The former Dallas police officer was found guilty of murdering her neighbor Botham Jean in his own apartment
Finally, a cop's white tears didn't work.
Fired Dallas police officer Amber R. Guyger, a white woman who shot and killed her unarmed black neighbor, Botham Shem Jean, was found guilty of murder on the second day of jury deliberations, an all-too-rare instance of the justice system holding police officers accountable for reckless actions.
The guilty verdict shocked me, and not because I’m used to being let down by the juries, grand juries, prosecutors and judges presiding over cops' cases.
It shocked me because Guyger had a weapon stronger than the law on her side; even more powerful than the gun she carried.
Guyger was armed with white tears. And in America, white tears are a source of ultimate power.
White tears helped kill Emmett Till, the 14-year-old black boy accused of whistling at a white woman in Mississippi back in 1955.
White tears almost allowed Susan Smith to get away with killing her own kids after claiming that an African American man was the culprit.
And white tears could have ruined the life of an innocent black man in Quincy, Mass, when a white woman said she was assaulted by a black male in his early 20s and only after police reviewed surveillance footage admitted she had made it up. Guyger invoked that power of white tears in court: "I was scared he was going to kill me," she said to the jury.
This time the outcome was justice.
Guyger, 31, lived in the same apartment complex as Jean.
On September 6, 2018, she entered Jean's apartment, which is on a different floor from hers. She says she thought she was in her apartment.
There she saw Jean eating ice cream, and she says she thought he was an intruder, so she shot him.
Jean died from his injuries in a nearby hospital.
Three days later, Guyger was arrested by Texas Rangers who took over the investigation.
Guyger was initially charged with manslaughter and terminated from the police force.
After a series of protests, public outrage, and a sorry attempt by the Dallas police department to smear Jean’s reputation as a Christian man, Guyger was charged with murder by a Dallas grand jury.
The disgraced Guyger faced a multiracial and multiethnic jury during her week-long trial that ended Tuesday in that shocking verdict.
Even though it seems like it would have been an open-and-shut case, African Americans know better.
We have seen how often cops continue to enjoy freedom after killing black people, even when the victims posed no threat, had no weapons, and the incidents were even caught on tape.
Freddie Gray, Eric Garner and Michael Brown — just to name a few — had no firearms on them.
They should be alive today and are not. All of their killers walked.
How does this happen? Cops who kill too often earn a get-out-of-jail-free card when they say “I feared for my life and the lives of my fellow officers.”
And Guyger tried it as well, claiming she was afraid Jean was going to kill her — even though by her logic he would have been more justified in shooting, because she had intruded into his apartment.
Guyger got the verdict she deserves, but I'd hold off on celebrating this turn of justice until she's sentenced.
Her conviction carries a sentence from five to 99 years, and she could easily receive a lesser penalty and be home soon.
And even if she is made to serve decades in prison, an innocent man is dead.
What will Dallas do to prevent another Amber Guyger incident?
Police officers have enormous powers — to take someone's freedom, to take their lives even.
Those powers were granted to Guyger, who then made a colossal, life-ending error in judgment while wielding those powers, with no checks in place to prevent those powers from killing a man.
According to Guyger, she was too tired to recognize her own home that night.
And yet she had enough cognitive control to fire deadly shots at a living being.
Jean had no weapon and, once again, was in his own home; and yet Guyger felt shooting him was her only option.
That's a serious issue — of training, of recruitment, of assessment — that goes deeper than one man's killing, and needs to be aggressively handled by the Dallas Police Department.

President Donald Trump on Sunday weighed in on two mass shootings that occurred 13 hours apart in Texas and Ohio, acknowledging “perhaps more has to be done” to address gun violence.
“We’ve done actually a lot,” Trump told reporters of his administration’s work on the issue, “but perhaps more has to be done.”
Trump, who made the comments to reporters on a tarmac in New Jersey after a weekend spent at his golf club in Bedminster, has overseen a ban on so-called bump stocks, but has not pursued large-scale gun control efforts. His predecessor, President Barack Obama, took executive actions on gun control, including on background checks and mental health.
Early Sunday, a shooter opened fire in Dayton, Ohio, killing nine people in the city’s Oregon District, a popular downtown area. The shooter was shot and killed by responding officers. Hours before on Saturday, a shooter opened fire at an El Paso, Texas, shopping center, killing at least 20 people. A 21-year-old white supremacist is in custody in the Texas domestic terrorism case.
Speaking broadly of the two recent mass shootings, Trump said, “I just want to say that these are two incredible places, we love the people.”
The President, who has regularly used incendiary language at rallies across the country, added, “Hate has no place in our country and we’re gonna take care of it.”
Praising law enforcement, Trump added that the massacres could have been worse. “It would have been unbelievable. It (was) horrible but it would have been so much worse,” he said.
Trump then said he would be making an official statement around 10 a.m. ET Monday on the mass shootings.
Earlier Sunday, Trump tweeted, “God bless the people of El Paso Texas. God bless the people of Dayton, Ohio,” and, separately, ordered American flags to be flown at half-staff as “a mark of solemn respect” for the victims of the tragedies.
