PENTAGON SUED FOR ALLOWING MEN WHO BEAT WOMEN TO POSSESS GUNS (VETS NOT EXEMPT)

PENTAGON SUED FOR ALLOWING MEN WHO BEAT WOMEN TO POSSESS GUNS:

VETS WHO BEAT THEIR WIVES SHOULD NOT BE EXEMPT.

VETS WHO BEAT THEIR WIVES SHOULD BE COURT FORCED INTO THERAPY, NOT ALLOWED TO CARRY GUNS.

NO WOMAN CAN PROVOKE A MAN TO BEAT HER BRAINS OUT OR SHOOT HER BRAINS OUT.

21st CENTURY AMERICA STILL LAGS WHEN IT COMES TO PROTECTING WOMEN.

***** After Texas church massacre, cities sue Pentagon for failing to report criminals to FBI gun database

Three cities have filed suit against the Pentagon for lapses that allowed a mass shooter in Texas to buy a gun, even though he carried a conviction in military court that should have barred his purchase.

Devin P. Kelley, who was convicted of domestic violence while serving in the U.S. Air Force, was never reported by the military for inclusion on an FBI database of individuals blocked from purchasing firearms. Kelley went on to kill more than two dozen churchgoers in Sutherland Springs, Tex., last month in one of the worst mass shootings in U.S. history.

In the complaint filed Tuesday in U.S. District Court in Alexandria, Va., the three cities — New York, San Francisco and Philadelphia — say they rely on the integrity of the FBI’s background check system. The suit alleges that the defendants, which include the military branches and Defense Secretary Jim Mattis, have an “admitted, systemic and longstanding failure to comply with the law.”

The cities are seeking to force the Defense Department to fully participate in the reporting system, which they said is already required by law. They also want the court to oversee the department’s compliance efforts.

“The Executive Branch and Congress have both had their chances to repair this clearly broken system. Now, after twenty years of failure, it’s time for the Courts to step in,” Ken Taber, a partner at Pillsbury Winthrop Shaw Pittman and lead counsel for the plaintiffs, said in a statement. The Giffords Law Center to Prevent Gun Violence also helped prepare the suit.

A spokesman for the Defense Department declined to comment Wednesday, citing a policy against commenting on ongoing litigation. A spokesman for the Justice Department said the attorney general has launched his own investigation into the issue.

“After visiting first responders and victims’ families in Sutherland Springs, Attorney General Jeff Sessions instructed the ATF and FBI to conduct a comprehensive review with the Department of Defense of how certain information is reported to the National Instant Criminal Background Check System,” Justice Department spokesman Devin O’Malley said in an email Wednesday. “The Justice Department is reviewing yesterday’s lawsuit and determining next steps.”

Members of a family ravaged by the Sutherland Springs shooting have also filed suit against the Air Force, alleging its failure to report Kelley’s criminal background led to their loved ones’ slayings.

Military officials have long acknowledged problems with the way it reports records to the FBI gun background check database.

According to Pentagon guidelines, military law enforcement personnel are supposed to submit fingerprint cards as well as information about the results of a criminal proceeding to the FBI database if troops are charged with or convicted of certain violent crimes, including domestic violence and child abuse.

However, a recent review by the Pentagon’s oversight agency, which examined 2,502 criminal cases between January 2015 and December 2016, found that 1 in 4 fingerprint cards were not submitted to the database. Military law enforcement failed to submit one-third of the final disposition reports, the review found.

Kelley’s record should have disqualified him from purchasing a weapon. Kelley spent a year in jail for crushing his young stepson’s skull, assaulting his wife and making other threats. He received a bad-conduct discharge from the military in 2014, a step below a dishonorable discharge.

Two years after his discharge, Kelley cleared a background check and bought a Ruger AR-556 semiautomatic rifle from a San Antonio sporting goods shop.
The weapon was found in front of the First Baptist Church in Sutherland Springs after the Nov. 5 killings.

JAHI MCMATH UPDATE: She Was Transferred But Family Is Receiving Death Threats (God Bless Attorney CHRIS DOLAN!)

#JahiMcMath

Following a Mediation meeting ordered by a FEDERAL Judge,
JAHI MCMATH has been released from the OAKLAND, CALIFORNIA Hospital that Butchered this 13-year-old BLACK Child & then left her for DEAD.

Last weekend JAHI was released to her MOTHER via a Court Order & transferred to another Medical Facility where she will receive continued Medical care.

She was removed from the OAKLAND CHILDREN'S HOSPITAL on a Ventilator, but the Hospital REFUSED to Re-insert her FEEDING TUBE.

FYI: According to the Attorney representing JAHI'S Family (CHRIS DOLAN),
she is now receiving NUTRITION & ANTIBIOTICS at her new location.

Praise GOD! May the good LORD Bless CHRIS DOLAN for his dedication & hard work for JAHI'S Family.

However due to DEATH THREATS made against JAHI'S Family, the Medical Facility where JAHI was Transferred will remain Unidentified.

JAHI'S DEATH CERTIFICATE was signed by a CORONER, dated DECEMBER 12, 2013.

JAHI MCMATH is BRAIN DEAD but NOT Physically DEAD after a Routine TONSILLECTOMY Procedure.

I repeat.

JAHI MCMATH'S Family has received DEATH THREATS & her DEATH CERTIFICATE was signed by a CORONER for DECEMBER 12, 2013.

So why the DEATH THREATS??

There are Powerful people who are Blood Thirsty for Human ORGANS, which is a very Lucrative Industry in America.

JAHI'S Young Vital Organs are worth close to $500,000!!

This explains why Hospitals are now Intentionally conducting acts of GROSS NEGLIGENCE & MEDICAL MALPRACTICE so they can Declare Young Patients BRAIN DEAD.

Human ORGANS taken from Children........Teens......and Young Adults are much more VALUABLE & in High Demand.

I suggest You PRAY.....TRUST GOD MORE....EAT HEALTHIER and EXERCISE.

HUMAN ORGANS ARE IN HIGH DEMAND……..STAY OUT OF HOSPITALS IF POSSIBLE………HOSPITALS ARE DECLARING PATIENTS "BRAIN DEAD" TO OBTAIN HUMAN ORGANS.

As it relates to HUMAN ORGAN Donations.......

Yes the Hospital is supposed to obtain LEGAL CONSENT from the Parents or next of kin FIRST.

However please know that HOSPITALS have been Stealing HUMAN ORGANS from PATIENTS for Decades.

Especially from Poor PATIENTS & BLACK Patients!

(My Mother worked in the Nursing Field for more than 20 years before She Retired.)

