Gov. Andrew Cuomo left little to chance in his Democratic primary fight against Cynthia Nixon, a race that drew national attention.

Cuomo, a master at using the levers of power in government, turned all the resources of his campaign and office to his advantage.

He was able to use more than $21 million in campaign spending to tout his record over the past eight years and beat back attacks on scandals that have rocked his administration to land a blowout victory Thursday over the neophyte Nixon.

"We have provided real-life progressive solutions. You cannot have the word 'progressive' without the word 'progress.' It doesn’t work," Cuomo said at a news conference Friday.

Cuomo beat Nixon 66 percent to 34 percent in the primary, on par with his primary victory over Zephyr Teachout in 2014.

Turnout up

The margin of victory came amid a surge in voter turnout: 24 percent of total enrolled Democrats cast a ballot on Thursday compared to 10 percent in 2014.

Cuomo was able to galvanize union support that eluded him in 2014 and that aided turnout along with a Democratic base that is more engaged following President Donald Trump's election.

Turnout was also boosted by heavily contested primaries in the New York City area, in particular, that led to seven Democratic incumbents in the Senate to lose their seats — a remarkable result in a state where incumbents rarely lose.

The Democrats' ire was directed mainly at the former eight-member Democratic Independent Conference, who had aligned with Republicans over much of the past seven years in the Senate, drawing criticism that they blocked progressive legislation.

Six of the eight ex-IDC members lost in primaries, including its former leader Jeff Klein, D-Bronx, who spent $2 million on his race but still fell to Alessandra Biaggi in a race that stretched into Westchester.

“Voters again made it clear that this is a new day and politics as usual are no longer acceptable," said Sen. Andrea Stewart-Cousins, D-Yonkers, who heads the mainline Democratic Conference and brokered a unity deal with Klein in April that didn't stave off IDC challengers.

Cuomo's power

It wasn't just that Cuomo blanketed the airwaves with television ads and ads on social media.

He used the power of his office to boost his standing, which drew criticism from his foes, but nonetheless helped him.

"When others were underestimating us, he did not — and he spent accordingly," Nixon said at the opening of her concession speech.

Nearly 1 million property-tax rebate checks were sent out before the primary, when they typically don't go out until late fall and through the winter.

Cuomo's office said the process became more efficient, so the checks went out earlier this year.

Others saw it different.

"The Senate was complaining most loudly about delays in the checks in previous years, and this year’s earlier posting could be seen as a response to those complaints that conveniently serves the governor’s interests as well," said E.J. McMahon, who heads the fiscally conservative Empire Center for Public Policy.

Cuomo will face Republican candidate Marc Molinaro on the November ballot, as well as several third-party candidates, including Green Party candidate Howie Hawkins, Libertarian candidate Larry Sharpe and Serve America Movement candidate Stephanie Miner.

Cuomo's aggressiveness also came with peril.
He held a huge ceremony the Friday before the primary to tout the opening of the second span of the Gov. Mario Cuomo Bridge in the Hudson Valley, only for the span's opening to be delayed several days.

And in the days leading up to the primary, Cuomo's campaign was embroiled in controversy over an anti-Semitic mailer it sent out about Nixon -- which the campaign later admitted was inappropriate.

Winning voters

Cuomo used the massive power of his office to his benefit.

Cuomo has the disposal of a state fleet of aircraft, allowing him to make multiple stops per day to discuss policy, make announcements and in recent months bash the Trump administration — which played well with Democrats in the primary.

Cuomo took 195 trips in state planes and helicopters in 2017, the New York Times reported earlier this month, which was significantly more than other big-state governors.

State agencies also put out a series of mailers ahead of the primary, including one from the Department of Motor Vehicles that encouraged residents to vote with the line.

"Governor Andrew M. Cuomo is expanding access and opportunity to New Yorkers to register to vote,” one read, according to the New York Post.

Cuomo, though, credited his strong record and apathy toward Trump as the reason for his success on Primary Day.

uomo targeted Trump more than Nixonduring the campaign, touting his experience in office compared to Nixon.

He said Friday he understands the sentiment of voters, pointing to his record that includes a higher minimum wage, paid-family leave, free SUNY tuition for income-eligible students and a property-tax cap.

His primary ticket all won: Lt. Gov. Kathy Hochul beat New York City Councilman Jumaane Williams; and Tish James, the New York City public advocate, won a four-candidate race for attorney general.
"A progressive Democrat, a Democrat in New York state. These are not ivory tower academics. These are not pontificators," Cuomo said Friday.

"New York Democrats, these are hard-working men and women. They are middle class; they are working families. They have real problems, and they need real help in life."

***** Kirsten Gillibrand 2020? Not with her Wall Street problem.


TThe presidential campaign was always here. Before man was, the campaign waited for him. And President Trump's first 100 days in office are almost up. So you know what that means: idle speculation about who will run in 2020!
Jokes aside, it is obviously too early to actually start running for the presidency, even in this wretchedly dysfunctional country. But it's not too early for ambitious politicos to start thinking about which policies to advocate for and what kind of reputation to cultivate. Laying the groundwork early has always been part of running for national leadership in every democracy.