Trump called the El Paso, Texas, shooting an “act of cowardice” on Saturday and said there “are no reasons or excuses that will ever justify killing people.”
The President also relayed earlier in a tweet that he had spoken with Texas Gov. Greg Abbott, a Republican, about the El Paso shooting and had offered the “total support” of the federal government to the state.
“Today’s shooting in El Paso, Texas, was not only tragic, it was an act of cowardice. I know that I stand with everyone in this Country to condemn today’s hateful act. There are no reasons or excuses that will ever justify killing innocent people,” Trump tweeted Saturday night.
Trump ended his comments to reporters Sunday stating “on behalf of our first lady and myself, condolences to all. We have to get it stopped. This has been going on for years.”
Ohio Democratic Sen. Sherrod Brown wrote in a tweet Sunday that “thoughts and prayers are not enough, we have a responsibility to act.”
“We are also angry — angry that shooting after shooting politicians in Washington and Columbus refuse to pass sensible gun-safety laws to protect our communities,” Brown said.
Three sources have identified the suspect as 21-year-old Patrick Crusius of Allen, Texas.
The case appears to meet the statutory definition of domestic terrorism, Bash said. Saturday’s shooting at an El Paso shopping center — which left at least 20 people dead and 26 injured — “appears to be designed to intimidate a civilian population, to say the least,” he said.
“We’re going to do what we do to terrorists in this country, which is to deliver swift and certain justice,” Bash said.
El Paso County District Attorney Jaime Esparza said the suspect faces capital murder charges and will be eligible for the death penalty.
“We will seek the death penalty,” he said.
Racist ‘manifesto’ posted on 8chan
Authorities are investigating a racist, anti-immigrant screed that they believe was posted by a man who opened fire Saturday morning, shortly after 10:30 a.m. local time.
About 20 minutes earlier, a post on the online message board 8chan believed to be from the suspect laid out a dark vision of America overrun by Hispanic immigrants. The 2,300-word document, which police called a “manifesto,” was attached to a post that said, “I’m probably going to die today.”
The writing is filled with white nationalist language and racist hatred aimed at immigrants and Latinos. It blames immigrants and first-generation Americans for taking away jobs.
The writer cited a fear that an influential Hispanic population in Texas would make the state a “Democratic stronghold,” though he said “the Republican Party is also terrible,” because the GOP is in his mind pro-corporation, which could lead to more immigration.
The writer of the document said they had held these beliefs for years before Donald Trump was elected President.
It took less than a month to plan the shooting, the author says.
The mass shooting happened in one of the largest and safest cities on the US-Mexico border, a place central to the Trump administration’s hardline stance on immigration and a city that Rep. Cesar Blanco called “ground zero” of the administration’s family separations policy.
El Paso County had an estimated population of 840,000 people as of July 2018, according to the US Census Bureau. An estimated 83% were Hispanic or Latino.
Saturday’s shooting is at least the third atrocity this year where a shooting suspect is thought to have posted to 8chan in advance of an attack.
Before the mass shooting in Christchurch, New Zealand, in March, an account believed to belong to the gunman posted a link to an 87-page white nationalist manifesto on Twitter and 8chan.
And 73 minutes before the deadly shooting at Congregation Chabad synagogue in Poway, California, in April, someone identifying himself as the suspect in that attack posted a link to a hate-speech-filled manifesto hyperlinked on 8chan.
A week bookended by shootings
The El Paso shooting was one of several that happened across the country over the last eight days. It was followed just 13 hours later by another mass shooting in Dayton, Ohio.
At least nine people were killed and at least 26 were injured in a popular nightclub district by a lone gunman, identified as 24-year-old Connor Betts. Dayton Police said the suspect is dead.
Last Sunday, a 19-year-old gunman wearing tactical gear opened fire at the Gilroy Garlic Festival in California, killing three people, including a 6-year-old boy and a 13-year-old girl.
And gunfire erupted Tuesday at another neighborhood Walmart in Mississippi, killing two employees and wounding a police officer. At least 34 people were left dead across all four scenes.
The first call of an active shooter in El Paso went out at 10:39 a.m. local time, El Paso Police Chief Greg Allen said. The first officer arrived on scene at the Walmart near the Cielo Vista Mall six minutes later.
Adria Gonzalez was walking by the meat section on a Saturday morning shopping trip with her mom when she heard the shots.
She said she stepped up to see what was happening and that’s when she saw the shooter near the main entrance, wearing headphones or earmuffs and carrying a gun.
“I could only think about getting my mom and others out of the store,” she said. “We gotta get out of here.”
After she saw the shooter, Gonzalez said she saw a grade-school aged boy get shot in the leg, a man bleeding on the floor and another man, covered in blood, reaching for a nearby child.
“We heard two to three shots, four to five shots, then six to seven shots,” Gonzalez told CNN.
She and her mother took off — along with about 40 other people, Gonzalez said. They waited in a storage area of the store until they no longer heard the gunfire.