When a Physician signs off on the documents that you are DEAD.....they can STEAL your ORGANS before they roll you into the MORGUE.

Since the HUMAN Body is NO longer viewed as Sacred in American Society, this process of removing ORGANS is akin to Slaughtering ANIMALS.

Only a trained, licensed MORTICIAN can really determine if HUMAN ORGANS are missing from a Body because there are ways to Surgically remove ORGANS without disfiguring the Body.

I know it sounds HORRIBLE but its nothing new in the Medical Industry.

HUMAN ORGANS are worth big Buck$$$$!!

Especially HUMAN ORGANS from Children...Teens.....and Young Adults.

ARTICLE: "Brain Dead Girl Jahi McMath Released From California Hospital"

STORY HIGHLIGHTS:

***Attorney: "We're very relieved that she got safely to where she needed to be".

***Jahi McMath is now receiving antibiotics and nutritional support, he says.

***The 13-year-old is on a ventilator and has been declared brain dead by some doctors.

***Her family has moved her to another facility.

Jahi McMath, a 13-year-old girl on a ventilator who was declared brain dead by California doctors after tonsil surgery, was released from a hospital to her mother Sunday night and moved to a facility willing to continue her care.

"We're very relieved that she got safely to where she needed to be, because we were all very afraid given the fragile condition as she wasted away at Children's that she might not make it," Attorney Chris Dolan told reporters Monday.

The move to an undisclosed location ends one chapter of a weekslong struggle between Children's Hospital & Research Center Oakland, which sought to remove Jahi from the ventilator after it and a judge concluded she was brain dead, and her relatives, who fought in court to keep her on life support and contended she showed signs of life.

The hospital released Jahi on Sunday to the Alameda County coroner, who then released her to her mother's custody, said David Durand, the hospital's chief of pediatrics. The hospital had previously said it needed the coroner's consent for the transfer because Jahi was legally dead.

Jahi -- who was declared brain dead December 12 after post-surgery complications that her family says included severe bleeding and cardiac arrest -- was moved from the hospital Sunday accompanied by a critical care team. She was attached to a ventilator, but with no feeding tube in place.

On Monday, Dolan said Jahi was being given antibiotics to fight infections and nutritional support.

"They're giving her everything that a person who would have a chance to live would be getting," he said.

He declined to provide details about the type of facility, citing privacy and security concerns.

"She's where she's going to be for a while," he said. "She needs to be medically stabilized, medically treated."

Although a New York facility has said it's ready to care for Jahi, Dolan told reporters Sunday night that her destination won't be announced.

"We've had people make threats from around the country. It's sad that people act that way," Dolan said. "So for Jahi's safety and those around her, we will not be saying where she went or where she is."

Let parents decide if teen is dead

But New Beginnings Community Center in Medford, New York, said it is an option.

"At this time we're named as the potential facility that Jahi and her family will be coming to, but we will know more details in a couple of hours, and we'll certainly be happy to let you know as we know," said Allyson Scerri, founder of New Beginnings, on Sunday.

On its website, the facility bills itself as an outpatient rehabilitation center for patients with traumatic brain injuries and says it plans to open a long-term care facility. According to her online biography posted on the facility's website, Scerri worked as a hair stylist for 25 years and founded the facility after her father sustained a traumatic brain injury in a motorcycle accident.

"We are aware of Jahi McMath's dire situation, and we are willing to open our outpatient facility to provide 24-hour care as an inpatient, long-term facility for Jahi with the required and appropriate medical staff that she depends upon," Scerri said in a letter included in court documents last week.

The surgery

Jahi's case drew national attention and fueled debate as a fierce court battle unfolded between devastated family members fighting to keep her on a ventilator and doctors arguing she'd already died.

Family members say the eighth-grader was alert and talking after doctors removed her tonsils, adenoids and extra sinus tissue in a surgery at the Oakland hospital on December 9.

Doctors had recommended the surgery to treat pediatric obstructive sleep apnea, a condition which made her stop breathing in her sleep and caused other medical problems.

Before the surgery, Jahi said she was worried that she would never wake up, according to her uncle. She seemed fine after the surgery, but asked for a Popsicle because her throat hurt.

Not long afterward, something went terribly wrong. In an intensive care unit, the girl began bleeding profusely, the family said.

According to family members, Jahi went into cardiac arrest. Days later, she was declared brain dead.

Hospital officials have said privacy laws prevent them from discussing details of the case.

The court battle and the medical debate

The family and the hospital disagreed over whether to disconnect her from a ventilator, and the issue wound up in Alameda Superior Court.

In court documents and public comments, the hospital maintained that there's no doubt that McMath is brain dead, describing the condition as irreversible.

"No amount of prayer, no amount of hope, no amount of any type of medical procedure will bring her back," Children's Hospital Oakland spokesman Sam Singer said last month. "The medical situation here in this case is that Jahi McMath died several weeks ago."

A judge on December 23 appointed Dr. Paul Fisher, chief of pediatric neurology at Stanford Children's Hospital, to evaluate Jahi.

Fisher concluded the next day that she met the criteria for brain death. According to a court filing, Fisher found that the girl's pupils were fully dilated and unresponsive to light and that she did not respond to a variety of intense stimuli.

His report also says Jahi showed no sign of breathing on her own when a ventilator was removed: "Patient failed apnea test." The report says her heart was beating only because of the mechanical ventilator.

In addition, an imaging test showed no blood flow to Jahi's brain, while another showed no sign of electrical activity.

Fisher's conclusion: "Overall, unfortunate circumstances in 13-year-old with known, irreversible brain injury and now complete absence of cerebral function and complete absence of brainstem function, child meets all criteria for brain death, by professional societies and state of California."

After seeing Fisher's report, Alameda Superior Court Judge Evelio Grillo concluded on December 24 that Jahi was brain dead. But Grillo twice ruled that the hospital had to hold off on disconnecting Jahi from life support, ultimately giving the family and the facility until January 7 to come to a resolution.

The Alameda County coroner issued a death certificate for Jahi on Friday, listing December 12 as the date of death. The certificate still needed to be accepted by the health department to become official.

Medical ethicists, meanwhile, say the high-profile case fuels a misperception: that "brain death" is somehow not as final as cardiac death, even though, by definition, it is. The case is "giving the impression that dead people can come back to life," Arthur Caplan, director of the Division of Medical Ethics at NYU Langone Medical Center, told CNN last month.

Family members say they've seen reason for hope

Jahi's family members maintain that they're hoping for a miracle and want her care to continue elsewhere.

Her mother told CNN last month that she'd seen improvements, including indications from a hospital monitor that she said suggest her daughter was trying to breathe on her own.