One obvious proto-candidate is Sen. Kirsten Gillibrand (D-N.Y.). She has a decent national profile, a couple of solid signature policies, and a lot of goodwill with the Democratic base for defying President Trump early. Plus, she would be able to claim that first female president ring that eluded Hillary Clinton. (Better still, she doesn't have one quarter of the baggage that Clinton had.)

There's just one big problem: Wall Street. If she wants to lock up the next Democratic presidential primary, she would be wise to make herself absolutely loathed by the bankster class.

The basic shape of a potential Gillibrand candidacy is outlined reasonably well in a sympathetic profile by Rebecca Traister. Gillibrand started her career in a conservative district in New York, taking office in 2006 as part of the great Democratic wave. She had been a lawyer for Big Tobacco in her early career, and started out as a Blue Dog conservative, holding pro-gun, pro-austerity, and anti-immigration positions.

She was thus thought to be a bad choice to fill Hillary Clinton's Senate seat when Clinton was tapped to serve as secretary of state in 2009. But Gillibrand quickly moved left, reversing course on immigration and gun control, and helping kill Bill Clinton's odious policy on gays in the military. She was easily elected in a 2010 special election and reelected properly in 2012.

She has since been a fairly middle-of-the-road Democrat, but has made a bit of a national name for herself by advocating for paid family leave in the form of the FAMILY Act. As policy and politics, it could stand to be more aggressive, but it's still pretty good by Democratic Party standards. (At least it's not a rotten tax-advantaged savings account.) And since then, Gillibrand has garnered even more attention by consistently opposing President Trump in almost everything he's done — including voting against more of his Cabinet nominees than any other senator.

But her record on Wall Street will haunt her. Gillibrand, as usual for New York senators, has worked assiduously on behalf of the financial industry. In 2010 she briefly suggested filing an amendment making it harder to regulate derivatives trading, though she later backed down after a backlash. In 2011, she complained that derivatives regulation would make U.S. banks uncompetitive. In 2013, she and five other Democratic senators wrote to then-Treasury Secretary Jacob Lew arguing essentially for an indefinite delay of regulations on cross-border derivative trading. As Reid Pilfant wrote in 2012, she has "quietly overcome considerable skepticism about her on Wall Street to become a go-to advocate for the financial services industry in her own right."

Why is this bad? For one, Wall Street is a cancer at the heart of the American economy. Its share of GDP has roughly doubled since the 1950s, and approximately all of that growth has come at the expense of the rest of the economy. It went from about 8 percent of corporate profits to 20-40 percent while becoming less efficient at basic financial tasks.

How? By abusing contracts, tax law, and market power to dominate consumers and productive enterprises so as to extract quick cash. Most "markets" in this country have become monopolies or oligopolies — the deliberate result of mergers and acquisitions coordinated on Wall Street. A generation of pressure from finance means corporations are now mainly expected to think only about the next quarter's profits, and to immediately disgorge them all — or more than all — to shareholders and executives.

Pick some economic abuse disproportionately affecting women or minorities, and it's a safe bet that some finance goons will be up to their neck in it. And that's setting aside actual criminal actions, like systematic document fraud that kicked nine million people out of their homes.

Dodd-Frank was a step in the right direction, but about 1/40th the proper size. We need cricket bat regulation.

Bernie Sanders got tremendous political mileage out of arguing that big banks must be broken up, his signature call to to wrest political power away from the "millionaires and billionaires," and above all from his palpable contempt for the ultra-rich. By necessity, taking a credible populist stand now means a ferocious attack on Wall Street.

If Gillibrand tries to split the difference, and run a Clinton-style campaign of status quo finance plus moderate new social programs, she's likely to be outflanked by a more credible populist. What's more, she will not have Clinton's gigantic head start, nor her total lock on all the party insiders. And with Clinton's astonishing loss to Trump, electability arguments against such a challenger will be far less convincing.

It will be tough — Gillibrand is married to a banker — but a good first step would be to contemptuously refuse all donations from finance for her upcoming reelection campaign. She won in 2012 by 46 points, partly on the strength of gigantic donations from Goldman Sachs. A smaller margin of victory there would pay national electoral dividends.

****** NY gov unveiling bill to remove firearms from those with domestic violence convictions


New York Gov. Andrew Cuomo (D) said he will announce legislation Wednesday to remove firearms from people who commit domestic violence crimes.

"Today I am announcing legislation to remove all firearms from those who commit any domestic violence crimes," Cuomo tweeted.

"Given the inextricable link between domestic violence and lethal gun violence, this legislation will require all domestic violence crime convictions, including misdemeanors, to result in the immediate removal of all firearms."

Cuomo said this year will be remembered as "the year of reckoning, when both the tragedy of mass shootings and cultural and institutional harassment of women became impossible to ignore."

"Let's make New York a safer state for all," he said.

Democratic lawmakers have pushed for new gun control measures after a series of mass shootings over the past year, including recent ones in Las Vegas and Texas.

More than 50 people were killed and more than 500 others wounded when a gunman opened fire at a country music festival in Las Vegas in early October. The following month, 26 people were killed after a gunman opened fire on churchgoers attending a Sunday service at a church in Sutherland Springs, Texas.