“You see this happening in the movies, but when you live it yourself, when you see a person killing, the blood everywhere, you are in shock,” she said.
‘I never knew there was an odor to blood’
Officials from two local hospitals said they had received at least 24 people.
Thirteen people were taken to University Medical Center of El Paso, spokesman Ryan Mielke told CNN, and one of them has died. Two children with non-life-threatening injuries were transferred to a children’s medical facility, Mielke said.
Eleven victims were transported to the Del Sol Medical Center, Dr. Stephen Flaherty said.
Eight are in stable condition and three are in critical condition, and the patients ranged in age from 35 to 82, he said.
Of the 20 killed, three were Mexican nationals, according to a tweet from President Andrés Manuel López Obrador. Of the 26 injured, six were Mexican, Foreign Affairs Secretary Marcelo Ebrard wrote on Twitter.
“The ages and genders of all these people injured and killed are numerous in the age groups,” Allen, the police chief, said Saturday. “The situation, needless to say, is a horrific one.”
The next day, when asked why he used the word “horrific” to describe the scene, Allen told reporters, “There’s not words you can place to say something like that. You have to see it for yourself.”
“When I first got to this job,” he said, “I never knew there was an odor to blood, but there is … I can’t tell you what it means … It will leave an impression that you’ll never forget.”

***** Dogs detect human decomposition in car of man arrested in case of missing girl Maleah Davis, 4
Trained dogs detected the scent of human decomposition in the car of a man arrested in connection with the puzzling disappearance of Maleah Davis, 4, outside Houston, a prosecutor said.
Derion Vence was in jail Sunday on a $1 million bond after he was arrested Saturday and charged with tampering with evidence – a human corpse. Vence is set to appear in court Monday.
Vence, 26, lived with Maleah’s mother, Brittany Bowens, and is believed to be the last person to see the girl before her disappearance more than a week ago.
Houston police said Maleah has not been found and the investigation is continuing. Authorities have declined to say whether they believe Vence killed the girl, but prosecutors said in court documents filed Saturday that Vence could face additional charges, including murder.
Police have said blood found in Vence’s apartment was linked to Maleah.
Vence initially told police he was assaulted by three men in a truck after stopping for a flat tire on the way to pick up Bowens at the airport on the night of May 4.
Vence said Maleah and his 2-year-old son were with him and they were all abducted by the three men, who knocked him unconscious.
When he came to the next day in Sugar Land, about 20 miles southwest of Houston, the girl was missing, Vence told police. He also said the Nissan Altima he was driving was stolen.
Police said surveillance video showed Vence getting dropped off at Methodist Sugar Land Hospital in the silver Altima last Sunday.
Police found the car in a parking lot Thursday.
At Vence’s probable cause court hearing Saturday night, Harris County prosecutor Pat Stayton said two dogs trained to find cadavers reacted to the trunk of the car.
“The dogs were responding to the scent of human decomposition in the vehicle,” Stayton said.
Surveillance video from a neighbor had shown Vence carrying a large, blue laundry basket with a large trash bag from his apartment on May 3, Stayton said. Vence returned three minutes later without the basket and later he was seen leaving the apartment with cleaning supplies, including bleach.
In the car, police found a laundry basket that looked like the one Vence took out of his apartment, Stayton said.
Police have described Vence as Maleah’s stepfather, but Bowens said through a spokesman that Vence is her former fiancé.
Child Protective Services removed Maleah and her brothers from the home Vence and Bowens shared in August after the girl sustained a head wound, but the children were returned in February, according to an agency spokeswoman.
The Houston Chronicle reported that Maleah’s grandmother, Brenda Bowens, had tried to get the kids placed at her home instead of in foster care when Child Protective Services conducted an investigation starting in August.

MALEAH DAVIS' STEPDAD CHANGED STORY WHILE REPORTING HER MISSING:
The stepfather of missing 4-year-old Maleah Davis originally told officers he was attacked while checking his tire over the weekend. But Sugar Land police say his story changed multiple times when they questioned him.
According to police, Darion Vence showed up at Sugar Land Methodist Hospital on Saturday night, where an off-duty officer noticed fresh wounds on him. Vence claimed to be the victim of a roadside attack by three Hispanic suspects the day before while on his way to pick up the girl's mother from Bush Intercontinental Airport.
Police also initially stated Vence was with Maleah and his 1-year-old son when he was left unconscious. He stated that he regained consciousness late Saturday afternoon on the side of Highway 6 near First Colony Mall. His son was with him but Maleah was not.
Vence's son is in the care of a relative while authorities and Texas EquuSearch combed the surrounding area for the missing girl.
On Wednesday, the Sugar Land Police Department revealed the original story had changed while Vence was questioned.
"During the initial interview, the man's story did change several times and some of what he told us just didn't add up," said Doug Adolph, the spokesperson for Sugar Land police.
Houston police took command of the investigation since the attack reportedly happened in the city limits.
