**** Trump’s big win leaves critics sputtering

Because President Trump emerges as a clear winner from his week-long confrontation with Mexico over our neighbor’s lax enforcement of its southern border, reflexive Trump critics will scramble to find some way of containing what is a clear Trump triumph, which came with assists by Vice President Pence and Secretary of State Mike Pompeo, who conducted the key negotiations.

Already we have heard about long-term damage to trust between the North American allies, about investor nervousness and Trump’s unpredictability.

This sort of flailing-about to deny the obvious says nothing about Trump and much about those critics who can no more admit he played high-stakes poker and won a round on border security than they can admit that the president delivered a magnificent tribute to the heroes of Normandy on Thursday.

Much of the media has overheated now and, like an engine that has run too long without an oil change, has begun to seize up, stall, even melt.

That Trump has contributed to the slow wreck of American media is undeniable.

It’s a feature, not a bug, of his presidency to attack, attack, attack the media elites. And no matter how often center-right journalists counsel him to abandon the Stalinist “enemy of the people” rhetoric, he hasn’t because it triggers a flaming hatred among the ideologies of the left, with platforms and elites eager to signal each other that they are part of the tribe menaced by this Godzilla from Trump Tower.

Voters, though — not just the “Twitter Democrats” but voters of all ages and ideologies — are a pretty smart bunch. Assume for a moment that they know, generally, that tariffs are a lousy idea in terms of economic growth. Assume as well that they know that tariffs can be an instrument of national power in confrontations unrelated to economic growth.

Assume that voters know our competition with China is far more than an economic race, but rather a complex geopolitical rivalry that both sides wish to keep contained short of open conflict and that is waged through proxies, cyber-confrontations, intellectual-property battles, freedom-of-the-seas disputes and the relative size and power of our armed forces and those of our allies.

In that context, tariffs on Chinese goods are just part of an overall negotiation toward a new normal that is in everyone’s interest.

So “tariffs bad, free trade good” is simplistic. “Free trade is good and agreed-upon international conventions are required for genuinely free trade and tariffs may be necessary to achieve those conventions” is accurate. And widely understood.

“Alliances are good” is simplistic. “Alliances in which allies actually do what they promise with regard to percentage of GDP spent on national defense while not increasing dependence on Russian natural gas” is complex but accurate.

Hard as it is for the Manhattan-Beltway echo chamber to believe, sounding sophisticated isn’t actually being sophisticated. Trump’s record is mixed, but not this week.

This week, even as Joe Biden began to melt (the headline in Saturday’s Times of London online edition was “Democrats raise doubts over Joe Biden’s stamina for presidential nomination race” — never a good sign when the neighbors notice these things), Trump put together back-to-back big successes. Historian and classicist Victor Davis Hanson speculates that Trump’s enemies are so addicted to hating him that, in a classic addict pattern, all behaviors are bent in service of the addiction.

This weekend and next week will separate the outrage addicts from the serious journalists. Trump would be very well advised to take this tariff weapon off the table with regard to Mexico.

It probably wouldn’t work a second time unless the Mexicans failed to deliver even a halfhearted effort.

It’s not the sort of threat you can use twice, and doing so would undo the enormous win he can rightfully paint this to be at rally after rally as Campaign 2020 gets underway.

If Trump invited Democrats back to the White House for immigration reform and border security talks right now, urging them to be as serious as the Mexican government has been about the border crisis, it might actually work.

House Democrats passed an immigration bill last week. Senate Republicans could quickly pass their own version to get a joint House-Senate conference with White House participation.

Everyone could win: the United States and Mexico, the president and the House speaker, both parties, the undocumented in this country seeking regularization, and the desperate and easily exploited poor of Central America.

****** Mexican Repeat offender who illegally entered U.S. four times sentenced to 8 years


A Mexican citizen who illegally entered the U.S. four times and racked up a long criminal history was sentenced to eight years in prison Thursday, more than twice the term suggested under federal sentencing guidelines.

Victor Santos-Ochoa, 45, convicted of more than 20 other crimes in the U.S. since 1992, pleaded guilty Feb. 14 to illegal re-entry following a conviction of an aggravated felony and was facing a prison term of 37 to 46 months under the sentencing guidelines.

“Quite frankly, you are the type of individual U.S. immigration policy is intended to keep out of the United States,” U.S. District Judge Henry E. Hudson told Santos-Ochoa shortly before imposing the term.

Earlier, Hudson told Nia Vidal, Santos-Ochoa’s lawyer, that he has handled 200 immigration cases as a federal judge.

“I believe this is the worst,” Hudson said.

S. David Schiller, an assistant U.S. attorney, told Hudson, “I have done in excess of 500 of these ... cases. I haven’t seen many that come close to this.”

According to court records, the U.S. attorney’s office said that between 1992 and 2007, Santos-Ochoa was convicted of 18 misdemeanors in California, Georgia and Virginia and spent eight of those 25 years in state and federal prisons.

He was deported, apparently in 2007, and then re-entered the U.S., showing up in Chesterfield County, where in 2008 he was convicted of malicious wounding. Deported again, he was caught re-entering the U.S. in Arizona in 2010, sentenced to 57 months and deported again.

He returned to Chesterfield, where he was convicted of possession of marijuana in 2016. Deported again, he returned and was most recently arrested in Chesterfield in September for assault and battery of a family member — a 5-year-old child — and another drug charge.

Vidal told Hudson on Thursday that the guideline range of 37 to 46 months already took into account his prior illegal entries and relevant criminal history. She asked the judge to sentence him within the guideline range, which was not binding on Hudson.

But Hudson cited the defendant’s long criminal history and disrespect for the law in going over the guidelines.

Presuming he will be deported again after his eight-year prison term, Hudson told Santos-Ochoa, “Needless to say, do not return to the United States without proper authorization, sir.”

The uproar over White House Chief of Staff John Kelly’s comments about illegal immigration in an interview with National Public Radio last week still hasn’t entirely died down. I haven’t found the resulting discussion to be super-enlightening, so, as I did with an earlier Kelly comment about how nobody knows anybody in the military anymore, I decided to see if a few charts might clear things up.

To review, Kelly argued that most undocumented immigrants are “not people that would easily assimilate into the United States, into our modern society.” He went on:

They're overwhelmingly rural people in the countries they come from — fourth, fifth, sixth grade educations are kind of the norm. They don't speak English, obviously that's a big thing. They don't speak English. They don't integrate well, they don't have skills. They're not bad people. They're coming here for a reason. And I sympathize with the reason. But the laws are the laws.

So … let’s dig into the data. More than 70 percent of undocumented immigrants in the U.S. are from Mexico and Central America, according to the Migration Policy Institute. Mexico is by far the most common country of origin, but the population of Mexican immigrants in the U.S. (both documented and undocumented) actually fell 6 percent from 2007 to 2015, according to the Pew Research Center, while the numbers of Salvadorans, Hondurans and Guatemalans in the U.S. continued to grow.