The girl's uncle, Omari Sealey, told reporters last week that Jahi moves when her mother speaks and touches her. Sealey also said that a pediatrician has seen Jahi and has sworn she is not dead.

Hawaii girl, 3, dies after dental procedure

When asked about the girl's possible movement, Singer, the hospital spokesman, said he would not comment directly on any claims the family makes, citing privacy laws. However, Singer said it is "quite common" for the muscles of brain dead patients to move, stressing it's "not a sign of life."

So far the family has raised more than $50,000 on GoFundMe.com to move her. According to the site, more than 1,300 people have donated money in 10 days.

"We're very grateful, very proud," said Sealey, Jahi's uncle. "We want to thank everyone that supported us, everyone that stood in our corner, everyone that prayed for us, everyone that helped donate to make this possible. Without you guys, none of this would be possible."

Scerri of New Beginnings told CNN on Sunday that the girl just needs to be given a chance to recover.

"Her brain needs time to heal. It's a new injury," Scerri said. "We believe in life after injury. All of us here at New Beginnings have firsthand experience because we have a loved one that was in the same situation as Jahi."

Dolan said moving Jahi to a new care facility is critical to her recovery.

"We're very pleased to announce that Jahi McMath has been taken from Children's Hospital and brought to a place where they will use her name instead of calling her a body, and where she can get to the starting line instead of where Children's has left her the past four weeks almost, at the finish line."

In releasing Jahi, the hospital said: "Our hearts go out to the family as they grieve for this sad situation and we wish them closure and peace."

OBAMACARE vs SCOTUS: Justice Sotomayor Grants Religious Organizations Exemption From Contraceptive Mandate (For Now)

#ObamacareMandate

Tuesday evening SCOTUS Justice Sotomayor Blocked the OBAMACARE Contraception Mandate.

She allowed Religious Organizations to be Exempt from the Contraception Mandate.

However she has given the OBAMA Admin until Friday to respond to her Ruling.

"Justice Blocks Contraception Mandate On Insurance In Suit by Nuns"

Justice Sonia Sotomayor on Tuesday temporarily blocked the Obama administration from forcing some religious-affiliated groups to provide health insurance coverage of birth control or face penalties as part of the Affordable Care Act.

Acting at the request of an order of nuns in Colorado, Justice Sotomayor issued the stay just hours before the requirement was to go into effect on New Year’s Day. She gave the Obama administration until Friday to respond to the Supreme Court.

Justice Sotomayor’s order applies to the nuns, the Little Sisters of the Poor, and other Roman Catholic nonprofit groups that use the same health plan, known as the Christian Brothers Employee Benefit Trust. The groups’ lawsuit is one of many challenging the federal requirement for contraceptive coverage, but a decision on the merits of that case by the full Supreme Court could have broader implications.

“We are delighted with the ruling,” said Mark L. Rienzi, a lawyer at the Becket Fund for Religious Liberty, who represented the nuns in the lawsuit. “We are delighted that the Supreme Court will require the government to file briefs in the court on this matter.” The Little Sisters of the Poor operate nursing homes for low-income people in the United States and around the world.

Without Justice Sotomayor’s order, the nuns “would have been forced to comply with the contraceptive mandate on Wednesday or face large fines,” Mr. Rienzi said late Tuesday.

The contraception requirement has been one of the most controversial aspects of the health law since the Obama administration first announced it in mid-2011, along with other requirements it characterized as preventive care. Religious opponents of abortion have objected especially strongly to the requirement to provide emergency contraception pills, like Plan B, although most studies show that the drug works by preventing fertilization, not by inducing abortion.

In an effort to compromise, the administration said that women who work for nonprofit religious groups that object to birth control could receive separate coverage not paid for by the employers. It refused, however, to offer accommodations to secular businesses whose owners have religious objections to contraception.

That has led to a separate group of lawsuits. And last month, the Supreme Court agreed to hear a pair of cases on whether corporations may refuse to provide insurance coverage for contraception.

Justice Sotomayor — who later was to lead the countdown for the Times Square ball drop — issued her order after the United States Court of Appeals for the 10th Circuit, in Denver, earlier on New Year’s Eve denied the nuns’ request for a preliminary injunction to block enforcement of the contraceptive coverage requirements imposed by the new health care law.

The Obama administration had argued that the Little Sisters of the Poor could opt out of the contraceptive coverage requirement by completing “a self-certification form” and providing it to the entity that administers their health benefits. Therefore, the Justice Department said, the contraceptive mandate imposes “no substantial burden on their exercise of religion.”

“To opt out of providing contraceptive coverage, Little Sisters need only certify that they are nonprofit organizations that hold themselves out as religious and that, because of religious objections, they are opposed to providing coverage for some or all contraceptive services,” the Justice Department told the appeals court on Monday.

The administration says it has exempted churches from the contraceptive coverage requirement and offered an accommodation to certain religious nonprofit groups. But the Becket Fund argued that “the ‘accommodation’ still forces the Little Sisters to find an insurer who will cover sterilization, contraceptive and abortion-inducing drugs and devices.”

“The Sisters would also be required to sign a form that triggers the start of that coverage,” it said. “In good conscience, they cannot do that. So the ‘accommodation’ still violates their religious beliefs.”

The Obama administration has repeatedly defended the birth control requirement. “The president believes that no one, including the government or for-profit corporations, should be able to dictate those decisions to women,” Jay Carney, the White House press secretary, said last month.

One of the pending Supreme Court cases was filed by Hobby Lobby, a corporation owned by a family whose members have said they try to run the business on Christian principles. The company, which operates a chain of arts-and-crafts stores and has more than 15,000 full-time employees of many faiths. Hobby Lobby has said it has no problem with offering coverage for many forms of contraception, including condoms, diaphragms, sponges, several kinds of birth control pills and sterilization surgery. But drugs and devices that can prevent embryos from implanting in the womb are another matter, and make it complicit in a form of abortion, the company said.

The other case was filed by the Conestoga Wood Specialties Corporation, which makes wood cabinets and is owned by a Mennonite family that had similar objections to the law.

"Jahi McMath’s Mother Claims Hospital Is Starving Supposedly Brain-Dead Daughter"

The mother of a California girl declared brain-dead claims the hospital is starving her daughter while the family fights to keep her on life support.

"To watch my daughter just sit there and not have food ... I'm just so happy that she is kind of a thick girl so she still looks good," Nailah Winkfield told ABC’s "Good Morning America." "I tell her every day, 'Jahi, you losin' weight girl, but you still look good.' I just think it's inhumane to not feed my child, to not refer to her by her name, and stop us in our tracks."

