLACK people behave when traveling, they are frequently treated with Disdain by TSA or Security Personnel.
In fact BLACK citizens who travel are frequently treated as if they are HOMELESS people seeking Shelter.
However rarely does TSA Personnel, Airport Security, Train Station Security and Bus Station Security Personnel question WHITE Travelers or request to see their Traveling documents until they are actually Boarding.
It's quite obvious that this extreme PROFILING and Disdain towards BLACK citizens who travel is a result of Pres OBAMA'S Racially-divisive POLICIES.
Whether anyone wishes to admit it or not, many of Pres OBAMA'S Policies have divided this nation more so than ever.
Congressman Diane Black (R-TN-06) and Congressman Bill Flores (R-TX-17) have introduced H.R. 4026, the Nondiscriminatory Transportation Screening Act.
The legislation would allow Americans to use gun license permits as permissible identification for Transportation Security Administration (TSA) purposes while maintaining strong protections for gun owners’ privacy rights and prohibiting government tracking of individuals who choose to present this identification at airport screenings.
The bill comes ahead of the 2015 Thanksgiving holiday season, where 25 million Americans are expected to board flights to travel destinations throughout the country.
Currently, the TSA explicitly bans the use of handgun licenses at airport checkpoints, despite the fact that these licenses meet all criteria for “verifying identity documents” under current law. Black and Flores released the following statements:
“We all understand the need for stringent security standards at our nation’s airports, but there must also be a place for commonsense.
It is mind-boggling that the TSA has reportedly accepted Costco membership cards at airport screenings, yet its website expressly prohibits the use of handgun carry permits.
Why the double standard?
Handgun licenses are a government-issued form of identification and no one has given me a valid reason why they cannot be accepted at TSA checkpoints.
Americans who exercise their Second Amendment freedoms have bared the brunt of much hostility from this Administration over the last seven years.
As a handgun carry permit holder myself, I believe this should be a simple, bipartisan step we can take to stop the government’s marginalization of gun-owners and alleviate confusion for millions of American travelers this holiday season,” said Congressman Diane Black.
“As travel continues to be a vital piece of our nation’s economy, TSA should accept approved government issued concealed handgun licenses as a valid form of identification.
The requirements to obtain a concealed license are similar and often times stricter than that of obtaining a standard ID card. Earlier this year, the Texas House of Representatives overwhelmingly passed a bipartisan resolution petitioning Congress to allow the TSA to accept concealed handgun licenses.
Concealed handgun licenses contain all of the identifying information required by the TSA.
It is time they recognize these licenses as acceptable forms of identification.
The Nondiscriminatory Transportation Screening Act provides a commonsense approach for the TSA to update its policies on permissible verifying documents,” said Congressman Bill Flores.
Recent attacks in Paris, Beirut and Baghdad linked to the Islamic State in Iraq and Syria (ISIS) have once again brought terrorism and Islamic extremism to the forefront of international relations.
According to newly released data that the Pew Research Center collected in 11 countries with significant Muslim populations, people from Nigeria to Jordan to Indonesia overwhelmingly expressed negative views of ISIS.
One exception was Pakistan, where a majority offered no definite opinion of ISIS. The nationally representative surveys were conducted as part of the Pew Research Center’s annual global poll in April and May this year.
In no country surveyed did more than 15% of the population show favorable attitudes toward Islamic State. And in those countries with mixed religious and ethnic populations, negative views of ISIS cut across these lines.
In Lebanon, a victim of one of the most recent attacks, almost every person surveyed who gave an opinion had an unfavorable view of ISIS, including 99% with a very unfavorable opinion. Distaste toward ISIS was shared by Lebanese.
Sunni Muslims (98% unfavorable) and 100% of Shia Muslims and Lebanese Christians.
Israelis (97%) and Jordanians (94%) were also strongly opposed to ISIS as of spring 2015, including 91% of Israeli Arabs.
And 84% in the Palestinian territories had a negative view of ISIS, both in the Gaza Strip (92%) and the West Bank (79%).