So when we talk about illegal immigration into the U.S., we’re mainly talking about immigration from those four countries, with El Salvador, Honduras and Guatemala playing a growing role and Mexico a huge but shrinking one.

And yes, most of those who have come to the U.S. from these countries are probably of rural origin, although (1) there’s not much good data on that and (2) there are indications that the rural share has been getting less “overwhelming” in recent years as Mexico and El Salvador, the two biggest sources of unauthorized immigrants in the U.S., have urbanized.

Much better data is available on the characteristics of foreign-born people here in the U.S., most of it from the Census Bureau’s American Community Survey, an annual survey of about 2 million households first conducted in 2005.

The ACS does not sort immigrants by whether they have permission to be in the U.S. or not. 1 (Estimates of the number of undocumented immigrants in the U.S., in fact, are arrived at by taking the totals from the ACS and subtracting out the numbers of temporary and permanent lawful residents provided by the Department of Homeland Security.)

Still, it offers much insight into the characteristics of different immigrant groups. To get back to Kelly’s comment, here are the countries from which immigrants in the U.S. have the least formal education, according to the 2016 ACS:

So yes, the people who have come to the U.S. from Mexico and Central America tend not to have a lot of schooling.

The European nations of Portugal, Italy and Greece are also on this list, although most immigrants from those countries arrived in the U.S. a long time ago so there’s understandably not much grumbling about them.

Meanwhile, the countries from which the most-educated foreign-born U.S. residents hail make for quite a diverse bunch.

Next, let’s examine Kelly’s comments about non-English-speakers. He’s right that immigrants from Mexico, El Salvador, Guatemala and Honduras struggle with the language, although this time around, they cede first place to Myanmar:

The list of countries from which immigrants in the U.S. are least likely to struggle with English are, unsurprisingly, all English-speaking countries, so I’m not going to bother with a chart. Extra credit, though, to the Netherlands and Germany for making the top 10 despite having their own languages, and to Trinidad & Tobago for beating out the U.K. for first place.

It’s important to remember, though, that immigrants from non-English-speaking countries have always struggled with the language. Many millions of immigrants from Germany, Italy and other European countries in the late 19th and early 20th centuries never did become fluent in English. But their children did!

The kids of today’s immigrants are learning English, too: Of people born in the U.S. who speak Spanish at home, reports the Census Bureau, 83 percent also speak English very well. The percentage is slightly higher — 87 percent — among those who speak other Indo-European languages at home, and is again 83 percent for those who speak Asian and Pacific languages at home.

Finally, there’s Kelly’s assertion that undocumented immigrants don’t integrate well. Language ability is one measure of integration. Employment is surely another one. When I ran a list of the countries from which immigrants in the U.S. have the highest employment-to-population ratio, some familiar names popped up:

The employment-population ratio for Mexican-born U.S. residents, by the way, is 65.5 percent, which ranks it 28th out of the 80 countries for which there’s data.

There are some caveats I should trot out here:

The immigrant populations from Guatemala, El Salvador and Honduras are younger and more male than the overall U.S. population, which skews employment ratios upward, and since this data covers everyone age 16 and up, college and even high school students count against the total — which brings the ratio down among groups likely to pursue higher education. Still, their strong employment performance isn't a fluke; the Cato Institute's David Bier offers up lots of other evidence that Central Americans are integrating pretty well.

The foreign-born residents with the lowest employment-population ratios hail mainly from countries (Hungary, Italy, Greece, Germany) from which most immigrants arrived decades ago and are now in their 60s or older. The very lowest employment-population ratio, though, is for those born in Saudi Arabia, most of whom are in the U.S. for college or graduate school.

And while no other country of origin has a majority of its U.S. residents currently enrolled in higher education, Kenya, Nigeria, Nepal and Ghana have the highest percentages after Saudi Arabia. So immigrants from Kenya, Nigeria and Ghana are near the top in both employment-population ratio and higher-education enrollment, and those from Nigeria are also near the top in educational attainment.

With that, let me offer my two cents on Kelly’s statement: It appears to be factually accurate in most of its characterizations of today’s undocumented immigrants, and I think the people decrying it as “racist” are for the most part just devaluing the term “racist.” His “they don’t integrate well” comment grates, though, given that Kelly and most other Americans are descended at least in part from rural people with limited education who didn’t speak any English when they got here.

And while there is a case to be made that education and English are far more important to success in the U.S. than they were a century ago, one certainly can’t depict Central Americans in particular as sitting around twiddling their thumbs wondering how they will ever integrate into U.S. society. They’re too busy working.

Also — and nothing Kelly said contradicted this, but some things his boss has reportedly said certainly have — what the charts above tell me is that if we want more high-skilled, hardworking, English-speaking, ready-to-integrate immigrants, it looks like the most obvious place to find them is in African countries where English is widely spoken.

The survey asks respondents whether they are citizens but does not ask the non-citizens to go into further detail.

These aren’t necessarily all immigrants who are planning to stay in the U.S. for good — a 25-year-old from India who is working on a doctorate at a U.S. university and planning to head home afterwards shows up, too. But close enough.

Donald Trump’s election victory over Hillary Clinton seemed to herald a new era for border security and immigration enforcement. But his polarizing and occasionally ignorant comments about immigrants have handed his adversaries a convenient pretext for stymying compromise on immigration reform: racism.

Left-leaning advocacy groups and a host of Democrats all too often shy away from the specifics of the debate and instead lean on cries of bigotry, resorting to claims like that of House Minority Leader Nancy Pelosi, who has described Trump’s approach to immigration reform as an effort to “make America white again.”

Claims that immigration enforcement equals racism ignore the reality that the group most likely to benefit from a tougher approach to immigration enforcement is young black men, who often compete with recent immigrants for low-skill jobs.

This dynamic played out recently at a large bakery in Chicago that supplies buns to McDonald’s. Some 800 immigrant laborers, most of them from Mexico, lost their jobs last year after an audit by Immigration and Customs Enforcement. The Cloverhill Bakery, owned by Aryzta, a big Swiss food conglomerate, had to hire new workers, 80 percent to 90 percent of whom are African-American. According to the Chicago Sun Times, the new workers are paid $14 per hour, or $4 per hour more than the (illegal) immigrant workers.

In this case, and in many others, the beneficiaries of immigration enforcement were working-class blacks, who are often passed over for jobs by unscrupulous employers.

The labor force participation rate for adult black men has declined steadily since the passage of the 1965 Immigration and Nationality Act, which ushered in a new era of mass immigration. In 1973, the rate was 79 percent. It is now at 68 percent, and the Bureau of Labor projects that it will decline to 61 percent by 2026.

The Obama White House in 2016 produced a 48-page report acknowledging that immigration does not help the labor force participation rate of the native-born. It concluded, however, that “immigration reform would raise the overall participation rate by bringing in new workers of prime working age.”