Relatives of 13-year-old Jahi McMath are locked in a legal battle with Children’s Hospital Oakland over the girl’s future. The family’s lawyer says the hospital has blocked their attempts to have feeding and breathing tubes inserted— a crucial step in the family’s quest to transfer the Jahi to a long-term facility.

Hospital officials say McMath is dead, and they can’t operate on a corpse.

"Performing medical procedures on the body of a deceased human being is simply not something Children's Hospital can do or ask its staff to assist in doing," hospital attorney Douglas Straus said.

Jahi went into cardiac arrest on Dec. 9 at the hospital following tonsil surgery to treat sleep apnea.

Children’s Hospital doctors declared her brain-dead three days later, but the girl’s family insists she is still alive.

The family has received support from a New York-based neurological foundation that was sending doctors to California to examine the girl.

Dr. Jonathan Fellus, chief medical officer with the International Brain Research Foundation, said Jahi needs time to heal from the cardiac arrest before doctors can make a definitive conclusion.

“Basically we need the dust to settle,” Fellus told the Daily News on Tuesday.

Winkfield claims her daughter moves at the sound of her parents’ voices and she says the hospital has been insensitive.

"I hate it that they refer to her as just the body or the deceased," Winkfield told ABC’s "Good Morning America." “That is my child that they're talking about.

They don't even use her name."

Children’s Hospital was set to unhook Jahi’s ventilator on Monday, but a court order in the final hours extended the deadline to Jan. 7.

The family has been desperately searching for another facility to take Jahi before time runs out.

KWinkfield’s lawyer, Christopher Dolan, said the New Beginnings Community Center in Medford, N.Y., is a possibility, but Children’s Hospital is making it difficult by denying their attempts to bring in doctors to insert breathing and feeding tubes.

"They're speaking out of both sides of their mouths,” Dolan said. “They say one thing and we go down that road, and then they say something else. The hospital said, 'Bring us a doctor,' and we said, 'Tell us the conditions,' and now, they've wasted a half a day of our time. We don't have much time."

A hospital spokesman said the family hasn’t produced any doctors willing to perform the surgeries.

JAHI MCMATH Is Still Alive! GOD Performed A Miracle!! She Is Being Transferred!! (Please Keep PRAYING)

#JahiMcMath

BREAKING NEWS ABOUT JAHI MCMATH......GOD PERFORMED A MIRACLE TODAY!!

SHE IS STILL ALIVE!!.....A JUDGE GIVES HER FAMILY UNTIL JANUARY 7TH!!

A HOSPITAL IN NEW YORK WILL ACCEPT JAHI MCMATH FOR CONTINUED CARE.

JAHI WAS SUPPOSED TO BE REMOVED FROM LIFE SUPPORT TODAY AT 5:00 PM BUT HER FAMILY FILED AN APPEAL........PLEASE KEEP PRAYING.

ARTICLE: "Brain-Dead Teen To Remain On Life Support Pending Appeal By Family"

With an hour to spare, a judge ordered a stay on the restraining order against the hospital that was scheduled to take the 13-year-old girl rendered brain-dead by elective surgeries in California off life support Monday evening.

Jahi McMath is allowed to remain on life support until Jan. 7, a California judge ruled.

Jahi underwent a tonsillectomy and other operations to alleviate her sleep apnea on Dec. 9. She started bleeding profusely and went into cardiac arrest shortly after.

The young girl’s family has been in a legal battle with Children’s Hospital in Oakland since Doctors at the hospital declared her brain-dead three days later.

The family gained a restraining order preventing doctors from removing Jahi from a ventilator keeping her alive, but Superior Court Judge Evelio Grillo revoked the order Tuesday after hearing testimony from an independent physician who also ruled Jahi met “all criteria for brain death," according to NBC Bay Area.

Grillo said Children’s Hospital would have allowance to remove Jahi from life support at 8 p.m. local time Monday (5 p.m. ET) unless the family filed a formal appeal.

The family filed an appeal just before 4 p.m. (7 p.m. ET) on Monday, according to NBC Bay Area.

Omari Sealey, left, uncle of 13-year-old Jahi McMath, and Sandra Chatman, grandmother of McMath speak to members of the media after a court hearing in Oakland, Calif., on Dec. 24.

"We are hopeful that one of these actions will forestall the hospitals rush to extinguish Jahi's chance at life," said Jahi's uncle, Omari Sealey.

Jahi’s parents have insisted that their daughter is alive, regardless of doctors’ opinions that Jahi’s condition is irreversible.

"I would probably need my child's heart to stop to show me that she was dead. Her heart was still beating, so there's still life there," Jahi's mother, Nailah Winfield said Friday, according to the Associated Press.

In efforts to keep Children’s Hospital from removing Jahi from the machine that was supporting her basic life functions, her family tried to move her to other facilities in California, but doctors at both facilities refused to treat someone who had been declared dead.

An unnamed hospital in New York agreed to take the teenager, but only after she underwent more medical procedures, according to the Associated Press.

David Durand, chief of pediatrics at Children's Hospital said administrators did “not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice.”

On Friday Winfield wrote on a fundraising page, “My family and I are still striving to find a location that will accept her in her current condition … Let us pray that some one (sic) will have the heart to accept her despite what Children's Hospital says. So that we can get her air lifted away from this place as soon as possible.” On Monday, donors had contributed over $25,000 to Jahi’s cause.

NBC Bay area reported that Sealey said that a hospital in New York had agreed to admit Jahi and on Monday, the family was organizing for an air ambulance to transfer the teen across the country.

JAHI MCMATH Update: Murdering Jahi McMath Just Like Terri Schiavo (Blog Talk Radio Broadcast)

Listen to internet radio with Black Political Buzz on Blog Talk Radio

#JahiMcMath

BLOG TALK RADIO BROADCAST: "MURDERING JAHI MCMATH JUST LIKE TERRI SCHIAVO"

On this NEW episode of my Blog Talk Radio Broadcast I will discuss the pending situation of a Life & Death crisis surrounding JAHI MCMATH, a 13-year-old BLACK Girl from OAKLAND, CA.

She is to be removed from LIFE SUPPORT today at 5:00pm.

(PLEASE KEEP PRAYING!)

I will also discuss how JAHI'S current situation somewhat mirrors that of a Young, WHITE Woman named TERRI SCHIAVO back in 2005 by her Husband in the State of FLORIDA, when he had her removed from LIFE SUPPORT for Life Insurance MONEY!

On Dec 2, 2013 JAHI was admitted to the OAKLAND CHILDREN'S HOSPITAL for a Tonsillectomy i.e, a routine Surgery involving very low Risk.

However during the procedure JAHI mysteriously went into CARDIAC ARREST.