SLPD also revealed the family's silver Nissan Altima, which was reported stolen after the attack on Vence, was seen driving around Sugar Land at 3 p.m. Saturday, just several hours before he told police that he regained consciousness.
So far, Vence is not facing any charges, and police have not considered him a suspect in Maleah's disappearance.
On Tuesday, Maleah's biological father, Craig Davis, spoke for the first time since the search began to ABC13 Eyewitness News. He said he wanted to speak directly with Vence about what happened.
"I'm not putting the blame on anybody," Craig said. "I just need the questions that aren't answered to be answered. There are so many unanswered questions. It's not for the public to answer to them for me. It's not for the police to answer them for me. It's not for the news to answer them for me. It's for Darion to answer for me."
Earlier this week, ABC13 learned the little girl, along with two of her siblings, was taken from her home last August as CPS investigated her head injuries. In court documents from Jan. 25, doctors couldn't confirm whether Maleah's injuries were caused by abuse, and due to this, CPS recommended Maleah and her siblings be returned to their family. They were back home by the following month.
The family told Eyewitness News the injuries were from an accidental fall.
Wednesday marked five days since Maleah was last seen alive. Flooding from Tuesday's severe weather forced crews to suspend their search.
A group of Youtube pranksters are facing criminal charges after posting a video of them impersonating Houston police officers.
Christopher Sails, 22, Nyyear Price, 21, Justin Denson, 20 and Devontay Sullivan were arrested Tuesday
after HPD learned of the video that was posted to Sails' and Nyyear's Youtube channels.
According to court documents, the video was filmed on Jun. 13 throughout the course of an afternoon.
The pranksters can be can be heard laughing and following drivers through neighborhoods and residential streets with fake police lights on top of their car.
At one point the group can be seen pulling over a security guard.
"I pulled you over cause you were speeding. I'm just playing, I'm just playing, it's a prank," one of the pranksters can be heard saying.
The men then proceeded to get back in the vehicle and followed another car, pulling it over. The video shows the pranksters exiting the vehicle and approaching a woman, before trying to convince her that they were undercover officers.
"We're undercover police officers. Here's my badge right here. I'm a have to write you a ticket ma'am," the prankster said.
After pulling over a number of drivers, one man warned the pranksters that a police station was nearby and that they should leave the neighborhood.
"Y'all know there's a whole police station down the street; like right there. This is not the right area guys," the man could be heard saying.
Since being posted, the video has close to 200,000 views and over 8,000 likes -- possibly due to the huge following that Sails and Nyyear have on social media.
Sails alone has 1.5 million Instagram followers; Nyyear has 380,000 and Sullivan has 35,000.
Prior to the arrest, Sails was scheduled to host a concert on Jul. 7, at the Underground.
Sails posted a picture of his flyer on Jun. 30, with a caption that read, "Come out to my show July 7th if you in Houston! ❤ click the link in my bio to get your tickets!" Sullivan posted the same photo to his page on Jun. 26.
So, was the arrest a publicity stunt to promote the comedy show and concert?
Many believe so seeing that this wasn't the first time that Sails was thrust into the spotlight due to social media.
Sails became popular by posting Youtube videos with his former girlfriend, Queen Naaija, whom he had a public breakup with over allegedly cheating with McKenna. Sails and Naaija were criticized, accused of sharing the details of their breakup on Youtube to gain followers.
Three cities have filed suit against the Pentagon for lapses that allowed a mass shooter in Texas to buy a gun, even though he carried a conviction in military court that should have barred his purchase.
Devin P. Kelley, who was convicted of domestic violence while serving in the U.S. Air Force, was never reported by the military for inclusion on an FBI database of individuals blocked from purchasing firearms. Kelley went on to kill more than two dozen churchgoers in Sutherland Springs, Tex., last month in one of the worst mass shootings in U.S. history.
In the complaint filed Tuesday in U.S. District Court in Alexandria, Va., the three cities — New York, San Francisco and Philadelphia — say they rely on the integrity of the FBI’s background check system. The suit alleges that the defendants, which include the military branches and Defense Secretary Jim Mattis, have an “admitted, systemic and longstanding failure to comply with the law.”
The cities are seeking to force the Defense Department to fully participate in the reporting system, which they said is already required by law. They also want the court to oversee the department’s compliance efforts.
“The Executive Branch and Congress have both had their chances to repair this clearly broken system. Now, after twenty years of failure, it’s time for the Courts to step in,” Ken Taber, a partner at Pillsbury Winthrop Shaw Pittman and lead counsel for the plaintiffs, said in a statement. The Giffords Law Center to Prevent Gun Violence also helped prepare the suit.
A spokesman for the Defense Department declined to comment Wednesday, citing a policy against commenting on ongoing litigation. A spokesman for the Justice Department said the attorney general has launched his own investigation into the issue.
“After visiting first responders and victims’ families in Sutherland Springs, Attorney General Jeff Sessions instructed the ATF and FBI to conduct a comprehensive review with the Department of Defense of how certain information is reported to the National Instant Criminal Background Check System,” Justice Department spokesman Devin O’Malley said in an email Wednesday. “The Justice Department is reviewing yesterday’s lawsuit and determining next steps.”