Although the report used the term “new workers,” Democrats may also be tempted by the prospect of new voters. But they should be aware that in courting one group, they risk losing others.

African-Americans tend to be a reliable voting bloc for the Democratic Party, but they have repeatedly indicated in public opinion surveys that they want significantly less immigration.

A recent Harvard-Harris poll found that African-Americans favor reducing legal immigration more than any other demographic group: 85 percent want less than the million-plus we allow annually, and 54 percent opted for the most stringent choices offered – 250,000 immigrants per year or less, or none at all.

These attitudes are rational.

In a 2010 study on the social effects of immigration, the Cornell University professor Vernon Briggs concluded: “No racial or ethnic group has benefited less or been harmed more than the nation’s African-American community.”

The Harvard economist George Borjas has found that between 1980 and 2000, one-third of the decline in the employment among black male high school dropouts was attributable to immigration. He also reported “a strong correlation between immigration, black wages, black employment rates, and black incarceration rates.”

University of Notre Dame professor Stephen Steinberg argued in a 2014 paper on neoliberal immigration policies and their effects on African-Americans that thanks to the Immigration and Nationality Act of 1965, “African-Americans found themselves in the proverbial position of being ‘last hired.’” Steinberg also noted that “immigrants have been cited as proof that African-Americans lack the pluck and determination that have allowed millions of immigrants from Asia, Latin America and the Caribbean to pursue the American dream.”

The struggles of black men obviously cannot all be linked to immigration, but it’s clear that the status quo does not benefit them.

As elected leaders consider changing our immigration laws, the interests of America’s most vulnerable citizens shouldn’t be overlooked. The first step toward honest reform is for the Democratic Party to admit that while liberal immigration enforcement might help them win new voters, it also harms and disenfranchises their most loyal constituency.

Tuesday night, January 30, 2018 Donald J. Trump our 45th legally elected leader of the Free world (USA), delivered his first State of the Union address before the entire world.

During his speech Trump talked about his administration’s first year achievements as all U.S. Presidents have done when delivering their SOTU speeches.

Trump then proceeded to provide an update on the cornerstone topic of his administration’s agenda and the topic which helped to secure his 2016 election.

That topic is ILLEGAL IMMIGRATION REFORM.

Trump mentioned during his SOTU address that he is halting the FAKE Syrian Refugee program until further notice.

Considering how most of the Men who entered America’s borders under the guise of “Syrian Refugees” were actually from IRAQ and were actually members of ISIL, I can see how choosing to halt this program although not POLITICALLY CORRECT, would be in the best interest of our country as it relates to NATIONAL SECURITY.

Trump then went on to discuss his agenda for dealing with GANG WARFARE as in the notorious, most Cold-Blooded Gang to ever exist.......the MS-13.

MS-13 is an international Gang comprised solely of Young LATINO Men, not BLACK Men.

These Young LATINO Men hail from MEXICO, South America, Central America and Honduras.

MS-13 Gang Members are so cold-blooded and violent, they also target and viciously MURDER LATINO citizens just as easily as they frequently Kill American citizens.

This Gang uses MURDER to Terrorize, Intimidate and Control entire American Communities.

In many instances even the POLICE are afraid of MS-13 Gang Members.

Choosing to prosecute and deport Young LATINO Men who are active members of MS-13 is not a POLITICALLY CORRECT decision for Trump’s administration because for years Politicians and other Elected Officials have feared throwing Latino or Middle Eastern Men into Jail, or Deporting them even for MURDER or TERRORISM because it’s not POLITICALLY CORRECT.

However these Politicians and Elected Officials had absolutely No Fear of throwing Young BLACK Men into Jail in a New York minute, even for minor offenses.

Can you say Double Standard based on RACE??

Yet were it not for BLACK Voters, neither VIRGINIA nor ALABAMA Democrats would have won the 2017 elections.

So I commend Pres Trump for standing up for what is right for the USA even when it’s not Popular or POLITICALLY CORRECT to do so.

****** Trump honors parents of MS-13 gang victims at SOTU


One of the longest standing ovations during President Trump’s first State of the Union address came when he introduced the parents of two teenage victims of gang violence.

Evelyn Rodriguez, Freddy Cuevas, Elizabeth Alvarado and Robert Mickens were invited by the White House to attend Tuesday’s speech. Their daughters — Kayla Cuevas and Nisa Mickens respectively — were killed by members of the MS-13 gang on Long Island in September 2016, on the eve of Nisa’s 16th birthday. Federal authorities later arrested 13 gang members in connection with their deaths. Ten of those arrested had entered the country illegally.

Trump used their killings to highlight what he views as America’s “open borders” that “have allowed drugs and gangs to pour into our most vulnerable communities.”

“These two precious girls were brutally murdered while walking together in their hometown,” Trump said. “Six members of the savage gang MS-13 have been charged with Kayla and Nisa’s murders. Many of these gang members took advantage of glaring loopholes in our laws to enter the country as unaccompanied alien minors — and wound up in Kayla and Nisa’s high school.”

The president turned to their parents, who were seated next to first lady Melania Trump.

“Evelyn, Elizabeth, Freddy, and Robert: Tonight, everyone in this chamber is praying for you,” Trump said. “Everyone in America is grieving for you. And 320 million hearts are breaking for you. We cannot imagine the depth of your sorrow, but we can make sure that other families never have to endure this pain.”

The parents then received a long standing ovation as they wiped away tears.

Trump called on Congress to “finally close the deadly loopholes that have allowed MS-13 and other criminals to break into our country.”

“We have proposed new legislation that will fix our immigration laws and support our ICE and Border Patrol agents, so that this cannot ever happen again,” he continued. “So tonight, I am extending an open hand to work with members of both parties — Democrats and Republicans — to protect our citizens of every background, color, religion and creed. My duty, and the sacred duty of every elected official in this chamber, is to defend Americans — to protect their safety, their families, their communities, and their right to the American Dream. Because Americans are dreamers too.”

A Federal warrant has been issued for the arrest of a Mexican immigrant acquitted Thursday evening of murder charges in the 2015 killing of Kate Steinle.

Steinle's death has been taken up by opponents of so-called sanctuary cities.

They argue that stricter immigration enforcement would have kept Jose Ines Garcia Zarate, who is residing in the U.S. illegally and was deported five separate times before the 2015 shooting, off the streets.

The arrest warrant unsealed in the Western District of Texas by the Justice Department on Friday accuses Zarate of violating his supervised release.

Zarate was released from jail in 2015, despite a federal immigration detainer request. Months after his release, he allegedly shot and killed Steinle on a pier in San Francisco.

Zarate was acquitted on Thursday of murder and manslaughter charges after a weekslong trial. He was convicted on a charge of being a felon in possession of a firearm.

President Trump seized on Steinle's killing as a presidential candidate, pointing to it as an example of the need to strengthen immigration laws. He chimed in on the subject after the verdict was announced Thursday night, calling it "disgraceful."