Police identified the suspect in the Texas shooting as Devin Kelley, who was discharged from the Air Force in 2014 for bad conduct after a domestic violence conviction. But the Air Force came under fire for failing to enter Kelley's domestic violence court-martial into a federal database used for background checks on gun sales.

Last month, a Democratic lawmaker introduced a billthat would require the Justice Department to conduct a study examining whether there is a correlation between individuals who have a history of domestic violence and mass shooters.

"If we look at the recent mass shootings in Sutherland Springs, Orlando, and the Congressional Baseball Game practice, we see a noticeable trend: all these shooters acted alone and had prior history of domestic violence," Rep. Mike Quigley (D-Ill.) said in a statement in November.

"Studies on the link between domestic violence at the early stages and mass shootings may help us prevent individuals from carrying out these horrific crimes in the future," he added.

***** Did Owner of Million-Dollar U.S. Home Help North Korea Evade Sanctions?


The five-bedroom house in New York's Long Island suburbs — listed for nearly $1.3 million — boasts a southern exposure and proximity to a country club.

But here's what's more interesting:

The seller, a Chinese national named Sun Sidong, has been linked by American security experts to a network of Chinese companies under Treasury sanctions for helping companies and individuals who support North Korea's nuclear and ballistic missile programs.

According to Chinese corporate filings, Sun is the listed owner of Dandong Dongyuan Industrial Co., which has shared an email address with another Chinese company, Dandong Zhicheng Metallic Material Co., a coal exporter suspected of helping North Korea evade sanctions.

The coal company and "four related front companies" were targeted by a federal search warrant allowing prosecutors to secretly monitor their financial transactions at eight U.S. banks, seizing any funds stemming from illegal sanctions-busting, according to a May federal court ruling.

The ruling, by U.S. District Judge Beryl Howell of Washington, D.C., said the eight American financial institutions — Bank of America, Wells Fargo, BNY Mellon, Citibank, Deutsche Bank, HSBC, JP Morgan Chase, and Standard Chartered Bank — had already processed upwards of $700 million in prohibited transactions involving North Korea since 2009. The ruling does not allege any wrongdoing by any of the banks.

On Tuesday, the Treasury's Office of Foreign Assets Control (OFAC) sanctioned Dandong Zhicheng Metallic Material Co. and its primary shareholder in response to "attempted evasion of U.S. sanctions."

That shareholder, a Chinese businessman named Chi Yupeng, was also named in a civil complaint filed Tuesday by the Justice Department seeking a money laundering penalty against the firm, as well as the seizure of $4 million in funds allegedly laundered for North Korea's ruling party. The complaint alleges that front companies controlled by Chi Yupeng comprise one of the largest financial facilitators for North Korea.

Chi Yupeng hung up on NBC News several times when asked for comment.

The Justice Department also moved to seize nearly $7 million from a Singapore firm over similar allegations, and Treasury levied sanctions against a number of other Chinese and Russian entities — 16 in total — it accused of helping North Korea evade sanctions.

The government's investigation was supported by the Center for Advanced Defense Studies (C4ADS), a non-profit U.S. think tank, is part of a new get-tough approach to North Korean sanctions that began in the Obama administration and is accelerating under President Trump, current and former U.S. officials say.

While it's widely assumed that North Korea has for years been subjected to punishing international pressure as it defied the world and advanced toward a nuclear missile capability, the sanctions against North Korea have been full of holes, experts say — far less restrictive, for example, than the measures that brought Iran to the nuclear bargaining table.

Sun's Great Neck house is an example of how the alleged sanction-busting networks can stretch around the globe, even to the luxe suburbs of Long Island. "The fact that you have somebody who's engaged in trade that is potentially not just sanctioned, but dangerous, and that individual then invests in real estate in the United States reflects that there are holes in the system," NBC News National Security Analyst Juan Zarate said.

The North Korea sanctions targeted specific military technology, "but what you didn't see until quite recently are these kind of broader sanctions to go after the North Korean economy as a whole," said Peter Harrell, who was the deputy assistant secretary for counter threat finance and sanctions in the State Department from 2012 to 2014.

Nor was there an aggressive enforcement effort against banks and individuals doing business with Pyongyang. As a result, the North Korean economy has grown steadily over the last decade, analysts say. And while the country as a whole remains extremely poor, the elite live relatively well amid a building boom of gleaming skyscrapers in the capital.

"Until February of 2016, U.N. sanctions against North Korea were strong on paper but poorly enforced, and U.S. sanctions against North Korea were comparatively weak — weaker than our sanctions against Belarus and Zimbabwe," said Joshua Stanton, a North Korea expert and former Army officer.

Now, that is changing — though it may be too late. North Korea tested a missile that many experts say could strike the U.S. mainland, and American intelligence officials say the country may be months away from being able to mount a nuclear warhead on such a missile.

Still, aided by new sanctions imposed in the past year, the Trump administration is moving to increase economic pressure on North Korea, by targeting the Chinese companies that have for years helped the North fund its military activities.

"Justice is stepping it up by going after the Chinese banks," said Anthony Ruggiero, a senior fellow at the Foundation for Defense of Democracies, who served as the nonproliferation advisor to the U.S. delegation to the 2005 Six-Party Talks on North Korea.