According to Hospital Officials JAHI begin to spit up Blood during the procedure.

I'm Not a Physician but how did this occur?

Prior to going on the Operating Table, JAHI'S Doctors had full knowledge of her Medical History, so how did this occur?

Did she receive too much Anesthesia or too little Oxygen?

Was She Operated on by a Medical Student who cut the Wrong Artery in ERROR??

i.e., GROSS NEGLIGENCE and MEDICAL MALPRACTICE

Was this so-called CARDIAC ARREST planned as a way of STEALING her ORGANS?

(ORGAN Harvesting is Big Busine$$ in the U.S.)

Immediately after JAHI went into CARDIAC ARREST, Hospital Officials wanted to take this precious Child off LIFE SUPPORT.

In fact they had the OAKLAND CORONER'S OFFICE lined up to take her body away ASAP.

But JAHI'S Parents who are Born Again CHRISTIANS (like Myself) Refused to accept LIES told them by Hospital Officials & they Refused to remove JAHI off LIFE SUPPORT.

Legal Action was filed and a JUDGE (most likely schooled by Gov JERRY BROWN) declared JAHI to be legally "BRAIN DEAD".

JAHI MCMATH is NOT Dead, nor is She is DECEASED but the Politicians....Media.....and Hospital Officials have declared her as Dead.

Hospital Officials & Politicians are even fighting to prevent JAHI from being Transferred to another Medical Facility.

Why??

POLITICS...... MONEY & JAHI'S ORGANS!

If POLITICIANS and OAKLAND CHILDREN HOSPITAL Officials proceed with their devious Plans to Murder JAHI MCMATH, they will face the Judgement of GOD Almighty & the Lord JESUS CHRIST before they leave this Earth.

GOD Himself Will Judge Them NOT The POPE!

Because the POPE is Not GOD, nor is he JESUS CHRIST!

"Jahi McMath's Family Searches For Options As Life-Support Cut-Off Looms"

While many people get their New Year's countdown clocks ready, Jahi McMath's family is scrambling as a darker deadline looms.

A judge's ruling will allow a hospital to disconnect life support machines at 5 p.m. Monday from the 13-year-old girl, whom doctors declared brain dead after she suffered complications from tonsil surgery earlier this month. Jahi's family, who wants to transfer her somewhere else, told CNN affiliate KGO that they spent Sunday working the phones, trying to line up another option.

The case has drawn national attention and sparked protests from some local leaders who say the hospital that treated her should have provided better care.

Medical ethicists, meanwhile, say the high-profile case fuels a misperception: that "brain death" is somehow not as final as cardiac death, even though, by definition, it is. The case is "giving the impression that dead people can come back to life," Arthur Caplan, director of the Division of Medical Ethics at NYU Langone Medical Center, told CNN last week.

But Jahi's family members maintain that they're hoping for a miracle and want to transfer the girl from Children's Hospital Oakland to another facility. A statement released by family members Saturday and provided to KGO says they are weighing several options.

"Our attorney is in discussions with two facilities that have expressed preliminary approval for accepting Jahi on a ventilator," the statement said. "One is in Southern California, the other is in New York."

Doug Straus, an attorney representing Children's Hospital Oakland, said in a letter to the family's lawyer Sunday that officials are still awaiting specifics from the family.

"To date, there has been no communication from any facility named by you regarding a transfer or requirements for transfer with any of the medical professionals at Children's. The family has not identified any facility with which Children's can have this dialogue.

Nor have we been provided with a transportation plan or coroner authorization," he wrote. "As your email and your statements about the facility in the Los Angeles area acknowledge, discussion about performing medical procedures upon a dead body presents unusual and complicated questions. Until there is a definite commitment by a facility to accept Jahi's body upon specified terms, I don't think I can tackle those issues. Please let me know if the family is able to identify a facility."

Jahi was declared brain dead by doctors at the hospital on December 12, three days after tonsil surgery.

Family members and hospital officials fought over her future in court. Last week, a judge ruled she was brain dead and urged both sides to work together to resolves the situation.

But the sparring showed no sign of slowing over the weekend, with family members sharply criticizing the hospital's handling of the matter.

"We wish to acknowledge that Jahi's case, and our stance regarding her right to life, and her mother's right to make decisions regarding her child, has stirred a vibrant, sometimes polarizing, national debate. This was never our intention," the family's statement said. "We have our strong religious convictions and set of beliefs and we believe that, in this country, a parent has the right to make decisions concerning the existence of their child: not a doctor who looks only at lines on a paper, or reads the cold black and white words on a law that says 'brain dead' and definitely not a doctor who runs the facility that caused the brain death in the first place."

The hospital's statement Sunday said they were supporting Jahi's family.

"We continue to do so despite their lawyer's criticizing the very hospital that all along has been working hard to be accommodating to this grieving family," the hospital said.

TERRI SCHIAVO Was Removed From Life Support & Murdered For MONEY (Right-To-Life)

#TerriSchiavo

TERRI SCHIAVO was Murdered in 2005 by her Husband in the State of FLORIDA when he had her removed from LIFE SUPPORT for Life Insurance MONEY and to Re-marry.

"Terri Schiavo Has Died; March 31, 2005"

Terri Schiavo, the 41-year-old brain-damaged woman who became the centerpiece of a national right-to-die battle, died Thursday morning, nearly two weeks after doctors removed the feeding tube that had sustained her for more than a decade.

Brother Paul O'Donnell, a spokesman for Bob and Mary Schindler, Schiavo's parents, said the couple was with their daughter's body and praying.

Wednesday, the Schindlers lost what their lawyer described as their "last meaningful legal appeal" in their desperate battle to have their brain-damaged daughter's feeding tube reinserted.

The U.S. Supreme Court late Wednesday refused once again to hear an emergency appeal from the Schindlers.

Their lawyer, David Gibbs, heard the high court had rejected the appeal during a news conference outside the Pinellas Park, Florida, hospice where Schiavo was receiving care.

"It appears that that will be the last meaningful legal appeal unless something comes up," Gibbs had said. "Fundamentally, the decision of the Florida courts will remain unchanged and the federal courts have declined to get involved."

Thursday morning, O' Donnell said that Schiavo was in her final hours of life, and police have prohibited her blood relatives from spending time with her.

O'Donnell, one of the family's spiritual advisers, said that her parents and siblings were "begging to be at her bedside...but are being denied."

Michael Schiavo Was Terri's Guardian And Controlled Who May Visit Her And When.

Pasco-Pinellas Circuit Judge George Greer in Clearwater, Florida, ordered the feeding tube removed March 18 at Michael Schiavo's request. He has said that his wife wouldn't have wanted to live in her condition -- what Florida courts have deemed a "persistent vegetative state."