"No wonder the people of our Country are so angry with Illegal Immigration," Trump tweeted.

The Justice Department is also considering federal charges from Steinle's death.

"We're looking at every option and we will prosecute this to the fullest extent available under the law because these cases are tragic and entirely preventable," Sarah Isgur Flores, the department's director of public affairs, said on "Fox and Friends."

In a statement issued shortly after the verdict was rendered on Thursday, Tom Homan, the deputy director of U.S. Immigration and Customs Enforcement, said the agency would "work to take custody of Mr. Garcia Zarate and ultimately remove him from the country."

'Chain migration' is the legal ability of U.S. residents to sponsor their foreign relatives for immigrant visas, in a process that repeats itself over and over.

President Trump has already proposed a sweeping change to America's legal immigration system, limiting family visas in favor of a skills-based merit system.

As word spread that he might ink a deal with Democrats to save the DACA program, he insisted on Twitter that it won't enable more chain migration.

DACA is an Obama-era program that protects from deportation nearly 800,000 people who were brought to the U>S. illegally as children.

Conservatives fear giving them legal status would allow them to sponsor visas for the adults who broke the law by bringing them to the U.S. in the first place.

As he works toward a bargain with Democrats to resolve the status of nearly 800,000 illegal immigrants brought to the U.S. as children, Donald Trump said Friday that he wont't embrace a solution that enables so-called 'chain migration.'

Chain migration refers to the legal right of citizens and other legal U.S. residents to 'sponsor' relatives living outside the country, bringing them one by one in expanding circles until extended families have immigrated.

White House press secretary Sarah Sanders told reporters on Friday that the president will lay out his specific proposals and their limitations in between 7 and 10 days.

Under proposals favored by some Democrats, people benefiting from the Obama-era 'Deferred Action for Childhood Arrivals' (DACA) program could gain legal status or citizenship, opening up the possibility that they could help overseas relatives obtain lawful residence.

The Trump administration fueled speculation on Thursday, with deputy press secretary Lindsay Walters telling reporters aboard Air Force One that a 'responsible path forward' for DACA recipients 'could include legal citizenship over a period of time.'

'But absolutely by no means will this White House discuss amnesty,' Walters added, confusing journalists on the plane.

The prospect of elevating DACA recipients to citizenship status is troublesome for conservative Republicans who point out that while they were brought into the United States, giving them the right to sponsor their parents for legal immigration status could reward the adults who snuck them across the border.

Chain migration was made part of federal immigration law in 1965 with the Hart-Celler Act, which gave relatives of legal U.S. residents preference over other potential immigrants with skills the government had prioritized.

The law has made family reunification a central plank of American immigration policy since 1924, when Congress allowed citizens' and residents' spouses and unmarried adult children up to age 21 to ignore per-country quotas and emigrate to the U.S.

In 1965 about 32,700 immigrants entered the United States on the basis of their existing family relationships.

By 2001 the annual number of family-sponsored immigration visas had grown to nearly 677,000.

Last month Trump announced his backing for a broader plan that would limit legal immigration by placing an emphasis on a skills-based merit system instead of family connections.

Applicants from foreign countries would be rewarded if they can speak English, financially support themselves and bring skills that 'can contribute to our economy,' Trump said in early August.
House Speaker Paul Ryan told the Associated Press on Thursday that 'moving from what people describe as chain migration to a skills-based merit system makes a lot of sense, while keeping nuclear families intact.'

The president stunned many Republicans this week by entering into negotiations with top congressional Democrats over the DACA program.

Attorney General Jeff Sessions announced last week that the administration was terminating DACA itself, subject to a six-month delay intended to give Congress a window to decide recipients' fate.

The latest episode of the saga came amid Democrats' claims Wednesday night that Trump had promised to sign a bill formalizing DACA without including funding for the wall he has pledged to build between the U.S. and Mexico.

Trump himself tweeted Thursday that it wasn't true.

No deal was made last night on DACA. Massive border security would have to be agreed to in exchange for consent. Would be subject to vote,' he wrote.

But he has also offered a full-throated defense of DACA recipients, insisting that he intends to show 'great heart' in dealing with their situations.

'Does anybody really want to throw out good, educated and accomplished young people who have jobs, some serving in the military? Really!' he said Thursday morning on Twitter.

'They have been in our country for many years through no fault of their own – brought in by parents at young age.'

At Tuesday's combative press conference in Trump Tower, President Trump questioned the removal of statues of Confederate leaders, but at the start of his presidential campaign, Trump publicly expressed his approval of South Carolina's decision to remove the Confederate battle flag from the State Capitol.

“I would take it down, yes,” said Trump in June 2015 at his first news conference following the declaration of his presidential candidacy. “I think they should put it in the museum... respect whatever it is you have to respect because it was a point in time.”

The long-running debate over whether the Confederate flag should be flown over the South Carolina State House arose again after nine people were fatally shot in the historically black Emanuel AME Church in Charleston, South Carolina, in a racially charged killing.

Then-South Carolina Gov. Nikki Haley, who is now serving in Trump’s Cabinet as the United States’ ambassador to the United Nations, ultimately decided to order the removal of the flag on July 9, 2015.

Trump argued Tuesday that taking down the statue of Robert E. Lee, a civil war general who fought to keep slavery intact, would be “changing history.” A protest of the monument's removal spurred the white nationalist rally that ultimately turned violent Saturday.

“You’re changing culture,” Trump said during the news conference at Trump Tower Tuesday.

Asked whether statues of Lee should remain in place in the U.S., the president said the situation was one that should be handled on a case-by-case basis, depending on the location of the monument.

"I would say that's up to a local town, community, or the federal government, depending on where it is located," he said.

Trump then characterized removing Confederate memorials as a slippery slope, equating Lee to American Founding Fathers George Washington and Thomas Jefferson, who both owned slaves.

“George Washington was a slave owner…. So will George Washington now lose his status? ... Are we going to take down statues to George Washington?” Trump wondered.

“How about Thomas Jefferson?” Trump asked. “... Because he was a major slave owner. Now, are we going to take down his statue?”

Trump later added, “So, this week it’s Robert E. Lee, I notice that Stonewall Jackson is coming down, I wonder is it George Washington next week? Is it Thomas Jefferson the week after? You have to ask yourself, where does it stop?”

President Donald Trump today joined with two GOP Senators to introduce his merit-based immigration reform, which is designed to help millions of Americans hurt by the nation’s current cheap-labor immigration policies.
The RAISE Act “will reduce poverty, increase wages and save taxpayers billions and billions of dollars,” Trump told reporters in the Roosevelt Room of the White House. “This legislation demonstrates our compassion for struggling American families who deserve an immigration system that puts their needs first, and that puts America first.”