Members of a family ravaged by the Sutherland Springs shooting have also filed suit against the Air Force, alleging its failure to report Kelley’s criminal background led to their loved ones’ slayings.
Military officials have long acknowledged problems with the way it reports records to the FBI gun background check database.
According to Pentagon guidelines, military law enforcement personnel are supposed to submit fingerprint cards as well as information about the results of a criminal proceeding to the FBI database if troops are charged with or convicted of certain violent crimes, including domestic violence and child abuse.
However, a recent review by the Pentagon’s oversight agency, which examined 2,502 criminal cases between January 2015 and December 2016, found that 1 in 4 fingerprint cards were not submitted to the database. Military law enforcement failed to submit one-third of the final disposition reports, the review found.
Kelley’s record should have disqualified him from purchasing a weapon. Kelley spent a year in jail for crushing his young stepson’s skull, assaulting his wife and making other threats. He received a bad-conduct discharge from the military in 2014, a step below a dishonorable discharge.
Two years after his discharge, Kelley cleared a background check and bought a Ruger AR-556 semiautomatic rifle from a San Antonio sporting goods shop.
The weapon was found in front of the First Baptist Church in Sutherland Springs after the Nov. 5 killings.
Tropical Storm Harvey sent devastating floods pouring into the nation’s fourth-largest city Sunday as rising water chased thousands of people to rooftops or higher ground and overwhelmed rescuers who could not keep up with the constant calls for help.
The incessant rain covered much of Houston in turbid, gray-green water and turned streets into rivers navigable only by boat. In a rescue effort that recalled the aftermath of Hurricane Katrina, helicopters landed near flooded freeways, airboats buzzed across submerged neighborhoods and high-wheeled vehicles plowed through water-logged intersections. Some people managed with kayaks or canoes or swam.
Volunteers joined emergency teams to pull people from their homes or from the water, which was high enough in places to gush into second floors.
The flooding was so widespread that authorities had trouble pinpointing the worst areas. They urged people to get on top of their homes to avoid becoming trapped in attics and to wave sheets or towels to draw attention to their location.
Judging from federal disaster declarations, the storm has so far affected about a quarter of the Texas population, or 6.8 million people in 18 counties. It was blamed for at least two deaths.
As the water rose, the National Weather Service offered another ominous forecast: Before the storm that arrived Friday as a Category 4 hurricane is gone, some parts of Houston and its suburbs could get as much as 50 inches (1.3 meters) of rain.
That would be the highest amount ever recorded in Texas.
Some areas have already received about half that amount. Since Thursday, South Houston recorded nearly 25 inches (63 centimeters), and the suburbs of Santa Fe and Dayton got 27 inches (69 centimeters).
“The breadth and intensity of this rainfall is beyond anything experienced before,” the National Weather Service said in a statement.
Average rainfall totals will end up around 40 inches (1 meter) for Houston, weather service meteorologist Patrick Burke said.
The director of the Federal Emergency Management Agency, Brock Long, predicted that the aftermath of the storm would require FEMA’s involvement for years.
“This disaster’s going to be a landmark event,” Long said.
Rescuers had to give top priority to life-and-death situations, leaving many affected families to fend for themselves.
Tom Bartlett and Steven Craig pulled a rowboat on a rope through chest-deep water for a mile to rescue Bartlett’s mother from her home in west Houston. It took them 45 minutes to reach the house. Inside, the water was halfway up the walls.
Marie Bartlett, 88, waited in her bedroom upstairs.
“When I was younger, I used to wish I had a daughter, but I have the best son in the world,” she said. “In my 40 years here, I’ve never seen the water this high.”
The city’s main convention center was quickly opened as a shelter.
Gillis Leho arrived there soaking wet. She said she awoke Sunday to find her downstairs flooded. She tried to move some belongings upstairs, then grabbed her grandchildren.
“When they told us the current was getting high, we had to bust a window to get out,” Leho said.
William Cain sought shelter after water started coming inside his family’s apartment and they lost power. “I live in a lake where there was once dry land,” he said.
Some people used inflatable beach toys, rubber rafts and even air mattresses to get through the water to safety. Others waded while carrying trash bags stuffed with their belongings and small animals in picnic coolers.
Houston Mayor Sylvester Turner said authorities had received more than 2,000 calls for help, with more coming in. He urged drivers to stay off roads to avoid adding to the number of those stranded.
“I don’t need to tell anyone this is a very, very serious and unprecedented storm,” Turner told a news conference. “We have several hundred structural flooding reports. We expect that number to rise pretty dramatically.”
The deteriorating situation was bound to provoke questions about the conflicting advice given by the governor and Houston leaders before the hurricane. Gov. Greg Abbott urged people to flee from Harvey’s path, but the Houston mayor issued no evacuation orders and told everyone to stay home.
The governor refused to point fingers on Sunday.