Six-in-ten or more had unfavorable opinions of ISIS in a diverse group of nations, including Indonesia, Turkey, Nigeria, Burkina Faso, Malaysia and Senegal.

FERGUSON, Mo. — When Sam Andrews awoke on Tuesday morning, he found his wife watching a television interview with a woman whose bakery had been vandalized during the violent unrest here on Monday.
“She said, ‘You’ve got to go help her,’ ” Mr. Andrews said in an interview on Saturday morning.
And so Mr. Andrews, a former Defense Department contractor who is now a weapons engineer in the St. Louis area, set to work. Under the auspices of a national group called the Oath Keepers, Mr. Andrews accelerated plans to recruit and organize private security details for businesses in Ferguson, which are receiving the services for free. The volunteers, who are sometimes described as a citizen militia — but do not call themselves that — have taken up armed positions on rooftops here on recent nights.
“It’s really a broad group of citizens, and I’m sure their motivations are all different,” said Mr. Andrews, who is in his 50s. “In many of them, there’s probably a sense of patriotism. But I think in most of them, there’s probably something that they probably don’t even recognize: that we have a moral obligation to protect the weakest among us. When we see these violent people, these arsonists and anarchists, attacking, it just pokes at you in a deep place.”
Mr. Andrews declined to say how many people were assisting in the effort, saying only that the number was “more than five, less than 500.” He estimated that men make up about 80 percent of the volunteers. About 80 percent are white, and 10 percent are black.
But on Saturday, with the county police said to be threatening the Oath Keepers with arrest, the volunteers decided to abandon their posts and instead protest against the authorities. During the evening, Mr. Andrews and some of his colleagues appeared on South Florissant Road, conducting a protest of their own. They ate pizza and stood beneath a handmade sign critical of Chief Jon Belmar of the St. Louis County police.
Just after 8:30 p.m., those protesting Mr. Brown’s death crossed paths with the Oath Keepers. Mr. Andrews shook hands with the demonstrators, many of whom have also been critical of Chief Belmar.
That some business owners accepted aid from a group regarded by some as an antigovernment militia is a testament to the rawness of emotions here following a riot on Monday night, after a grand jury declined to indict a white police officer, Darren Wilson, who shot to death Michael Brown, an unarmed black teenager, on Aug. 9.
Since then, the riot police have tussled on the streets with protesters. Convoys of National Guard Humvees patrol the streets, and law enforcement officials have confiscated guns, firecrackers and homemade firebombs from arrested protesters. The Oath Keepers, equipped with militia-style gear and often clad in camouflage, have joined the volatile mix.
Their presence is a symbol of the continuing criticism of Gov. Jay Nixon’s handling of security before and after the grand jury’s decision became public. In the days before the announcement, Mr. Nixon declared a state of emergency and sent the Guard to Ferguson. Yet, in the initial hours following word of the grand jury’s decision, the Guard played only a limited role.
Troops protected a police command post and other facilities, but they were not posted along the main commercial corridors where property destruction was rampant.
“The governor said himself, I think on TV, that the businesses will be protected by the National Guard during this situation,” said Reggie Jones, the mayor of Dellwood, a neighboring city where many businesses were damaged in Monday’s unrest. “Unfortunately, that did not happen until Tuesday. But we were expecting it to happen on Monday.”
After the destruction that night, Mr. Nixon ordered hundreds more soldiers to Ferguson, saying, “We must do better, and we will.”
But for people like Mr. Andrews, the governor’s vow was of little solace. So while the New Chinese Gourmet restaurant at the end of a block of South Florissant Road appears to have little in the way of defense beyond the painted wooden boards that cover its windows, armed men and women on recent nights have roamed the rooftop it shares with a dental practice and a law office.
“When they’re here, there’s definitely a weight lifted off of our shoulders,” said Davis Vo, whose family owns New Chinese Gourmet. “I’d be lying if I said otherwise.”
On its website, Oath Keepers released a recruiting message to “all skilled veterans and patriots” and asked them to “grab your gear and start rolling toward Ferguson.” The post listed nine types of people the group was seeking, including paramedics, police officers, “private drone operators” and videographers who could “film any encounters with looters.”