The current immigration system, said Trump:

has placed substantial pressure on American workers, taxpayers and community resources, and among those hit the hardest … are minority workers competing for jobs against brand new arrivals. It has not been fair to our people, to our citizens, to our workers … [this RAISE act] will give Americans a pay raise by reducing immigration… [and] it will restore the sacred bonds of trust between America and its citizens.

Democrats and their ethnic pressure groups are expected to oppose the immigration reform because they wish to increase the inflow of unskilled foreign migrants. Business groups also oppose the measure because it would raise wages and reduce the inflow of new welfare-aided consumers.

However, many polls show strong public support for cutting the annual inflow of immigrants and temporary blue-collar and white-collar foreign workers. That foreign inflow now adds up to almost 4 million people per year. The inflow has a huge economic impact on the 150 million Americans in the workforce, but especially on the 4 million young Americans who join the workforce each year.

The bill was drafted and is being pushed by Georgia Sen. David Perdue and Arkansas Sen. Tom Cotton. It is formally titled the “Reforming American Immigration for a Strong Economy Act.”

The nation’s immigration system “should help American workers to achieve a pay raise and have a higher standard of living,” he said. The new RAISE act “would raise economic growth and help America get more competitive,” said Cotton. “Our current system simply doesn’t do that … it puts great downward pressure on people who work with their hands and on their feet … it is a symbol that we are not committed to working-class Americans.”

Each year, only one-in-15 of the 1 million green card immigrants is accepted because of their ability to grow the economy, said Cotton.

“It is imperative that our immigration system focuses on high skilled workers who can add value to our economy and ultimately achieve their own version of the American dream,” said Perdue.

To help the bill survive opposition from media and business groups, the bill focuses only on green card legal immigration. It does not raise or lower the number of green card workers, such as H-1Bs, or constrict the annual award of work permits, dubbed “Employment Authorization Documents.”

Each year, the federal government provides green cards to roughly 1 million people. It also provides work visas to roughly 500,000 foreign workers, such as H-2Bs and H-1Bs, and it provides work permits to roughly 2 million people, including refugees and foreign graduates of U.S. colleges.

But if the RAISE act becomes law, Democrats and their business allies would lose the huge annual inflow of immigrants whom they expect will soon bring them national political dominance. That loss will pressure Democrats to compete for votes from working-class Americans by offering to slash the very unpopular inflow of visa-workers.

The proposed immigration reform was applauded by pro-American reformers. Roy Beck, the president of NumbersUSA said:

The RAISE Act introduced today by Senators Cotton and Perdue will do more than any other action to fulfill President Trump’s promises as a candidate to create an immigration system that puts the interests of American workers first.

Our recent polling confirms that American voters overwhelmingly want far less immigration because they know mass immigration creates unfair competition for American workers.

Seeing the President standing with the bill’s sponsors at the White House gives hope to the tens of millions of struggling Americans in stagnant jobs or outside the labor market altogether. NumbersUSA stands with these Americans in wholeheartedly endorsing the RAISE Act.

According to a statement from Perdue, the RAISE Act would:

• Establish a Skills-Based Points System. The RAISE Act would replace the current permanent employment-visa system with a skills-based points system, akin to the systems used by Canada and Australia. The system would prioritize those immigrants who are best positioned to succeed in the United States and expand the economy. Applicants earn points based on education, English-language ability, high-paying job offers, age, record of extraordinary achievement, and entrepreneurial initiative.


• Prioritize Immediate Family Households. The RAISE Act would retain immigration preferences for the spouses and minor children of U.S. citizens and legal permanent residents while eliminating preferences for certain categories of extended and adult family members.

• Eliminate the Outdated Diversity Visa Lottery. The Diversity Lottery is plagued with fraud, advances no economic or humanitarian interest, and does not even promote diversity. The RAISE Act would eliminate the 50,000 visas arbitrarily allocated to this lottery.


• Place a Responsible Limit on Permanent Residency for Refugees. The RAISE Act would limit refugees offered permanent residency to 50,000 per year, in line with a 13-year average.

The Trump administration’s push to deport more Central American gang membershas alarmed officials here who fear that the returning gangsters could exacerbate violence in one of the deadliest countries in the hemisphere.

This year the U.S. government has deported 398 gang members to this country, compared with 534 in all of 2016, according to Salvadoran government statistics. This sharp increase in the rate of gang deportations — and the prospect of more gang roundups in the United States — has prompted Salvadoran authorities to hold emergency meetings and propose new legislation to monitor suspected criminals who are being sent home.

“This clearly affects El Salvador. We already have a climate of violence in the country that we are combating,” said Héctor Antonio Rodríguez, the director of the country’s immigration agency. “If gang members return, of course this worries us.”

In tweets and speeches, President Trump has made MS-13, or Mara Salvatrucha, the leading symbol of the dangers of illegal immigration and the need for more and faster deportations. He has compared the gang’s “meanness” with that of al-Qaeda. He promised last week that the organization will be “gone from our streets very soon, believe me.” Recent high-profile killings, such as that of a 15-year-old Salvadoran girl in Springfield, Va., and a string of slayings on Long Island, have fueled concerns of an MS-13 resurgence in the United States.

In El Salvador, this gang and rivals such as the 18th Street gang have terrorized neighborhoods for decades. MS-13 formed in Salvadoran immigrant communities in Los Angeles in the 1980s, building its ranks with refugees from the country’s civil war. Waves of deportations over the years helped MS-13 take root in El Salvador and grow into a powerful criminal organization with tens of thousands of members across Central America.

In El Salvador, this gang and rivals such as the 18th Street gang have terrorized neighborhoods for decades. MS-13 formed in Salvadoran immigrant communities in Los Angeles in the 1980s, building its ranks with refugees from the country’s civil war. Law enforcement officials in Los Angeles and other U.S. cities have launched raids recently to capture dozens of MS-13 and other Latino gang members. U.S. Immigration and Customs Enforcement announced this month the arrest of more than 1,300 gang members across the country in what it described as the largest anti-gang crackdown in agency history.

Salvadorans are dreading the return of those captured in the U.S. raids.

“Probably we won’t feel the symptoms today or tomorrow or the next week. But probably in six months or a year we’ll be feeling the symptoms of what these deportations are causing now,” San Salvador Mayor Nayib Bukele said in an interview.

Gang members make up a small fraction of the deportee total. Salvadoran authorities say 6,922 people were brought back here from the United States in the first four months of the year, up slightly over last year.

This year the total number of deportations by United States has dropped about 12 percent, to around 56,000 people, compared with the same period last year. Officials have attributed the decline to the fact that the federal immigration court system is overtaxed.

But the Trump administration is clearly working to expel more gang members.

“You know about MS-13?” Trump said during a speech in April to the National Rifle Association. “Get them the hell out of here, right?”