In June, the U.S. Treasury Department designated China's Bank of Dandong — based in a city on the North Korean border that serves as a center of trade between the two countries — to be a "primary money laundering concern." It said the small bank "acts as a conduit for illicit North Korean financial activity." Two Chinese individuals were also targeted in the government's action.

Last September, the Justice Department charged Dandong-based businesswoman Ma Xiaohong with evading sanctions and laundering millions of dollars for North Korea. Ma has not made a court appearance and her whereabouts are unclear.

Sen. Cory Gardner, R-Colo., recently introduced a bill that would cut off entities that do business in North Korea, including the top ten Chinese importers of North Korean goods, from using the American financial system.

In August, the U.N. Security Council unanimously passed new sanctions meant to pressure Pyongyang's export revenue. They crack down on North Korea's primary exports — including iron, iron ore, coal, lead, lead ore and seafood — and target banks and joint ventures with foreign companies.

C4ADS, which focuses on international security, uses sophisticated software and business records to map links between companies involved with North Korea.

In June, the group published a report — titled "Risky Business" — naming Sun, who owns the Great Neck house, as part of a network that may be exporting technology that could be used in North Korea's missile program.

Chinese business records cited by C4ADS show Sun owns 97 percent of Dandong Dongyuan Industrial Co. Ltd., a general-purpose trading firm whose businesses include the sale of automobiles, machinery, natural resources, and general household products, the report says. NBC News confirmed that the records show Sun as primary shareholder.

Customs records indicate the firm has exported to three countries: North Korea, the Democratic Republic of the Congo, and the United States. From 2013 to 2016, the company sent $28 million worth of material to North Korea, the records show.

For example, Dandong Dongyuan Industrial Co. sent North Korea a shipment of radio navigational aid apparatus valued at nearly $800,000 in June 2016, the C4ADS report said. Experts at the James Martin Center for Nonproliferation Studies concluded that "this category might contain guidance devices for ballistic missiles."

NBC News reviewed shipment data from Panjiva, which tracks global trade. It shows more than 60 shipments of items by Sun's company to North Korea that fall into the category of "nuclear reactors, boilers, machinery and mechanical appliances; parts thereof." This broad category is set by the country of origin, in this case the Chinese government. Experts say dual-use items like these help the Kim regime evade sanctions that are explicitly designed to prevent its nuclear capability.

"The danger with the export of dual-use items is that they appear to be legitimate. These are things that could be used for normal purposes," Zarate said. "You have parties that are willing to export what are really dangerous items to a regime that has been sanctioned, and trying to use the cloak of legitimate commerce in order to do that."

C4ADS also links Sun to a ship carrying arms from North Korea to an unknown destination. In August 2016, a cargo vessel flying a Cambodian flag was intercepted by Egyptian authorities entering the Suez Canal with parts for 30,000 rocket-propelled grenades aboard. The grenade parts were hidden under 2,300 tons of iron ore, which is one of the newly banned mineral exports targeted by the U.N.'s recent sanctions program.

According to shipping records reviewed by NBC News, one of Sun Sidong's companies owned the vessel from April 2012 until August 2014, when ownership was transferred to a company controlled by Sun Sihong, who according to C4ADS is Sun's sister.

In 2015, Sun registered a New York-based company called Dongyuan Enterprise USA. On March 2, it received a shipment of "used furniture" from Dandong Dongyuan Industrial Co., Sun's Chinese company. Originally shipped from Dandong, the cargo traveled to the U.S. from Busan, South Korea, according to its bill of lading.

The real estate agent who brokered the sale of the Great Neck home to Sun recalled that the family was expecting furniture to arrive from China.

Sun, whose U.S. company operates out of a New York City address he does not own, bought the Great Neck property near the country club for $1.1 million in December 2016.

The house is already on the market again. Sun's U.S. real estate broker told NBC News that's because Sun "doesn't want to do business here."

One lesson of Sun's activities is that targeting a small number of key actors could put a severe dent in North Korean's effort to evade sanctions, according to David Johnson, the executive director of C4ADS.

"The networks that perpetrate sanctions evasion for North Korea are limited, centralized, and vulnerable," Johnson said. "That is, we can touch them, there are very few pressure points, and we can make a major impact."

Billionaire philanthropist David Rockefeller, former head of Chase Manhattan Corp and patriarch of one of the most famous and influential American families, died on Monday, a family spokesman said. He was 101.

Rockefeller, who reportedly gave away nearly $2 billion in his lifetime, died in his sleep of congestive heart failure at his home in Pocantico Hills, New York, spokesman Fraser Seitel said in a statement.

One of the few remaining links to the U.S. "gilded" era of robber barons, he was the son of John D. Rockefeller Jr., who developed New York's Rockefeller Center, and was the last living grandson of oil tycoon John D. Rockefeller, founder of Standard Oil and the family dynasty. He also embodied an era when globe-trotting bank chiefs worked with the world's most powerful politicians.

During his time as head of Chase from 1969 to 1981, Rockefeller forged such a network of close relationships with governments and multinational corporations that observers said the bank had its own foreign policy.