Mr. Andrews said he researched the qualifications of each volunteer, as well as whether any might have racially based motivations to participate.
“I don’t want any racists in my group,” he said. “I don’t want any people who want to visit violence on any group. I only want professionals with real credentials that can be verified and have experience in dealing with violence.”
But the St. Louis County police, Mr. Andrews said, and other law enforcement officials have expressed misgivings.
“When we hear information that someone, or a group, is providing security without a license, our department has to investigate the issue,” a police spokesman, Shawn McGuire, said in an email on Saturday.
Mr. Andrews said that the warning on Friday was tantamount to a temporary shutdown order, and he said he did not expect his volunteers to defy it.

So where were Ferguson's BLACK Pastors and Older BLACK Community Leaders while these BLACK Male Youth were left unattended and engaged in Illegal Activity??
Ferguson's BLACK Pastors and Older BLACK Community Leaders were off somewhere Volunteering their time on Pres OBAMA'S Election & Re-election Campaigns.
Ferguson's BLACK Pastors and Older BLACK Community Leaders were also somewhere pushing the AFFORDABLE CARE ACT in the faces of BLACK Voters.
None of those BLACK Pastors and Older BLACK Leaders were pushing for JOBS or Academic After School Programs for the BLACK Male Youth in their Communities.
Instead those same BLACK Pastors and Older BLACK Community Leaders were too busy trying to maintain their positions of #Leadership.

Washington (AFP) - The Missouri police officer who killed an unarmed black teen sparking months of protests in the city of Ferguson will never return to policing, his lawyer said.
Darren Wilson is currently in discussions with the Ferguson, Missouri police department on the terms and conditions of his departure, attorney Neil Bruntrager said this week.
"There's no way in the world he can go back to being a police officer," the lawyer said.
"It's not a question of if, it's a question of when," Bruntrager said of Wilson's departure.
Wilson shot and killed 18-year-old Michael Brown in August claiming he acted in self-defense.
The shooting set off days of racially-charged protests that erupted again this week after a grand jury on Monday announced that Wilson would not be charged over the fatal shooting.
Bruntrager told CNN that Wilson, who has said his conscience is clear, could simply not go back to work given the outrage over the case.
"The first day he would be back on the street something terrible would happen to him or to someone that would be working with him," he told CNN.
"The last thing he wants is to put other police officers at risk," the attorney added.
Mexican President-Elect Enrique Peña Nieto spoke to CNN’s Fareed Zakaria this week for an interview airing tomorrow, and in a preview released today, Peña Nieto reacts to our Supreme Court upholding parts of Arizona’s controversial SB-1070 law.
While calling the law “discriminatory,” he acknowledged that the solution was making immigration “a decision and not a necessity for Mexicans.”
Zakaria asked Peña Nieto to respond to the Arizona law and explain how, as president of Mexico, his administration would address the immigration problem, particularly the criminal side of it.
He called the law “discriminatory” and argued that said laws “do not recognize the contribution and the value of millions of immigrants” to the American economy.
He added, however, that as President of Mexico, “I understand that Mexico must facilitate conditions for greater economic development through structural reforms, treasury reform, labor reform… in order to generate jobs and great opportunities in our culture.”
The bottom line for him was to make “immigration a decision and not a necessity for Mexicans.”
Mexico's Enrique Peña Nieto called for a "new debate" on the drug war and said the United States must play an important role in that discussion.
The presumptive president-elect spoke this week to Fareed Zakaria in an interviewing airing on this week's "Fareed Zakaria GPS."
"Yes, I do believe we should open up a new debate regarding how to wage war on drug trafficking. Personally, I'm not in favor of legalizing drugs. I'm not persuaded by that as an argument.
However, let's open up a new debate, a review, in which the U.S. plays a fundamental role in conducting this review," said Peña Nieto.
More than 47,500 people have died in drug-related violence since Felipe Calderon, Mexico's current president, made combating cartels a top priority when he took office in 2006.