Salvadoran officials worry that although the number of killings has fallen this year, gangs could quietly be strengthening or reorganizing. MS-13 has at least 49 “cliques” in El Salvador, according to Guadalupe de Echeverría, the head of the homicide and anti-gang unit at the attorney general’s office. Over the years, some of these cliques have named themselves after the cities in the United States where members lived before being deported.

One important dynamic within MS-13, Echeverría said, is a recent rupture between the historic leaders, most of whom have long been imprisoned, and an offshoot known as the “503” — the telephone country code for El Salvador.

“They have already formed a new group, and very probably with deported people,” she said. “We’ve already seen a certain amount of violence between them.”

To prepare for moredeportations, the Sánchez Cerén administration recently proposed legislation to monitor gang members who return to the country. Under the measure, if the suspected gangster had no warrant for crimes in El Salvador, he would be asked to check in with police once a month and notify authorities whether he moved. The law also would create “internment centers,” possibly guarded by the military, that would be something like a halfway house for returning gang members.

Rodríguez, the head of the immigration agency, said that many gang members in the United States had fled conflicts with rivals in El Salvador.

“To return,” he said, “some run the risk of danger for having escaped. That’s why we think there is an opportunity in the internment centers to protect them and be able to reinsert them into society.”

Human rights workers here have questioned the legality of holding suspected gang members if they have not been charged or convicted of a crime in their home country.

***** Man going to prison for selling fake IDs to undocumented immigrants in Carolinas


A Mexican man was sentenced to two years and 10 months in prison on Wednesday for providing fake documents to undocumented workers and others in the Carolinas and Georgia.

Humberto Ginez-Edmundo, 27, charged $130 to $600 for the fake Social Security cards, state identification cards, driver’s licenses and permanent residence cards he produced beginning in November 2015, court records show.

Ginez-Edmundo was convicted of fraudulent identification document conspiracy and aggravated identity theft.

Chief U.S. District Judge Frank Whitney sentenced him in federal court in Charlotte.

Ginez-Edmundo will face deportation proceedings after serving his sentence, the U.S. Attorney’s Office in Charlotte said.

U.S. Immigration and Customs Enforcement Homeland Security Investigations led the investigation into the fake documents Ginez-Edmundo produced and sold.

President Donald Trump is ready to crack down on the infamous, money-making MS-13 gang, after a violent quadruple homicide in Long Island, N.Y. last week left four teenagers dead and badly beaten. Trump is promising to remove the gang from U.S. streets “fast.”


MS-13, a group that was started by Central American immigrants in Los Angeles in the 1980s, is known for its ruthless and violent tactics. Most of the founding members were from El Salvador and fled to the U.S. during the country’s civil war that lasted 12 years, from 1980-92. Since then the gang’s membership has ballooned to at least 10,000 members in the United States and more than 30,000 worldwide, according to the FBI and Treasury Department.

“[MS-13] is one of the most dangerous and rapidly expanding criminal gangs in the world today,” Philip Holloway, a legal analyst and former police officer, told FOX Business. “MS-13’s mottos is ‘Mata, roba, viola, controla’ (Kill, steal, rape, control),” he noted.

The gang has managed to expand its business tentacles into a variety of illegal activities, despite sanctions levied against the group by the U.S Treasury Department under the Obama administration. “They are involved in multiple crimes including murder, racketeering, drug trafficking, sex trafficking and human trafficking including prostitution,” Holloway said.

MS-13 also uses violence as a means for extortion, which constitutes much of its income, University of Houston sociology professor Luis Salinas told FOX Business.

“A lot of the violence is part of the extortion … and prostitution. Once they get here they get these individuals and extort money from their families. They’re also into extortion for protection of this neighborhood or that neighborhood,” Salinas said.

In 2015 the U.S. Treasury Department froze the assets of three members of the gang who were funneling funds back to higher-ups in El Salvador from prison. These actions were an attempt “disrupt” MS-13’s financial network by cutting off profits from illegal activities in the United States, the Treasury Department said. In 2012 the Obama administration designated MS-13 a transnational crime organization and implemented sanctions against six members in 2013.

While the U.S. government attempts to target MS-13’s earnings, targeting its culture is proving more difficult. The fierce loyalty among members is unique, Ron Hosko, former assistant director of the FBI’s Criminal Investigative Division, told FOX Business.

“They're very cohesive and often directed by imprisoned bosses in El Salvador to recruit and expand in American communities. That tends to mean there's an aggressive internal enforcement mechanism which equates to internal discipline involving physical violence and murder for disrespect or betrayal,” he said.

Membership in street gangs showed no signs of decreasing, according to the FBI’s 2015 National Gang Report, and MS-13 was identified as one of the top gangs involved in cross-border crimes. Recently, law enforcement has taken a tougher stance on making arrests; a move spurred by Attorney General Jeff Session’s focus on illegal immigrant crime, Hosko said.

“MS is a clear example [of illegal immigrant crime]. Affiliates would cross the border and make their way to American enclaves where they found friends and relatives living here already,” he said. “Citizenship is a combination of American born (many to illegals) and illegal immigrants.”

Salinas said about 60-70 percent of current U.S. members in MS-13 are immigrants, the majority of which could be illegal.

On Tuesday during an interview on Fox News, Attorney General Jeff Sessions said he believes the gang “could qualify” as a terrorist group. In El Salvador, MS-13 has already been designated as a terrorist organization.

Hosko said President Trump’s administration is changing the narrative quickly for both gang members and law enforcement in the United States.

“[The FBI] believed that claiming of ‘credible fear’ of persecution, gang retaliation, other bad acts in their homeland to immigration authorities likely resulted in widespread release of bad actors into the U.S. as their claims were being evaluated. With Obama, that was acceptable risk. I think that's changing fast.”

After almost three months of stepped up enforcement under President Donald Trump, Homeland Security Secretary John Kelly said Tuesday that new efforts to stem the flow of illegal immigration into the United States are quickly paying off, as he said lawmakers in Congress who don’t like the enforcement changes by the Trump Administration should change the laws, or “shut up.”

If lawmakers do not the laws that we enforce, that we are charged to enforce, that we are sworn to enforce, then they should have the courage and the skill to change those laws,” Kelly said in a speech at George Washington University.

“Otherwise,” Kelly said of lawmakers, “they should shut up and support the men and women on the front lines.”

In his speech, Kelly cited figures that show a steep drop in the number of people trying to ilegally cross the southern border of the United States.

“March apprehensions were 30 percent lower than February, and 64 percent lower than this time last year,” Kelly said in a speech at George Washington University in D.C.

“These numbers are lower because we’ve shown we are serious about border security, and enforcing our immigration laws,” the DHS chief.

Kelly noted a large drop in the number of families trying to make the crossing into the United States.

“While more than 16,000 family units were apprehended at the border in December, only 1100 were apprehended in March,” Kelly told his audience.

“This is a phenomenal drop in movement,” Kelly said.