The Rockefeller name came to symbolize unpopular U.S. banking policies in debtor countries, and Rockefeller was scorned on the left for working with Chile's Augusto Pinochet and the shah of Iran.

He also was viewed with anger on the right for pushing to open trade with China and the Soviet Union during the Cold War. The Trilateral Commission, a group Rockefeller founded in 1973 to foster relations between North America, Japan and Western Europe, came to be a regular target of the far-right and conspiracy theorists who said it was trying to create a one-world government.

Rockefeller became embroiled in an international incident when in 1979 he and long-time friend Henry Kissinger helped persuade President Jimmy Carter to admit the shah of Iran to the United States for treatment of lymphoma, helping precipitate the Iran hostage crisis.

Born in Manhattan as the youngest of six siblings, Rockefeller spent his childhood in New York City and at the family's estates, and recalled meeting such luminaries as Charles Lindbergh, Admiral Richard Byrd and Sigmund Freud.

His ties to the internationally famous continued throughout his adulthood, symbolized by his famed 100,000-card Rolodex, housed in its own room next to his office in Manhattan's Rockefeller Center.

The site of the nine-story mansion where he was born, then New York's largest residence, is now part of the Museum of Modern Art, which his mother, Abby, helped found in 1929.

Rockefeller collected beetles as a lifelong hobby and also acquired art - a Mark Rothko painting he bought in 1960 for less than $10,000 was auctioned for more than $72 million in May 2007.

His fortune, investments in real estate, share of family trusts and other holdings were estimated at $3.3 billion in March 2017 by Forbes magazine. Seitel said Rockefeller had donated nearly $2 billion in his lifetime to organizations including the Museum of Modern Art in New York and Rockefeller University.

In May 2015, he made a rare public appearance in Maine to mark his approaching 100th birthday by donating 1,000 acres (405 hectares) for preservation on exclusive Mount Desert Island.

Rockefeller established several international and philanthropic associations: the Americas Society, the weighty Trilateral Commission to promote cooperation between North America, Europe and Japan, and the New York City Partnership to help the city's poor.

Chase Manhattan grew from a $4.8 billion institution in 1946 when he joined to a bank with $76.2 billion in assets when he stepped down in April 1981. But it slipped from its standing then as No. 3 in the world and was purchased by Chemical Bank of New York in 1996. Today it is part of JPMorgan Chase & Co.

He published his autobiography, "Memoirs," in 2002 and continued going to work every day into his 90s.

He remained a lifelong member of the moderate "Rockefeller Republicans" wing of that party, including his 2006 co-founding of Republicans Who Care, to support the party's moderates.

Rockefeller earned a degree from Harvard University in 1936 and did graduate work at the London School of Economics, where he met future President John F. Kennedy and dated his sister Kathleen. He was awarded a Ph.D in economics from the University of Chicago in 1940.

From 1940 to 1941 he was secretary to New York Mayor Fiorello LaGuardia and in 1942 he enlisted in the U.S. Army, serving in military intelligence in North Africa and France.

Rockefeller was awarded the French Legion of Honor.

Rockefeller's wife Peggy died in 1996. They had six children and 10 grandchildren.

Fox News host Megyn Kelly will interview Republican presidential candidate Donald Trump in a Fox TV special to air next month.

The GOP presidential front-runner will be a guest on "Megyn Kelly Presents," a prime-time special airing May 17 on Fox TV.

Extended portions of the sit-down interview will also appear on "The Kelly File" on Fox News Channel beginning on May 18.

The interview, which will take place in New York, marks the first sit-down between the two since the August 2015 presidential debate on Fox News Channel.

Kelly will explore how events unfolded with Trump after the August debate as one of the most prominent voices covering the 2016 presidential campaign of the front-runner, according to a statement from Fox News.

She will also examine Trump’s successful campaign for the White House to date and his role in one of the most historic presidential runs in modern times.

"Mr. Trump and I sat down together for a meeting earlier this month at my request. He was gracious with his time and I asked him to consider an interview. I am happy to announce he has agreed, and I look forward to a fascinating exchange — our first sit-down interview together in nearly a year,” Kelly said in a statement announcing the upcoming interview.

In addition to the Trump interview, “Megyn Kelly Presents” will feature a wide variety of notable guests from the entertainment world and other spheres of human interest to be interviewed by Kelly. The full list of guests will be announced at a later date.

Ted Cruz is projected to come in third in New York’s GOP presidential primary, behind Donald Trump and John Kasich, Fox News and MSNBC are reporting.

Cruz, who may end up getting zero delegates from New York state, was not helped by his attacks on "New York values."

The New York values line — first delivered in January as a critique of Manhattan's liberal culture — played well among evangelicals in Iowa but came back to bite Cruz when he had to face Empire State voters. 

Cruz drew loud protests as he campaigned in the Bronx and tried to reframe the comment as an attack on New York Democrats. But returns from Tuesday show no evidence he made inroads with voters.

Trump is on track to win more than 50 percent of the New York vote statewide and could come close to winning all 95 delegates there.

Both Clinton and Sanders would beat any GOP candidate in the state in November, poll shows.

Democrat Hillary Clinton and Republican Donald Trump have significant leads ahead of the primaries in their home state of New York next month, a poll released Thursday showed.