“Now is not the time to second-guess the decisions that were made,” Abbott, a Republican, said at a news conference in Austin. “What’s important is that everybody work together to ensure that we are going to, first, save lives and, second, help people across the state rebuild.”
The mayor, a Democrat, defended his decision, saying there was no way to know which parts of the city were most vulnerable.
“If you think the situation right now is bad, and you give an order to evacuate, you are creating a nightmare,” Turner said, citing the risks of sending the city’s 2.3 million inhabitants onto the highways at the same time.
Jesse Gonzalez, and his son, also named Jesse, used their boat to rescue people from a southeast Houston neighborhood.
Asked what he had seen, the younger Gonzalez replied: “A lot of people walking and a lot of dogs swimming.”
“It’s chest- to shoulder-deep out there in certain areas,” he told television station KTRK as the pair grabbed a gasoline can to refill their boat.
The Coast Guard deployed five helicopters and asked for additional aircraft from New Orleans.
The White House announced that President Donald Trump would visit Texas on Tuesday.
He met Sunday by teleconference with top administration officials to discuss federal support for response and recovery efforts.
The rescues unfolded a day after Harvey settled over the Texas coastline. The system weakened Saturday to a tropical storm.
On Sunday, it was virtually stationary about 25 miles (40 kilometers) northwest of Victoria, Texas, with maximum sustained winds of about 40 mph (72.42 kph), the hurricane center said.
Harvey was the fiercest hurricane to hit the U.S. in 13 years and the strongest to strike Texas since 1961’s Hurricane Carla, the most powerful Texas hurricane on record.
Now that the sun is finally shining and the murky, brown floodwaters are slowly receding in much of the Houston area, grim reality is setting in.
Harvey is about to release its dead.
In Texas, the official death toll surpassed 30 on Wednesday and was expected to climb as authorities investigated several other deaths to determine whether they were storm-related.
Officials fear that the number of fatalities will climb sharply in coming days as neighbors, emergency workers and family members search for the missing — and discover the bodies of people trapped in waterlogged homes or encased in underwater graves inside cars.
And the death toll might rise even further in the recovery phase, from car crashes, carbon monoxide poisoning or other accidents during cleanup.
"Historically all estimates of deaths are wrong in the beginning," said Craig Fugate, who was the Federal Emergency Management Agency director from 2009 until earlier this year.
Already, the nation is shocked by the horrors revealed as the storm moves out of the area and east toward Louisiana and points north.
The first confirmed fatality came early: A man in the Gulf coastal city of Rockport was killed in a fire late Friday as the storm raged ashore.
On Wednesday, officials located a submerged van that seven members of a Houston family had been traveling in when it was swept off a bridge and into a storm-ravaged bayou.
Samuel Saldivar told police he was trying to bring his elderly parents and his brother's four grandchildren to safety from their flooded home on Sunday when the van he was driving was tossed by a strong current into the bayou as it crossed the bridge.
He escaped through a window but the six others were trapped when the van's partially submerged sliding door wouldn't open.
Also Wednesday, authorities said 65-year-old Donald Rogers and his 58-year-old wife, Rochelle, drowned when they were swept away by a current after driving their pickup truck into floodwaters in a rural area southwest of Houston.
Fort Bend County Sheriff's Maj. Chad Norvell said the couple was on the phone with 911 asking for help when the line went silent. When officers found the truck, it was completely submerged.
Sunlight Returns to Houston, Revealing the Grim Reality of Harvey's Aftermath
On Tuesday afternoon, a 3-year-old girl was found alive in a rain-swollen canal, clinging to the body of her drowned mother in Beaumont, Texas.
A second woman was confirmed dead in Beaumont on Wednesday.
Earlier Tuesday, the body of 61-year-old Houston Police Sgt. Steve Perez was found in his car. He'd been swept down a flooded road as he drove to his precinct, determined to serve his community.
Eleven other confirmed deaths, some of which were listed on a Harris County database, showed people were found floating in waters — some in homes or businesses, others near cars.
Among those victims was Ruben Jordan, a high school football and track coach, who was last seen late Saturday helping people through floodwaters.
His family was informed on Monday that he had died in the floods.
"The sad thing is, of the deaths we've seen, we're going to see more, unfortunately," said Jeff Schlegelmilch, the deputy director of the National Center for Disaster Preparedness at Columbia University. "That number doesn't stop moving up until we're well into the recovery phase."
No official number of the missing has been released, and a spokesman for the Harris County Sheriff's Office, where Houston is located, said there isn't a specific strategy in place to look for additional bodies.
"We are going to go out and try to find any potential victims that may be there," said the spokesman, Jake Smith. "We are also encouraging the public if they come across anything, we strongly urge them to call 911 if they find a body or a potential victim."
Houston Police Chief Art Acevedo said the department had received 47 missing persons reports since Harvey inundated the city and 27 of those individuals have been located.
Photos with pleas for help have been posted on social media, cut-and-pasted and retweeted by thousands of people as desperate family members seek loved ones they fear may be dead — but who may only have a cellphone without power.
The uncertainty is terrifying.