Peña Nieto has pledged to focus more on reducing violence and less on catching cartel leaders and blocking drugs from reaching the United States.
"What we seek now in our new strategy is to adjust what's been done up until now. It's not a radical change.
It's to broaden the coverage and above all, the emphasis I aspire to of reducing the violence in our country," he told Zakaria.
"I'm persuaded that if we achieve the specialization in the work carried out by the various branches of the federal police and the inspector general's office, waging war on impunity will allow us to combat crime," he said.
The presumptive president-elect also weighed in on Arizona's immigration law, which allows police to check a person's immigration status while enforcing other laws if "reasonable suspicion" exists that the person is in the United States illegally.
The controversial provision was recently upheld by the U.S. Supreme Court.
It struck down other parts of the law.
"Clearly, it seems to me that these are discriminatory laws that don't recognize the contribution and the value of millions of immigrants, particularly from my country, who make enormous contributions to the United States' economic development.
It's clear to me that Mexico must facilitate conditions for greater economic development through structural reforms, energy reforms, treasury reform, labor reform, in order to generate jobs and greater opportunities in my country, so that immigration is a decision and not a necessity for Mexicans," he said.
An official tally of returns Friday confirmed Peña Nieto of the Institutional Revolutionary Party, or PRI, as the winner of Mexico's presidential election.
But until the country's electoral tribunal ratifies the results - and challenges are virtually assured - he remains the presumptive president-elect.
Peña Nieto's closest rival, Andres Manuel Lopez Obrador, has vowed to challenge the results, accusing the PRI of vote-buying, and said that he would take his complaints through the legal system.
The federal electoral tribunal, known as TRIFE, will begin to accept complaints Monday of voting irregularities.
The tribunal will have until September 6 to complete its investigation and ratify - or reverse - the official election results.
Authorities in Tempe, Arizona, dismantled a drug trafficking cell associated with Mexico's Sinaloa Cartel, arresting 20 people and seizing three tons of marijuana, 30 pounds of methamphetamine and $2.4 million in cash, police said.
A six-month investigation by Tempe police and the U.S. Drug Enforcement Agency also concluded with the seizure of an airplane, 10 vehicles and 14 firearms, police said Friday.
The cartel delivered illegal drugs in Tempe and branched out to customers in New York, Alabama, California and other states, police said.
"This operation demonstrated a collaborative effort by state and federal law enforcement agencies," Tempe Chief of Police Tom Ryff said in a statement.
The drug trafficking "stretched across the Mexico border and into Arizona and beyond," said Doug Coleman, special agent in charge of the DEA's Phoenix office.
The Sinaloa Cartel is one of Mexico's most powerful drug-trafficking groups, and cartel leader Joaquin "El Chapo" Guzman Loera is widely known as Mexico's most-wanted fugitive.
Forbes magazine has placed him on its list of the world's most powerful people, reporting his net worth at $1 billion as of March.
A trial lawyers task force has studied a decade's worth of law enforcement traffic stops in North Carolina and found that blacks and Hispanics are "systematically searched at much higher rates than whites."
The N.C. Advocates for Justice, formerly the N.C. Academy of Trial Lawyers, analyzed almost 13.5 million traffic stop records covering a period from 2000 to mid-2011.
In a report this spring, the authors called their findings "deeply disturbing and may be indicative of a problem." They have called for the creation of a broad-based state commission to study the causes of the racial disparities at traffic stops and make recommendations.
The comprehensive report is a first of its kind in North Carolina, but not many state officials are aware of it.
The report was sent to only a half dozen of the state's top leaders, including Gov. Bev Perdue and state Attorney General Roy Cooper. No legislators from Cumberland County were aware of the report's existence until a reporter contacted them this week.
The Fayetteville Observer obtained a copy of the report's summary and analysis from a source at the N.C. General Assembly on the condition of anonymity.
Among other findings, the report said blacks and Hispanics are "almost twice as likely to be searched and twice as likely to be arrested" as white drivers.
State Rep. Marvin Lucas, a Democrat from Spring Lake, expressed concern about the disparities.
"That sounds like something we ought to address," Lucas said.