Mrs. Clinton, a former U.S. senator from New York, tops her Democratic rival, U.S. Sen. Bernie Sanders of Vermont, 54% to 42% among likely Democratic primary voters, according to the Quinnipiac University poll.

Mr. Trump, a Manhattan real-estate developer, leads with 56% among likely GOP primary voters, followed by Sen. Ted Cruz of Texas with 20% and Gov. John Kasich of Ohio with 19%, the poll showed.

“The home-court advantage helps both party’s front-runners in the presidential primaries in New York,” said Maurice Carroll, assistant director of the Quinnipiac University Poll.

New York’s primaries will be held April 19.

Among Democrats, women favored Mrs. Clinton over Mr. Sanders, while white primary voters were divided with 48% for Mrs. Clinton and 47% for Mr. Sanders. Mrs. Clinton continues to dominate Mr. Sanders with black voters, beating him 66% to 31% in the state.

In the GOP, Mr. Trump holds double-digit leads among both genders.

The poll found both Mrs. Clinton and Mr. Sanders would beat any of the Republican candidates in the November general election.

Quinnipiac surveyed 693 likely Democratic primary voters and 457 likely GOP primary voters.

The poll has a margin of error of plus or minus 3.7 percentage points on the Democratic side and plus or minus 4.6 percentage points on the Republican side.

**** NY Judge: US Cannot Make Apple Provide iPhone Data

The U.S. Justice Department cannot force Apple to provide the FBI with access to locked iPhonedata in a routine Brooklyn drug case, a federal judge ruled Monday.

U.S. Magistrate Judge James Orenstein's written decision gives support to the company's position in its fight against a California judge's order that it create specialized software to help the FBI hack into an iPhone linked to the San Bernardino terrorism investigation. Apple on Thursday formally objected to the order in a brief filed with the court.

The San Bernardino County-owned iPhone 5C was used by Syed Farook, who was a health inspector. He and his wife Tashfeen Malik killed 14 people during a Dec. 2 attack that was at least partly inspired by the Islamic State group.

Apple's opposition to the government's tactics has evoked a national debate over digital privacy rights and national security.

Orenstein concluded that Apple is not obligated to assist government investigators against its will and noted that Congress has not adopted legislation that would achieve the result sought by the government.

Orenstein said he was offering no opinion on whether in the instance of this case or others, "the government's legitimate interest in ensuring that no door is too strong to resist lawful entry should prevail against the equally legitimate societal interests arrayed against it here."

He said the interests at stake go beyond expectations of privacy and include the commercial interest in conducting business free of potentially harmful government intrusion and the "far more fundamental and universal interest ... in shielding sensitive electronically stored data from the myriad harms, great and small, that unauthorized access and misuse can cause."

"How best to balance those interests is a matter of critical importance to our society, and the need for an answer becomes more pressing daily, as the tide of technological advance flows ever farther past the boundaries of what seemed possible even a few decades ago," Orenstein wrote. "But that debate must happen today, and it must take place among legislators who are equipped to consider the technological and cultural realities of a world their predecessors could not begin to conceive."

The Justice Department said in a statement that it's disappointed in the ruling and plans to appeal in coming days. It said Apple had previously agreed many times prior to assist the government and "only changed course when the government's application for assistance was made public by the court."

Apple and their attorneys said they were reading the opinion and will comment later.

In October, Orenstein invited Apple to challenge the government's use of a 227-year-old law to compel Apple to help it recover iPhone data in criminal cases, noting that another law on the books already covered the issue.

The Cupertino, California-based computer maker did, saying in court papers that extracting information from an iPhone "could threaten the trust between Apple and its customers and substantially tarnish the Apple brand."

It followed up by declining to cooperate in a dozen more instances in four states involving government requests to aid criminal probes by retrieving data from individual iPhones.

In ruling, Orenstein wrote: "I believe Apple has the better argument" because the other law covering wiretaps for telecom companies "explicitly absolves a company like Apple of any responsibility to provide the assistance the government seeks here."

Federal prosecutors say Apple has stopped short of challenging court orders judicially, except in the cases before Orenstein and the California jurist who ruled about the San Bernardino shooter's phone.

"Ultimately, the question to be answered in this matter, and in others like it across the country, is not whether the government should be able to force Apple to help it unlock a specific device; it is instead whether the All Writs Act resolves that issue and many others like it yet to come," Orenstein wrote. "For the reasons set forth above, I conclude that it does not."

~ Trump insists 'most' black pastors endorsing him

Donald Trump is insisting that “most” of the 100 black pastors he met with on Monday are endorsing him for president.

“I thought it was an amazing meeting. I met some fantastic people,” Trump said following the private meeting at Trump Tower.

The GOP presidential front-runner had canceled a planned press conference on Sunday where he was to have highlighted the endorsements of 100 black religious leaders.

He did so after several of the pastors denied they were endorsing Trump for president.

Darrell Scott, a pastor at the New Spirit Revival Center in Cleveland Heights, Ohio, stood by Trump’s side on Monday, saying that the meeting was “productive” and “constructive” and that the group of religious leaders are a “united front.”