**** Trump vows to reopen, or toss, NAFTA pact with Canada and Mexico

(Reuters) - Republican presidential candidate Donald Trump on Tuesday vowed to force Canada and Mexico to renegotiate the NAFTA trade agreement with the United States if elected, as part of an effort to protect and restore American jobs.

Trump criticized the North American Free Trade Agreement as a U.S. job killer, saying he would be willing to scrap the pact if Canada and Mexico were unwilling to budge. He also tried to link Democratic rival Hillary Clinton to the deal on the eve of a meeting in Ottawa of the "three amigos," the leaders of the three NAFTA signatories: the United States, Mexico and Canada. 

In his most detailed speech on trade, the presumptive Republican nominee said he would pull the United States out of negotiations for a deal among 12 Pacific Rim nations and promised to use executive power to resolve trade disputes with China.

Trump also pledged to revive the U.S. steel and aluminum industry, speaking at an aluminum scrap company in Monessen, Pennsylvania, nearly 30 miles (50 km) south of Pittsburgh, the one-time American steelmaking capital.

Trump has identified Pennsylvania as a state he believes he can wrest from the Democrats in the Nov. 8 election. He also campaigned on Tuesday in Ohio, which like Pennsylvania is a Rust Belt state. 

Democratic President Barack Obama won both states in 2008 and 2012, but manufacturing job losses have led to voter anxiety in the region.

"I'm going tell our NAFTA partners that I intend to immediately renegotiate the terms of that agreement to get a better deal for our workers. And I don't mean just a little bit better, I mean a lot better," Trump said in Pennsylvania.

If Canada and Mexico do not agree to renegotiate the pact, Trump said he would notify them under the agreement's terms "that America intends to withdraw from the deal."

He tried to tie his Democratic rival to the pact, approved in 1993 during the administration of her husband, President Bill Clinton, as he called NAFTA one of the "worst legacies" of the Clinton years.

On MSNBC after Trump's speech, Clinton spokeswoman Kristina Schake called the wealthy New York businessman the "king of outsourcing," in an apparent reference to Trump-branded products such as suits and ties made overseas. 

"It was full of hypocrisy and misstatements and outright lies," Schake said.

Trade has been a vulnerability for Clinton, who struggled for white, blue-collar votes in her Democratic primary race against U.S. Senator Bernie Sanders, who criticized her for supporting trade deals and said she was too close to Wall Street. 

TRANS-PACIFIC PARTNERSHIP

Trump echoed Sanders' criticism on Tuesday, saying Clinton supported the 12-nation Trans-Pacific Partnership, or TPP, while she was secretary of state and only opposed it once she was running for president. Clinton's campaign said she opposed the agreement because it was not strong enough on currency manipulation and other areas. 

Clinton has said she will evaluate each trade deal on its merits but does not believe the TPP is good for U.S. workers. Sanders now says he will vote for Clinton in November, although he has not formally withdrawn from the race.

Trump said he saw no way to fix the TPP, calling it a "death blow" for American manufacturing. Although China is not part of the agreement, Trump said Beijing might try to enter it "through the back door" later on.

Later, during a rally in St. Clairsville, Ohio, Trump said the deal was "just a continuing rape of our country."

Just hours before Trump spoke, Clinton allies sought to pre-empt the planned trade speech by saying Trump's policies amounted to empty promises.

Earlier, AFL-CIO President Richard Trumka told a trade conference in Washington that "Trump embodies everything that is wrong with our current trade policy. He has consistently sent American jobs overseas to line his own pockets."

The AFL-CIO, which collectively represents more than 12 million workers, making it the largest U.S. labor federation, endorsed Clinton this month.

Both Clinton and Trump have acknowledged that Britain's vote to leave the European Union signaled a global economic frustration among working-class voters that could reverberate in the U.S. election.

"There is a lot of legitimate anxiety, fear and even anger in many parts of our country because people feel like the economy has failed them," Clinton said in Denver on Tuesday. "I think this is going to be one of the defining issues in this election."

Trump has seized on the historic Brexit vote to bolster his argument that voters are rising up against establishment leaders, saying Americans would reject the "global elite" and support his presidential candidacy.

But Trump has broken with Republican Party orthodoxy in criticizing trade deals, and has threatened to slap tariffs on Mexican and Chinese imports. His rhetoric has drawn criticism from many economists, who say such practices could spark trade wars.

As Trump spoke, the U.S. Chamber of Commerce, which is usually in sync with prominent Republicans on trade policy, said on Twitter: "Under Trump's trade plans, we would see higher prices, fewer jobs, and a weaker economy."

Investigation reveals arms shipments ongoing.

An expert researcher investigating the ATF’s Operation Fast and Furious gun walking scandal has discovered the operation is ongoing and is likely serving as a conduit for a global gun ring.

Speaking to radio host Alex Jones Tuesday, Lt. Col. Matt Smith-Meck, working on behalf of slain Border Patrol Agent Brian Terry’s family, revealed the botched operation transferred more weapons than initially suspected into the hands of Mexican cartels and possibly abroad.

“Not only is it guns and rifles, but also grenades, grenade launchers, military grade night vision goggles, black special forces tactical uniforms,” Smith-Meck stated, adding that the number of military items relinquished is “more in the magnitude of 4,700.”

Smith-Meck asserts weapons transfers into Mexico are ongoing to this day, and his research suggests the weapons may be resold to broader international networks outside the country.

“What I would speculate is – dovetailing on what Tosh Plumlee has been on your program before and talked about – this is, I think, part of a much larger international gun running operation,” Smith-Meck said.

Explaining the nexus between Fast and Furious and the Middle East, Smith-Meck claimed Mexican traffickers were already on record meeting with foreign purchasers in 2010, and weapons linked to the operation later showed up in Morocco.

“We know from accounts from folks that are actually involved in running these weapons, in September of 2010, weapons – separate from what we would call Fast and Furious – were run down to Mexico, down to a town in Mexico, Caborca actually, met with a international middle eastern arms dealer and en route over to the Middle East,” the retired US Marine said Tuesday.

“And I think of great import, is a Moroccon DST commander – their DST is their internal security forces on 16 October 2010, reported to his supervisors that Fast and Furious weapons were in the kingdom of Morocco en route to arm the rebels in Algeria.”

Smith-Meck was also informed that military equipment and installations were utilized during the operation.

“I was approached by a Col. Taylor – told me he was from OSI, Office of Special Investigations and that the military was aware of possible military installation and equipment involvement with Fast and Furious,” Smith-Meck stated.

According to his sources, Smith-Meck predicts yet another arms transfer to Mexico will occur towards the middle of May.

“We’ve got a mid-May of this year time frame where another large shipment is scheduled to go across from basically Arizona into Mexico, and we’re trying to make sure that does not occur,” Smith-Meck said, adding he had forwarded the information on to Rep. Trey Gowdy.

Additionally, Lt. Smith-Meck, who suspects Agent Terry may have been murdered for digging too deep into Fast and Furious, says he himself has been targeted for harassment.