The statewide findings are similar to the racial disparities in Fayetteville, where recent statistics showed almost three of every four people searched by police at traffic stops were black.
The Fayetteville City Council has responded to the controversy over the past year with police policy changes, the introduction of written consent forms and the installation of about 200 camera systems in patrol cars. The former city manager was asked to resign in March because of his handling of the issue.
Dick Taylor, the chief executive officer of the N.C. Advocates for Justice, said the task force was formed in response to a call by the American Bar Association that each state explore the role of racial bias in the criminal justice system.
Taylor said members of his organization did not feel they should lead such a statewide examination of the issue, but they wanted to at least examine public traffic-stop records that most law enforcement agencies are required to submit to the state.
"We thought it might be a good way to demonstrate the need for North Carolina to have just a broad-based study," Taylor said Thursday.
Taylor said his group has reached out to top state leaders with the results of the analysis, urging action.
Noelle Talley, a spokeswoman for the N.C. Department of Justice, said Cooper and his staff had a productive meeting about the report on March 29 in his office with members of the N.C. Advocates for Justice.
"We agreed as a group that these issues deserve deeper examination and said the DOJ would participate," Talley said in an email Thursday. "We urged continued collaboration with state leaders and legislators and inclusion of more stakeholders."
Those stakeholders would include members of law enforcement, prosecutors and judges, she said.
Spokesmen for the General Assembly's two leaders - House Speaker Thom Tillis and Senate President Pro Tem Phil Berger - could not be reached for comment.
According to the task force's report, Cabarrus, Onslow, Mecklenburg and Orange counties were among those "where disparities are significantly above statewide averages" for blacks.
Cumberland and Forsyth were among six counties that had the "lowest levels" of disparities for Hispanics.
Reporting Requirement:
In 2000, the state began requiring the State Highway Patrol to report traffic-stop data in response to complaints of racial profiling. The law eventually was applied to many other law enforcement agencies around the state, including Fayetteville and Hope Mills police and the Cumberland County Sheriff's Office. Police departments in cities with fewer than 10,000 people are not required to report the data.
One state senator, Thom Goolsby, a Republican from Wilmington, filed Senate Bill 923 on May 30 that seeks to repeal the traffic-data reporting requirements. No one else has sponsored the bill, which has been assigned to the Senate Judiciary Committee. Goolsby did not return a message Thursday to comment about this bill.
Troy Williams, a former Cumberland County sheriff's deputy, first raised the issue of Fayetteville's racial disparities in traffic stops in a guest column published in the Observer in October 2010. He said the task force's report shows "a system of biased-based policing statewide."
"It's certainly not something that just happens in Fayetteville," Williams said. "But I give them credit for the policy changes they've instituted."
Fayetteville's outgoing police chief, Tom Bergamine, has vehemently denied accusations that his department has violated drivers' rights.
In March, city consultants with the National Organization of Black Law Enforcement Executives said the racial disparities in the city were a concern, but they were unable to document instances of racial profiling. They made 24 recommendation, mostly procedural.
A review of data on traffic stops in North Carolina finds law enforcement officers are twice as likely to conduct searches of vehicles driven by minorities than whites.
Researchers for North Carolina Advocates for Justice reviewed state data collected on more than 13 million traffic stops conducted between 2000 and 2011. In addition to the higher risk for being stopped and searched, the data showed blacks and Hispanics are almost twice as likely as whites to be arrested following a traffic stop.
Dick Taylor, the chief executive of the trial lawyers' group behind the study, supports the creation of a broad-based commission to study the issue of racial and ethnic disparities in how laws are enforced on the state's roads and highways.
"When you are stopped, you are more likely to have a negative outcome if you're Hispanic or African-American," Taylor said. "The disparities are there. We need to look in a serious way at why that is the case."
The data used in the report was collected by the law officers themselves, following the passage of a 1999 state law intended to monitor racial profiling.
The new report was quietly sent in March to Gov. Beverly Perdue, Attorney General Roy Cooper, legislative leaders and other state policy makers, many of whom Taylor said he and other members of the lawyers' group have met with. The report became public Friday after a copy was obtained by The Fayetteville Observer.