“We voiced concerns sensitive to the African-American community,” Scott said. “We’re all satisfied with the answers.”

Scott said there were a number of pastors who endorsed Trump, but didn’t have an official number. He said the religious leaders who remain undecided are “praying about it.”

“Nobody at this meeting came out with negative reaction in any kind of way,” Scott said, adding that “Everybody in the room likes Donald Trump.”

Omarosa Manigault-Stallworth, a former contestant on Trump’s reality show "The Apprentice" who is now a minister, also stood next to Trump at the press conference.
At the end of the press conference, Trump emphasized that he’s made no financial commitments to any of the churches.

Trump said issues such as African-American unemployment were addressed at the meeting, which lasted about two and a half hours.

Trump has been battling charges that his campaign is divisive. He’s been criticized for rhetoric seen by critics as anti-Muslim and questions about an alternation between a Black Lives Matter protester and white attendees at a recent rally.

When asked by a reporter if he wanted to comment about BLM, Trump dismissed: “Black lives are very important, white lives are very important, and to me all lives are very important.”

ARTICLE: "Give Dennis Rodman A Break"

This week, we've been treated to the increasingly familiar sight of former NBA star and provocateur Dennis Rodman attending events in Pyongyang, North Korea. It's his fourth trip in less than 12 months.

On Tuesday, an angry Rodman defended his visit in a CNN interview straight from Pyongyang, at one point saying to "New Day" anchor Chris Cuomo, "I don't give a rat's ass what the hell you think ..." in response to question about Kenneth Bae, an American detained in North Korea.

When will we tire of this circus?

In case you don't watch cable news, you might miss that the media really loves this kind of thing. No story about North Korea is too weird to go unreported, even if there is no real information to disseminate. Recall the recent rumor that Kim Jong Un's uncle was executed by being fed to hungry dogs, which most likely was started as satire on Chinese social media but was at first reported widely in the media (CNN was unable to confirm and did not report the story).

In media discourse, North Korea is the classic enemy. The regime's injustices, quirks and dysfunctions are reassuring to Americans that their own country is just the opposite: Normal, well-functioning, a land of peace and liberty.

But add in Rodman to the North Korea story, and it's bound to produce eye-popping headlines:

"The Weird American Athlete Goes to Weird Country story is just too easy not to cover."

Rodman himself seems to be thriving on finding a strange smidgen of relevance through his visits to North Korea (and perhaps a Paddy Power paycheck). Though often described as quite shy, he has always enjoyed challenging the values of Middle America. North Korea is providing him a new avenue to be in the spotlight.

The most passive player in this tragicomedy is Rodman's home country, the United States. The U.S. State Department has deployed the rhetorical equivalent of an embarrassed teenager whose dad has shown up to dance at his prom. Something along the lines of "this has nothing to do with us" is what the State Department has said with every one of Rodman's trip. Last winter,the State Department criticized Rodman's timing as it followed a nuclear test and rocket launch. This time, it has merely said a private individual can do what he wishes.

This is an understandably cautious position. After all, Rodman has professed his love and undying affection for Kim, and he is probably not a canny enough operator to spearhead any form of political outreach along the lines of the "Ping-Pong diplomacy."

On this trip, Rodman addressed the unavoidably political nature of a relationship with North Korea, saying his visits could "open the doors" to "talk about certain things." In the CNN interview, he argued that it's a "great idea for the world."

Rodman's celebrity status and sporting prowess has given him access to Kim. At some point, when both the U.S. and North Korean governments are feeling a little brave, perhaps they can try to thaw the ice with more professional diplomats tagging along on cultural or sporting exchanges.

There are precedents. For example, the U.S.-China Ping-Pong diplomacy of the 1970s had its genesis in table tennis player by the name of Glen Cowan. Once he broke the ice, the governments began talking.

The kind of engagement that Rodman is pushing cannot always be seen as merely rewards for a naughty regime, as much as we appear locked into a carrot-and-stick way of thinking about relations with North Korea. It can be mutually beneficial. We have the potential to gain as much as they do. Breakthroughs might be sudden and surprising, but they are usually underpinned by creative thinking, dialogue and the mutual acceptance that no one can get exactly what they want.

Unfortunately, this particular trip does feel somewhat like a gift, coming as it does on Kim's birthday and less than a month after the violent and very public purge of his uncle and second-in-charge, Jang Song Thaek.

Had Rodman pulled out or delayed, the channel for opening may well have closed. If he really is in it for the long haul, he probably couldn't afford to slight the leader on his birthday.

Domestically, it is great PR for Kim. He gets to appear gregarious and inclusive in front of his people. Notwithstanding Jang's execution, this is the image he has been assiduously cultivating. He's eager to promote his friendly, approachable image while at the same time enjoying watching some former stars play his favorite sport.

For now, little will come out of Rodman's visits other than extraneous news. But as Pyongyang continues to devote resources and energy to sports development, its appetite for athletic exchanges will increase.

Let's warily hope, to use Rodman's phrase, that this can "open the doors" to other things.

"Terri Schiavo's Family Joins Family Of Teen Jahi McMath In Fight Over Life Support"


The family of Terri Schiavo has joined the battle over Jahi McMath, a 13-year-old girl on life support who has been declared dead by doctors.