The investigator says he filed a police report after a March 22, 2015 incident in which someone approached him around 10pm while he was walking his dogs, knocked him down, kicked him in his lower back and told him, “You obviously aren’t getting the message. Keep your Fing mouth shut.”

Smith-Meck declares he will continue searching for the truth behind Brian Terry’s death and is asking for Congress’ help to find answers.

To recap:

• Agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives from 2006 through 2010 convince straw dealers to sell weapons to suspected arms traffickers who may in turn sell them over to Mexican cartels, ostensibly to track the cartels.

• On December 14, 2010 while conducting operations in Nogales, Arizona, Border Patrol Agent Brian Terry was shot and died while attempting to arrest five individuals. Two of the guns found at the scene were linked to Fast and Furious.

• Smith-Meck claims weapons were sold in Mexico to middle eastern arms dealers in September 2010. A Moroccon DST commander – on 16 October 2010 also reported Fast and Furious weapons were in the kingdom of Morocco en route to arm the rebels in Algeria.

**Did Brian Terry Die in Vain?**
**A call to Congress to find answers.**

Border Patrol Agent Brian Terry was murdered on December 14, 2010, ten minutes before his shift ended, and the day before he was going to “blow the whistle” on the Fast and Furious gun-walking debacle. The bullets that ended his life were fired from a Fast and Furious weapon.

Two months earlier, he was visiting his mother in Michigan. Brian, a principled and disciplined former Marine, rarely discussed his work with family. But this trip was different. Speaking with his mother Josephine recently, she told me that Brian acted differently during this visit. He was anxious. It seemed he had the weight of the world on his shoulders. Almost spontaneously over coffee one afternoon, he told his mother, “I just don’t want to go back this time … something bad is going to happen.”

Operation Fast and Furious was initiated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) in 2009 ostensibly as a way to confront the problem of illegal weapons traveling from the United States to Mexican drug cartels. The ill-considered operational design involved allowing straw purchasers in the U.S. to buy weapons and deliver them into Mexico under the supervision of law enforcement. The weapons would be tracked by using serial numbers with the hope that future busts would lead U.S. officials to cartel members.

Brian’s brother, Kent Terry, told us recently that following the killing, law enforcement officials were sympathetic, and most importantly, responsive to the Terry family’s concerns. After a memorial for Brian on January 22, 2011 in Tucson, Arizona, the family was invited to a hotel room full of government suits, including prosecutors and FBI agents. The purported purpose of the meeting was to allow Kent and his brother-in-law, Ron, to “ask any questions you might have” about Brian’s death. Rumors of guns being “walked” across the border to Mexico were already swirling. Ron, not one to mince words, immediately asked about the gun-walking. He told us, and Kent corroborated, that the room fell silent. The officials failed to make eye contact (except with each other). That single question effectively ended the meeting. Both Kent and Ron got the gut feeling that they were summoned there not to have their questions answered but as a fishing expedition. How much did Kent and Ron know? Had Brian confided in them about what he knew? Is this why the government, without notifying the family, went into Brian’s private residence after his murder, rifled through his personal effects and removed all electronic/digital devices and returning them, completely wiped clean, to the family a full year later?

A couple hours later in the same hotel, the Terry family was approached my members of the union that represented Border Patrol personnel, including Brian. The union leadership expressed their condolences, but then very cryptically referred to 3 e-mails that they had received from Brian in the weeks preceding his murder. They wanted the Terrys to be aware of them, but said they weren’t allowed to discuss the content. However, it was obvious, based on the union representative’s tone and demeanor, they weren’t typical union communications, such as transfer requests or shift schedules, for example.

On that final visit with his mother, Brian also told her that he was aggressively confronted by a couple of “bad” agents, and that he told them, “No need to talk to me; I’ll just walk away.” Law-enforcement communities are notorious rumor mills, and we suspect that word had somehow gotten around that Brian was going to speak up about weapons going south with BATFE’s permission, and expose, unbeknownst to Brian, the clandestine nature of Operation of Fast and Furious. We suspect this confrontation was borne out of concern to protect the architects and the players. Brian wasn’t part of the Fast and Furious Operation, but he had stopped vehicles attempting to enter Mexico that contained numerous AK-47 assault rifles. When he radioed the discovery to supervisors, the response was “Let ‘em through.” This troubled him.

In January 2011, ATF agents John Dodson and Vince Cefalu “blew the whistle” on Fast and Furious after learning that the ballistic results showed that a Fast and Furious weapon was used to kill Brian.

The House of Representatives’ Committee on Oversight and Government Reform (HOGR) launched an investigation into Fast and Furious. The Justice Department’s reluctance to cooperate was evident from the very beginning. A February 4, 2010 letter from an Assistant Attorney General to Senator Grassley, Ranking Minority Committee Member for the Judiciary, denied that straw purchased weapons were being deliberately sent over the border into Mexico. The Department did a full 180 degree turn almost a year later, officially retracting their earlier assurances, and admitting that the gun-walking operation was real.

Congress decided to dig deeper, issuing subpoenas for any information including e-mails and other correspondence pertaining to Fast and Furious. After much wrangling and negotiation, the DOJ turned over information compiled prior to February 4th, the day when they claimed the operation didn’t allow for the transport of weapons. On May 3, 2012, Chairman Darrell Issa—presumably frustrated by the Department’s stone walling—issued the following points in a memorandum to fellow members of the committee he chaired:

Some important areas remain cloaked in secrecy:

1. How did the Justice Department finally come to the conclusion that Operation Fast and Furious was “fundamentally flawed?”

2. What senior officials at the Department of Justice were told about or approved the controversial gun-walking tactics that were at the core of the operation’s strategy?

3. How did inter-agency cooperation in a nationally designated Strike Force fail so miserably in Fast and Furious?

These questions—four years later—still have not been answered. The Terry family and the American people deserve better. When the investigation began, members of Congress (House Oversight and Government Reform and Senator Grassley’s offices, specifically) and their staffs were very forth coming to the Terry family about the status of the investigation, answering questions and offering support. The Terrys have reported to us this, sadly, is no longer the case. At first the Terry Family truly believed the truth would come out concerning Brian’s murder, including both what reckless decisions about gun-walking were made and by whom within the Justice Department leadership made them. Now, with the knowledge that actionable information regarding “evidence to lay hands on” was provided to law enforcement, HOGR, and Senator Grassley’s offices in 2012 and 2013 without any meaningful responses, the Terry family is rightly distrustful and discouraged.

On January 19, 2016, the Honorable Amy Berman, U.S. District Judge for the District of Columbia, issued an opinion ordering certain withheld documents regarding Fast and Furious be turned over to the House Oversight and Government Reform Committee. Perhaps this new material will reignite the investigative fire for members of Congress and lead to answers for the Terry family, the American people, and the institution of justice. For Brian Terry, the work of Congress has just begun.