Taylor said the group kept the results of the study quiet, recognizing the sensitivity of the topic. While he stressed that the Advocates were not suggesting the state's law enforcement agencies are institutionally racist, he said the data does raise troubling questions that need to be addressed, possibly with new training and educational programs.
The group's report cited other recent studies have focused on racial disparities within North Carolina's criminal justice system.
Black youths are three times more likely than whites to be referred to the state's juvenile courts, and once in the system three times more likely to be sent to a juvenile correctional facility or transferred to adult court.
Blacks make up 57 percent of the state's prison population, but only 22 percent of the state population as a whole. Blacks are twice as likely as whites to be sentenced to prison for drug crimes, with the disparity growing even wider in some North Carolina jurisdictions.
In Wilson County, for example, blacks charged with drug offenses are 10 times more likely to be sent to prison than whites charged with similar crimes, according to the report.
Perdue spokeswoman Chris Mackey said the administration had arranged for members of the advocacy group to meet with the Governor's Crime Commission, which could potentially provide money for further study.
Cooper's spokeswoman, Noelle Talley, said the attorney general agrees more study is needed of the roots of the racial disparities reflected in the data.
"We urged continued collaboration with state leaders and legislators, and inclusion of more stakeholders, especially those involved in the criminal justice system at the community level, including law enforcement, prosecutors, judges and other members of the criminal justice system," Talley said.
The New York governor's proposal to decriminalize the public possession of marijuana is drawing high praise from politicians and police, black and Hispanic activists and backers of pot legalization.
"It is a step in the right direction," said the Rev. Al Sharpton, a prominent African-American political activist.
But some voices issued warnings about the proposal, with one group, the Drug Free American Foundation, arguing that it is not the time "to be backing off the marijuana law."
New York Gov. Andrew Cuomo unveiled the proposal Monday and said the law would end a double standard that has disproportionately hurt black and Hispanic youth.
In 1977, New York's legislature reduced the penalty for possessing 25 grams or less of marijuana to a non-criminal violation carrying a fine of no more than $100 for first-time offenders, as long as the marijuana was in private possession and not in public view.
If the marijuana is out and viewable in public -- as it might be when someone is asked to empty his or her pockets during a police "stop and frisk" -- it becomes a Class B misdemeanor and can lead to arrests and jail.
The "stop and frisk" policy allows police to stop and search anyone they deem suspicious.
In 2011, more than 50,000 arrests were made for small amounts of marijuana, the governor's office said. Half of those arrested were under 25 years old, and 82% were black or Latino. Less than 10% were ever convicted of a crime.
Selling and smoking or burning marijuana is still a crime, and Cuomo is not suggesting changing that.
"If you possess marijuana privately, it is a violation. If you show it in public, it's a crime. It's incongruous. It's inconsistent the way it has been enforced," Cuomo said in Albany on Monday.
As a result, thousands of young people have wound up "with a permanent stain on their record for something that would otherwise be a violation.
The charge makes it difficult for them to find a job," Cuomo said.
His proposal won praise from legislators, police, the Manhattan district attorney and New York Mayor Michael Bloomberg.
Some say the proposal is counterproductive.
David G. Evans, special adviser to the Drug Free America Foundation and a criminal defense lawyer in New Jersey, said the group is "very very concerned with this latest development."
"This can be seen by the young people as approving the use of marijuana, and they will most likely use marijuana. Marijuana of today is much more addictive and much more potent, and it poses health and criminal problems."
New York State Assemblyman Brian Kolb, a Republican, said he doubts legislators will back the proposal because of "pushback" from the community. He argues that marijuana possession is a federal crime, and "it does not make sense to pass guidelines at the state level that contradicts federal laws."
"This is a wrong message to send across the country," he said. "This should be a decision at the federal level to be interpreted for all the 50 states."
He said the Food and Drug Administration should make sure the plan follows the proper protocol. "This is not a states-rights issue. This is a drug issue. In this case, this is a controlled-substance issue," he said.