"Together with our team of experts, Terri's Network believes Jahi's case is representative of a very deep problem within the U.S. healthcare system -- particularly those issues surrounding the deaths of patients within the confines of hospital corporations, which have a vested financial interest in discontinuing life," the Terri Schiavo Life & Hope Network said in a prepared statement.

The organization said it has been overseeing the efforts of several groups to help get Jahi transferred out of Children's Hospital Oakland and brought "to a safe place."

Jahi's family said Tuesday it had found a facility in New York willing to take her. The Oakland hospital "refused to agree to allow us to proceed in that matter," Jahi's uncle Omari Sealey said.

The hospital denied the accusation.

"We have done everything to assist the family of Jahi McMath in their quest to take the deceased body of their daughter to another medical facility," hospital spokesman Sam Singer said.

"To date, they have been unwilling or unable to provide a physician to perform the procedures necessary, transportation, or a facility that would accept a dead person on a ventilator. Our hearts and thoughts go out to them in this tragic situation, but the statements being made by their attorney and some family members are misleading and untrue."

Family attorney Christopher Dolan had accused the hospital of being "hell bent" on ending Jahi's life.

A judge has declared Jahi brain dead as well. Doctors say there's no chance she will come back to life.

Omari Sealey, Jahi's uncle, said Wednesday that the family still hopes to move her to another facility.

He accused the hospital of starving his niece by not using a feeding tube to provide her with nutrients.

Singer said a judge Tuesday had dismissed the family's request for additional medical procedures, including a feeding tube.

A deadline loomed Monday as a judge had said the hospital could disconnect the machines after 5 p.m. (8 p.m. ET). But shortly before Jahi could have been cut off, that same judge extended his order to 5 p.m. (8 p.m. ET) on January 7.

Terri Schiavo died in 2005, nearly two weeks after doctors removed the feeding tube that had sustained her for more than a decade. She was severely brain damaged and became a national focal point in the right-to-die battle.

Her husband and guardian, Michael Schiavo, said she wouldn't have wanted to live in her condition, which Florida courts deemed a "persistent vegetative state." Her parents fought to have her kept alive.

Schiavo's parents, brother and sister created the Life & Hope Network.

The statement Wednesday about Jahi included a quote from Bobby Schindler, Terri Schiavo's brother and executive director of the organization.

"Families and individuals must make themselves aware of what so-called 'brain death' is and what it is not," he said.

"Every person needs to understand that medical accidents happen every day. Families and individuals must be more aware of the issue of accountability and patient rights."

Last month, Jahi had surgery to remove her tonsils, adenoids and extra sinus tissue. Doctors had recommended the surgery to treat pediatric obstructive sleep apnea, a condition that made her stop breathing in her sleep and caused other medical problems.

Before the surgery, Jahi said she was worried that she would never wake up, according to her uncle. She seemed fine after the surgery and asked for a Popsicle because her throat hurt.

It wasn't long before something went terribly wrong. In the intensive care unit, the girl began bleeding profusely -- an image that her mother told CNN would be forever seared in her mind.

According to family members, Jahi went into cardiac arrest.

Days later, she was declared brain dead.

If this entire ordeal is NOT about Stealing this Precious Child's ORGANS and Covering Up MEDICAL MALPRACTICE........

"Judge Extends Life Support For Jahi McMath Until Jan. 7"

The family of the 13-year-old Oakland, Calif. girl who was declared brain-dead after a tonsillectomy was desperately trying to move her to a New York facility until a judge extended her life support at the Children's Hospital in Oakland Monday.

A judge extended life support for a brain-dead 13-year-old girl in Oakland until 5 p.m. on Jan. 7.

Jahi McMath suffered complications from a routine tonsillectomy at the Children's Hospital of Oakland on Dec. 9 to treat sleep apnea. She bled heavily and went into cardiac arrest.

Alameda County Superior Court Judge Evelio Grillo ruled to extend her time on a ventilator shortly before 5 p.m. Monday Pacific time, when she was scheduled to be taken off life support.

The family wants the life support to continue in case there is a possibility for recovery.

The girl's mother, Nailah Winkfield, said she cried and hugged her relatives outside the hospital when she heard the ruling.

"Who wants to know the date and the time their child would die?" she said, according to the Associated Press.

Up until that point, McMath's family was frantically trying to transfer the girl to a New York hospital.

The family's attorney Chris Dolan said he was waiting to hear from the New York facility, which he did not identify because he did not want media attention to influence its decision.

Dolan said other facilities in California have declined to take McMath and the New York hospital is the "last, last hope."

"The family is together, and today everybody is praying and being together," Dolan said Sunday.

The Children's Hospital in Oakland sent a letter to the family Sunday stating they have yet to hear from a New York hospital about taking Jahi.

The Oakland facility said it would need to discuss transportation and other legal issues before it can release the patient.

"We need to be able to talk to the other facility to understand what it is they are capable of doing," Cynthia Chiarappa, a spokeswoman for Children's Hospital, said. "This is not transferring an individual in a vegetative state, but a dead body."

Her family has set up a gofundme account to accept donations to move Jahi.