The parents felt otherwise and had sought to take guardianship of their daughter from her husband. Their bitter court battles began in 1998.

"I don't understand why Michael Schiavo at some point didn't walk away," Gibbs said.

Justice Anthony Kennedy, who has jurisdiction over Florida, Georgia and Alabama, and could have ruled on the petition on his own, referred the appeal to the entire Supreme Court at 10:40 p.m. Wednesday.

There was no breakdown of the vote, and the high court issued no explanation for its decision. The petition had been filed earlier in the night.

It was the second time in a week the high court refused to hear the case, and the sixth time since 2001.

The Schindlers "can know they have done everything possible under the law in letting government know that they wanted to fight for the life of their daughter," Gibbs said.

In his Supreme Court filing, Gibbs and other lawyers for the parents wrote that removing the tube represented "an unconstitutional deprivation of Terri Schiavo's constitutional right to life."

The Supreme Court's rejection came hours after the 11th U.S. Circuit Court of Appeals in Atlanta, Georgia, rejected the parents' petition 9-2. That court denied three similar requests from the parents last week.

In a concurring opinion of the Atlanta court's latest ruling, Judge Stanley Birch said Congress "chose to overstep constitutional boundaries" by passing a law to force the Schiavo case into federal courts.

Judges Gerald Tjoflat and Charles Wilson dissented, with Tjoflat writing that the Schindlers deserved a hearing on the merits of their argument.

On March 21, three days after Schiavo's feeding tube was removed, Congress passed a bill transferring jurisdiction of the case from Florida state court to a U.S. District Court, for a federal judge to review. President Bush signed it into law the next day. But federal courts refused to overturn the state courts' decision.
2002 videotapes released

The Pinellas County Probate Court has released nine of 11 videotapes of Terri Schiavo recorded in the summer of 2002 and shown in a Florida appeals court hearing on her medical condition.

The videos show several doctors talking to and examining Schiavo to get ready for their court testimony. The tapes were recorded from July to September 2002.

Family members, including her mother and husband, also appear in the video.

Two of the 11 tapes remain sealed by the court, but it was unclear why.

In October 2002, Florida's 2nd District Court of Appeal heard a week of testimony from five doctors who examined her, including two picked by Michael Schiavo, two by her parents and one picked by the court.

Three doctors, including one appointed by the court, testified that Terri Schiavo was in a persistent vegetative state with no hope of recovery. The two doctors selected by the Schindlers testified they thought she could recover.

The appellate court concurred with a lower court decision that Schiavo had no hope of recovery and that her feeding tube could be removed.

Terri Schiavo collapsed in her home in 1990, suffering from heart failure that led to severe brain damage because of lack of oxygen.

Her husband has said she suffered from bulimia, an eating disorder, that resulted in a potassium deficiency that triggered the heart failure.

Michael Schiavo's Insurance Company Contributed to "Death with Dignity" Bill Supporter

CLEARWATER, Florida, April 5, 2005 (LifeSiteNews.com)

- The Jerger & Centonze Insurnace (sic) Agency, a company that lists its address as 2807 Marrie Court - Michael Schiavo's address - and has as a co-founder, Michael's girlfriend/fiancé Jody Centonze, was a contributor to the campaign of death-with-dignity bill champion Florida Senator Jim King.

"Conflicts of interest among key players in the Terri Schiavo controversy could give the United Nations oil-for-food investigation a run for its money," wrote canadafreepress.com Editor Judi McLeod. "Campaign contributors to the political campaign of district 8 [Jacksonville] Florida Senator James W. "Jim" King include Richard M. Jerger of Jerger & Centonze Insurnace Agency (sic)."

McLeod also revealed that, "Senator King seemed in a rush for Terri Schiavo to depart planet earth," quoting from King in an earlier St. Petersburg Times report: "I believe that there is a heaven and that's where Terri is going to go, and that's a trip that's long overdue," the Senator said. King was the key sponsor of Florida's death with dignity legislation. "Had God not wanted what happened today, He would have intervened," King claimed, describing the failure of the Florida Senate to pass legislation preventing the euthanasia of Terri Schiavo.

McLeod further pointed out that Senator King is also an acting member of the board governing the Pinellas Park hospice where Terri Schiavo lived and died.

McLeod also revealed a conflict of interest from local Bishop Robert N. Lynch, whose diocesan legal firm contributed to the campaign to re-elect Florida circuit Judge George Greer.

McLeod concludes: "Meanwhile, if there are any key players in the ongoing Schiavo controversy who do not have a hospice board of director, right-to-die membership, or political campaign contribution conflict of interest to declare, would they please stand up?"

Hochul's Win Fueled By GOP's "Kill Medicare" Agenda: Decision 2012

If Democrat Congressional Candidate Kathleen C. Hocul's Recent Win In New York's Formerly Staunch Republican 26th District Doesn't Send A Message To The Republican Party About Class Warfare, I Don't Know What Else To Tell Them.

That's Right!

Last Night Kathleen C. Hocul Beat The Pants Off Of Her GOP Opponent Jane Corwin After Corwin Endorsed Republican Congressman & Future GOP Star Paul Ryan's "Kill Medicare" Budget.

Can You Say; A Referendum On GOP's "Kill Medicare" Budget?

I Guess Corwin's Dirty Politics Scheme Of Barring The Certified Winner Via An Court Order Didn't Work!

FYI: Considering NY-26 Is A District That Has Elected ONLY Three Democrat Candidates Since 1857, I'd Say This Win Could Be Considered A Political Miracle!

Such Political Victories Against GOP Leaders' Class Warfare Agenda (Haves Vs Have Nots) Just Might Be The ONLY Way For Democrats To Win Back The U.S. House & Spur Democrat Congressional Leaders Into Taking Their Jobs Much More Seriously Next Time Around.

As It Relates To Paul Ryan's "Kill Medicare" Budget, Hardworking Americans, Including Our Nation's Very Valuable Senior Citizen Voters, Are Tired Of Congressional & State Lawmakers Balancing Our Nation's Budget On The Backs Of Middle Class, Senior Citizens, Veterans & Low Income People.

What About The Super Wealthy?

How Is It That Billionaires & Millionaires Are Legally Allowed (Due To Our Corrupt U.S. Tax Code) NOT To Pay Taxes?

Even Worse, How Is It Billionaires & Millionaires Are Legally Allowed To Send American Jobs Overseas (For Cheap Labor) & Still NOT Have To Pay Taxes, While Tax Bills For Middle Class, Senior Citizens, Veterans & Low Income Citizens Continue To Increase Annually?