But Sharpton, president of the National Action Network, said the proposal would address police abuse.
"We have been convinced, given the data, that Stop and Frisk does not alleviate crime but instead increases the racial profiling exposure of mostly young Blacks and Hispanics," he said in a statement.
Allen St. Pierre, executive director of the NORML Foundation, which supports legalizing marijuana, said he expects legislators to "faithfully embrace" the proposal.
He also said the proposal is "a political no-brainer" because most Americans will someday back "marijuana possession in small amounts." He said Cuomo, who might one day might have presidential aspirations, is positioning himself as the "marijuana law reformer."
Lester Grinspoon, a psychiatrist, retired professor at Harvard University and expert on drug policy, said Cuomo's move is "a step on the way of what is inevitable."
"Adults should be allowed to use marijuana responsibly, in much the way we use alcohol," he said. "It's not just because it's a civil liberties issue. It is very important to furthering marijuana as a medicine."
He said marijuana has been used in the treatment of cancer, multiple sclerosis, AIDS and glaucoma.
Robert MacCoun, professor of law and public policy at the University of California at Berkeley, said a dozen states have decriminalized small amounts, usually up to an ounce for a first-time possession, and most of the legal changes took place in the 1970s.
An expert on marijuana laws, MacCoun said the "decriminalization label has mattered less and less" over time.
"First, the other 38 states have become less and less likely to send convicted marijuana possession felons to prison. Second, states that have 'decriminalized' -- like New York -- still make lots of arrests for marijuana.
Few of those arrested will end up in prison, but they may do a short jail stint."
And echoing concerns about the stain of an arrest for marijuana, he said, "there is a lasting effect on their records, which hurts their employability."
MacCoun said the "big change" over the past 10 years "is the partial legalization of medical marijuana in many states."
"Recent polls suggest that roughly half of American voters now support some form of legalization; if current trends continue, I think we'll see a state legalize marijuana soon, perhaps even this November. But there will be a thorny conflict with federal laws that prohibit marijuana," he said.
He points out that medical marijuana or decriminalization can't be confused with "true legalization." He called decriminalization a "sensible reform" and not a "risky" legal change.
"Marijuana possession sanctions have almost no measurable effect on levels of marijuana use. So it is not clear whether any valid purpose is being served by all the marijuana arrests in New York, and people of color are much more likely to be arrested even though they are not more likely to be marijuana users," he said.
"Legalization is more complicated, because the steep drop in prices would be difficult to offset with a sustainable tax, and so consumption would probably increase."
Manhattan District Attorney Cyrus R. Vance Jr. said, "the human costs to each defendant charged with a misdemeanor are serious."
"The simple and fair change proposed by Gov. Cuomo will help us redirect significant resources to the most violent criminals and serious crime problems, and, frankly, it is the right thing to do."
The governor's office said 94% of arrests for small amounts of marijuana in the state are in New York City, and Bloomberg, the New York Police Department and Police Commissioner Ray Kelly have come under fire in recent years for the department's "stop and frisk" policy.
Last year, Kelly issued a policy order directing officers to issue violations, rather than misdemeanors, for small amounts of marijuana discovered during street searches. On Monday, Bloomberg issued a statement in support of Cuomo's comments.
"The governor's proposal today is consistent with the commissioner's directive and strikes the right balance by ensuring that the NYPD will continue to have the tools it needs to maintain public safety -- including making arrests for selling or smoking marijuana," he said. "Thanks to the NYPD, our city has come a long way from the days when marijuana was routinely sold and smoked on our streets without repercussions."
Kelly said Monday, "I was asked to respond to criticism by some members of the (City) Council that the Police Department was making 'too many' arrests for small amounts of marijuana. And my response to them was, 'Well, your option is to go to Albany and get the law changed.' Better that than having New York City police officers turn a blind eye to the law as it was written, and as it is still written."
And, with the backing of the mayor and the governor, it's hard to fathom any significant opposition to the proposal will arise, said Peter Moscow, an associate professor in the Department of Law and Police Science at John Jay College of Criminal Justice in New York.