One of the worries, said Schlegelmilch, is that many of the severely flooded neighborhoods weren't in evacuation areas.
Additionally, the people most likely to be found dead are the elderly, the infirm and the people who were isolated from others — along with folks who didn't have the means or wherewithal to flee.
Sometimes it's a matter of having the strength to wade through floodwaters a few blocks to safety, or to pull one's self up onto a roof.
"Those who are the most vulnerable when the sky is blue, they are also the most vulnerable when the sky is gray," Schleglemilch said.
Fugate, the former FEMA head, said it's also common for people to die during the recovery phase, when stress levels are high and people aren't making clear-headed decisions.
"Stay safe, stay home, stay off the roads if you can. Don't go sightseeing," he warned.
Still, experts say there is some good news:
They don't expect the death toll from Harvey to come anywhere close to that of Katrina, when 1,800 people died.
Many of those flood-related fatalities came when a levee broke and water inundated New Orleans.
People were stranded in extreme heat and the federal response was slow.
Emergency managers learned painful lessons during Katrina, and have put those lessons to use in this storm.
Residents of New Orleans during Katrina saw top-to-bottom failures at every level, experts said.
During Harvey, "state and local officials and FEMA were mobilizing, water rescue teams were prepared, in anticipation of this," said Fugate, adding that safe shelters were almost immediately in place for Texas residents, unlike New Orleans. "That provided faster rescues."
One other thing seems to have helped Houston in its time of need: the residents themselves.
"Neighbors helping neighbors," Fugate said. "That will keep the death toll down."
People in poor communities lack the resources to escape the worst of the flooding.
As the remnants of Hurricane Harvey continues its march, the lives that are most devastated are those confined to poor communities of color—as we’ve seen with previous mega storms like Hurricane Katrina.
The New York Times reports that the hurricane, now a tropic storm, drenched parts of Texas throughout Sunday. At least five people died and more than a dozen have been reported injured, since Harvey struck Texas’s Gulf Coast, dropping up to 25 inches of rain since Friday. Several areas have seen a downpour of as much as 50 inches.
In Houston, as with many other cities, poor communities of color are the most vulnerable during these destructive storms. They tend to live in segregated, flood risk neighborhoods that are near petrochemical plants, according to The Atlantic.
People in these communities lack the resources to evacuate, and the authorities—despite South Texas’ vulnerability to major storms—have failed to create an evacuation plan.
Houston Mayor Sylvester Turner defended his decision not to order an evacuation for some neighborhoods, KPRC-TV reported.
He told residents that their homes are “the best place” to stay during the storm, the NBC News affiliate reported.
Those who were unable to escape Harvey are “overwhelming” emergency centers with phone calls and tweets for help, The Atlantic stated. Homeless people sought shelter under highways and other low-lying areas to prepare for Harvey. Many of those makeshift shelters are now under water.
KPRC-TV reported that Houston’s 911 center has received more than 56,000 calls since Saturday evening. Police and firefighters have fielded more than 6,000 rescue calls, and more than 1,000 people have been pulled out of flooded homes and streets.
According to the current affairs publication, Texas has failed to fund a plan to control flooding, even though most climate scientists predict an increase in superstorms because of climate change. The most vulnerable are feeling the consequences.
Meanwhile, Harvey is not finished. The storm is expected to create tornadoes and floods in its path, which remains inhabited by poor people of color.

X known MS-13 gang member wanted in connection with two homicides in Texas was caught in Arlington, Virginia.
Arlington County police, along with federal agents, arrested 20-year-old Douglas Alexander Herrera-Hernandez on Saturday, while he was walking near Four Mile Run Drive and Columbia Pike.
The Texas Department of Public Safety issued an all-points bulletin for Herrera’s arrest on July 26. Local law enforcement and ICE agencies received information that the suspect was possibly in Virginia.
Herrera is wanted in connection with two murders in the Houston area. The first warrant is for a shooting in Missouri City, Texas, on June 13, 2016; the second is in connection to a homicide on July 9, 2017.
Herrera, a Salvadoran national known as “Terror,” was one of the 10 most wanted fugitives in Texas, according to an ICE statement.
ICE records indicate that Herrera was arrested by U.S. Border Patrol in December 2014 when he entered the country illegally in Texas.
An immigration judge ordered his removal to El Salvador after Herrera failed to appear in court in June 2015 for his hearing.
Herrera is in jail in Arlington County, pending extradition to Texas.
Texas Lt. Governor Dan Patrick put the blame for the deaths of 10 illegal aliens packed in the back of an 18-wheeler on sanctuary cities.
“[Sunday’s] tragedy is why I made passing Senate Bill 4 to ban sanctuary cities — which is now law — a top priority,” the Republican Lt. Governor posted on Facebook. “Sanctuary cities entice people to believe they can come to America and Texas and live outside the law. Sanctuary cities also enable human smugglers and cartels.”
Initially, eight people lost their lives from exposure to the heat and lack of water after human smugglers left 39 people locked in the back of a refrigerated trailer with a failed air conditioner. The death toll rose to nine later on Sunday and then to 10 early Monday.