Don't You Think Something Is Very, Very Wrong With This Picture?

And Now GOP Congressional Leaders Want To Kill Medicare Too?

Come On!

If GOP & Tea Party Leaders Are Truly Serious About Reducing The Deficit & Balancing The Budget Why Not Kill Subsidies & Tax Breaks To Oil Companies?

Why NOT Make The Super Rich Pay Taxes Too?

Why NOT Revise The U.S. Tax Code So That Its Fair For ALL American Citizens?

(NO CORRUPT FLAT TAX RATE PLEASE!)

i.e., EVERYONE Will Have To Begin Paying Taxes!

Why NOT Make The Super Rich Corporate Titans Bring Back American Jobs From Overseas & Pay American Workers REAL Wages For Their Labor, Instead Of Paying 50 Cents An Hour To Some Third World Country Sweat Factory Employee?

And....

Instead Of Proposing To Kill Medicare, Medicaid & Social Security Why Not Just Stop All Of The Fraud & Waste By NOT Allowing State Governors To Use Medicare, Medicaid & Social Security Funds To Balance Their State Budgets?

ALL Governors SHOULD Know How To Properly Balance A State Budget Without Robbing Their State's Most Vulnerable Citizens Or They Should NOT Be A Governor!

So With These Issues In Mind I Hope, Pray & Trust That Pres. Obama, Democrats, Independents And Union Leaders Will Rise Up, Mobilize, Keep The White House And...

Take Back The U.S. House In 2012!

Its Time For A New America!

America That's Fairly Opportunistic For EVERYONE!

NOT Just Wealthy White Citizens.

Congrats Are In Order To Kathy Hocul Of NY-26!

VOTE OBAMA IN 2012!

Democrat Kathy Hochul wins House seat in New York special election

Democrat Kathy Hochul swept to victory Tuesday night in a closely watched Congressional election in New York state, which turned into a proxy battle on a House Republican proposal on Medicare.

The race in New York's 26th Congressional district was to fill the seat of former Republican Congressman Chris Lee, who resigned over pictures and e-mails of him trying to find a date on Craigslist.

The seat had been considered safe for Republicans, who had held the district for more than four decades.

Democrats claimed the victory "had far reaching consequences around the country" over Medicare, while a top Republican warned trying to "predict the future based on the results of this unusual race is naive and risky."

With nearly 90 percent of precincts reporting, Hochul has 48 percent of the vote, Republican Jane Corwin 42 percent, self-proclaimed Tea Party candidate Jack Davis nine percent, and Green Party candidate Ian Murphy one percent.

The crowd chanted "Medicare, Medicare" during Hochul's victory speech in Buffalo, after the issue became the center of the once-little talked about race.

Hochul and Corwin attacked each other over it, with both campaigns, parties and outside groups flooding the airwaves with television commercials. Many of the ads spotlighted the political battle over House Budget Chairman Paul Ryan's plan to drastically cut federal spending by reforming Medicare.

Hochul told supporters in her speech voters "looked beyond party labels ... for a message they believed in."

The Eric County clerk vowed to help balance the budget "the right way, not on backs of our seniors."

During the campaign, she highlighted the national fight, telling CNN before the election, "Corwin has 100% embraced the Paul Ryan budget. Even when Republicans in Washington walk away from it, she's been asked again and again, and she continues to support it."

Corwin called Hochul's message "scare tactics," and had argued, "she's trying to put out the idea that I'm trying to end Medicare. There's nothing further from the truth, I'm working to protect Medicare.

Minutes after the results were announced, both parties sought to paint far different implications of the race.

Democratic National Committee chairwoman Debbie Wasserman Schultz said, "Tonight's result has far-reaching consequences beyond New York."

Schultz said "it demonstrates that Republicans and Independent voters, along with Democrats, will reject extreme policies like ending Medicare that even Newt Gingrich called radical."

She said that she hopes the GOP will listen to voters.

"With this election in the rear-view mirror, it is my hope that Republicans will accept the message being sent by voters in this race, in the polls and at town hall meetings across the country and work with Democrats to get our fiscal house in order while protecting Medicare and other initiatives vital to our economic recovery," she said.

Democratic Congressional Campaign Committee chairman Steve Israel said, "We served notice to the Republicans that we will fight them anywhere in America when it comes to defending and strengthening Medicare."

But National Republican Congressional Committee Chairman Pete Sessions said the race does not have national implications.

"Obviously, each side would rather win a special election than lose," he said. "But to predict the future based on the results of this unusual race is naive and risky. History shows one important fact: the results of competitive special elections from Hawaii to New York are poor indicators of broader trends or future general election outcomes. If special elections were an early warning system, they sure failed to alert the Democrats of the political tsunami that flooded their ranks in 2010."

Republican National Committee Chairman Reince Priebus argued the presence of a third party candidate was a factor in the race.

"Corwin ran a strong campaign in spite of facing a Democrat and a Democrat posed as a Tea Party candidate, both of whom sought to distract from the central issues in the minds of voters: restoring our economy and creating jobs," he said in a statement. "If we have learned anything from these results, it is that Democrats will stop at nothing to preserve the status quo in Washington, which is propelling our country towards bankruptcy."

Looking to the race for the seat next fall, Priebus said, "there is no question Kathy Hochul will have a tough time holding onto this seat in 2012 with Barack Obama and his failed economic leadership weighing heavily on the minds of western New York voters when they return to the polls."

Both parties have brought in some of their big guns to stump for their party's candidates.

House Speaker John Boehner and Cantor made recent trips to the district to campaign for Corwin.

For the Democrats, Sen. Charles Schumer of New York, one of the Senate Democratic leaders, went to the district recently to campaign for Hochul, as did the state's other Democratic Sen. Kirsten Gillibrand.

I Can Hear GOP Leaders On Capitol Hill Biting Their Nails Over This Race As We Speak.

This Afternoon Republican Candidate For The NY-26 Special Election Jane Corwin, Obtained A Court Order Barring Any Certified Winner In Today's Election Results.

A Clear Case Of Fear & Super Dirty Politics Wouldn't You Agree?

How Can A Candidate Block A Certified Winner Before The Actual Votes Are Counted?

I Really Hope Corwin's Democrat Opponent Kathleen C. Hochul Pulls This One Off Because New Blood Is Most Definitely Needed In This Stuffy Congressional District Of NY.

Corwin granted court order barring certification of winner

Jane L. Corwin this afternoon obtained a court order from State Supreme Court Justice Russell P. Buscaglia barring a certification of a winner in the special 26th Congressional District race pending a show-cause hearing before him later this week.

The Buffalo News obtained a copy of the show-cause order Buscaglia signed this morning based on a petition the Republican candidate filed Monday.

Under the judge's 11-page order, attorneys for Corwin have until Wednesday to serve copies of the court order on the election boards of Erie, Niagara, Genesee, Orleans, Wyoming, Livingston and Monroe counties, their sheriff's offices, the state Board of Elections and her three opponents.

Pending court proceedings before Buscaglia on Thursday at the earliest, the judge also impounded all voting equipment and enjoined the canvass of paper ballots "except as directed by this court" and "temporarily enjoined and restrained from certifying" the winner pending that court hearing.

Chris Grant, a spokesman for the Corwin campaign, said the court action "is very typical" in such close elections.

"We recognize the closeness of the race and we want to make sure that every legal vote is counted fairly and accurately," Grant said.

Paul B. Wojtaszek, Buscaglia's law clerk, said such prospective court actions are permissible under the state's Election Law when a close vote is borne out by pre-voting polling.

Buscaglia has scheduled a hearing in the election case for 10:30 a.m. Thursday in his second-floor courtroom at 25 Delaware Ave. But the entire matter could be "moot" if the winning margin is sufficient to eliminate any need for court action, Wojtaszek said.

Corwin is battling Democrat Kathleen C. Hochul, Tea Party candidate Jack Davis and Green Party candidate Ian Murphy in today's election.

A copy of the court order was filed in the Erie County Clerk's Office at 11:01 a.m. today. Hochul is Erie County clerk.

Chris Christie Ordered To Increase Education Funding For Poor Students

Today The New Jersey Supreme Court Ordered Former Potential 2012 Presidential Candidate Gov. Chris Christie To Increase Educational Funding For Schools In Lower Income Communities.

In Other Words He Can NO Longer Steal Money From Poor Students To Educate Wealthier White Students Living In The Suburbs.

Can You Say Discrimination Disguised As "Budget Cuts"??

All I Can Say On This One Is Thank You Lord Jesus!

Court Orders New Jersey to Increase Aid to Schools

The New Jersey Supreme Court ordered the Christie administration on Tuesday to increase state education aid by $500 million in the coming school year, saying it had failed to meet its constitutional obligation to provide adequate educational resources for poor and minority children.

In a 3-to-2 ruling, the court directed that the additional aid be distributed among 31 school districts in historically poor cities like Camden, Newark and Paterson — the so-called Abbott districts at the heart of a school financing case, Abbott v. Burke, that has roiled state officials and courts for three decades.

While the amount of additional aid the Supreme Court ordered was less than the $1.7 billion requested by some advocates, the decision was still seen as a blow to Gov. Chris Christie, whose efforts to rein in school spending and teachers’ salaries have won broad voter support across the state and helped establish him as a leader in national conservative circles.

Mr. Christie, a Republican who had previously suggested that he might defy a court order to spend more on schools, said Tuesday, “I intend to comply with the Supreme Court’s order.” But at a news conference at the State House, he said he would leave it to the Legislature, controlled by Democrats, to determine how to come up with the money.

“The constitutional ball is now in the Legislature’s court,” the governor said.

Several lawmakers noted that state revenue was running above projections by about the same amount as the court mandate. But it is not clear whether Mr. Christie will agree to spend that additional sum on schools, increasing the overall state budget, rather than finding cuts elsewhere. Lawmakers are facing an estimated $10 billion deficit for the coming fiscal year as they try to hammer out a budget.

Barbara Keshishian, president of the New Jersey Education Association, said in a statement that the ruling “begins the process of restoring our schools to fiscal health.” But she also expressed disappointment that state aid would not be restored beyond the 31 Abbott districts, and called on Mr. Christie and lawmakers to honor “the spirit of the ruling” and fully finance a school aid formula for all students in all districts.

“We also urge them to fund the education of students in all districts moving forward so that the state does not waste any more time or money defending the indefensible,” Ms. Keshishian said. “Our children’s education is too important to be left to the whims of politics.”

The ruling capped months of testimony and debate by state officials, educators and advocates for poor children over whether state education cuts had disproportionately harmed poor and minority children who depend most heavily on public resources.

Last year, Mr. Christie, in his first year in office, cut direct aid to individual districts by up to 5 percent of their budgets to help close an $11 billion state deficit. The governor and his aides have argued that the reduction was unavoidable after a $1 billion infusion of federal stimulus money for schools ran out.

But this year, as state revenues have rebounded, Mr. Christie increased school aid by $250 million for 2011-12, effectively restoring one percentage point of the 5 percent reduction to districts. Many districts, not expecting any increase, had already planned their budgets and were able to use the money as a cushion against further layoffs and program cuts and even to restore some previous cuts.

The Abbott lawsuit was filed in 1981 by advocates seeking to ensure that New Jersey’s poorest children receive a constitutionally guaranteed “thorough and efficient education” in a state whose public schools are deeply stratified along socioeconomic and racial lines. Despite years of intervention, the worst-performing schools continue to be in struggling urban centers with large concentrations of black and Hispanic students, like Camden and Newark, while the top-performing schools are in wealthy suburbs like Millburn and Ridgewood.

In 2008, Gov. Jon S. Corzine and the Legislature put in place a new school financing formula, in response to criticism that too much aid had been concentrated in the Abbott districts, while many of the state’s neediest children lived outside those districts. The new formula steered increased aid to 205 of the state’s 591 districts, many of them in the suburbs, rather than just 31 urban districts.

In a previous ruling, the Supreme Court upheld the new formula, in part on the specific condition that it be fully financed by the state for the 31 Abbott districts. On Tuesday, the court found that the state’s decision to provide less aid to districts than the formula required “amounts to nothing less than a reneging on the representations it made.”

Democrats said the governor had only himself to blame for the court ruling, because he had violated the 2008 compromise.

“The governor’s reckless decision to ignore the law is the reason that the court has returned us to the very system he has railed against,” said State Senator Barbara Buono, who is seen as a potential candidate for governor.

Stephen M. Sweeney, the Senate president, said that Mr. Christie “was well aware that his draconian cuts to education were illegal,” and noted that during his 2009 campaign, the governor vowed not to cut school aid.

The Supreme Court ruling was complicated as well as narrow. One justice, in a separate opinion, wrote that he would have required the state to provide additional financing to all 205 districts that serve poor children.

But in a dissenting opinion, two justices challenged the order for additional state aid, saying that such an action required a minimum of four approving votes from the seven-member court, and should not be granted on the basis of a 3-to-2 decision.

Five justices were left to decide the case after two justices recused themselves: Chief Justice Stuart Rabner, who worked in the Corzine administration when the new school aid formula was developed, and Associate Justice Virginia Long.