“[T]hese people paid a terrible price and demonstrate why we need a secure border and legal immigration reform so we can control who enters our country,” Patrick wrote. “We continue to pray for the families and friends of the victims.”
Officials identified the driver of the truck as 60-year-old James Mathew Bradley, Breitbart Texas reported. He is a resident of Clearwater, Florida, according to the U.S. Attorney’s Office for the Western District of Texas. He is due in court Monday to face charges that will likely include murder and human smuggling.
Walmart employees became aware of the people being trapped in the trailer after one of the aliens approached them and asked for water. Police arrived at the scene shortly after midnight Sunday morning. At least 29 fire rescue units responded and two AirLIFE helicopters assisted in transporting the most critically ill patients.
Surveillance cameras showed a number of automobiles coming to pick up individuals in the trailer. Authorities suspect a human smuggling operation was underway.
Medical teams transported nearly two dozen people to local hospitals, including two 15-year-old males. All of the deceased illegal aliens are reported to be adult males.

President Donald Trump is ready to crack down on the infamous, money-making MS-13 gang, after a violent quadruple homicide in Long Island, N.Y. last week left four teenagers dead and badly beaten. Trump is promising to remove the gang from U.S. streets “fast.”
MS-13, a group that was started by Central American immigrants in Los Angeles in the 1980s, is known for its ruthless and violent tactics. Most of the founding members were from El Salvador and fled to the U.S. during the country’s civil war that lasted 12 years, from 1980-92. Since then the gang’s membership has ballooned to at least 10,000 members in the United States and more than 30,000 worldwide, according to the FBI and Treasury Department.
“[MS-13] is one of the most dangerous and rapidly expanding criminal gangs in the world today,” Philip Holloway, a legal analyst and former police officer, told FOX Business. “MS-13’s mottos is ‘Mata, roba, viola, controla’ (Kill, steal, rape, control),” he noted.
The gang has managed to expand its business tentacles into a variety of illegal activities, despite sanctions levied against the group by the U.S Treasury Department under the Obama administration. “They are involved in multiple crimes including murder, racketeering, drug trafficking, sex trafficking and human trafficking including prostitution,” Holloway said.
MS-13 also uses violence as a means for extortion, which constitutes much of its income, University of Houston sociology professor Luis Salinas told FOX Business.
“A lot of the violence is part of the extortion … and prostitution. Once they get here they get these individuals and extort money from their families. They’re also into extortion for protection of this neighborhood or that neighborhood,” Salinas said.
In 2015 the U.S. Treasury Department froze the assets of three members of the gang who were funneling funds back to higher-ups in El Salvador from prison. These actions were an attempt “disrupt” MS-13’s financial network by cutting off profits from illegal activities in the United States, the Treasury Department said. In 2012 the Obama administration designated MS-13 a transnational crime organization and implemented sanctions against six members in 2013.
While the U.S. government attempts to target MS-13’s earnings, targeting its culture is proving more difficult. The fierce loyalty among members is unique, Ron Hosko, former assistant director of the FBI’s Criminal Investigative Division, told FOX Business.
“They're very cohesive and often directed by imprisoned bosses in El Salvador to recruit and expand in American communities. That tends to mean there's an aggressive internal enforcement mechanism which equates to internal discipline involving physical violence and murder for disrespect or betrayal,” he said.
Membership in street gangs showed no signs of decreasing, according to the FBI’s 2015 National Gang Report, and MS-13 was identified as one of the top gangs involved in cross-border crimes. Recently, law enforcement has taken a tougher stance on making arrests; a move spurred by Attorney General Jeff Session’s focus on illegal immigrant crime, Hosko said.
“MS is a clear example [of illegal immigrant crime]. Affiliates would cross the border and make their way to American enclaves where they found friends and relatives living here already,” he said. “Citizenship is a combination of American born (many to illegals) and illegal immigrants.”
Salinas said about 60-70 percent of current U.S. members in MS-13 are immigrants, the majority of which could be illegal.
On Tuesday during an interview on Fox News, Attorney General Jeff Sessions said he believes the gang “could qualify” as a terrorist group. In El Salvador, MS-13 has already been designated as a terrorist organization.
Hosko said President Trump’s administration is changing the narrative quickly for both gang members and law enforcement in the United States.
“[The FBI] believed that claiming of ‘credible fear’ of persecution, gang retaliation, other bad acts in their homeland to immigration authorities likely resulted in widespread release of bad actors into the U.S. as their claims were being evaluated. With Obama, that was acceptable risk. I think that's changing fast.”
A federal appeals court has struck down North Carolina’s voter identification law, holding that it was “passed with racially discriminatory intent.”
The ruling also invalidated changes the state made in 2013 to early voting, same-day registration, out-of-precinct voting, and preregistration.
The state could seek to appeal the decision to the full bench of the 4th Circuit Court of Appeals or to the Supreme Court, but it seems unlikely those courts will step in to restore the voter ID law and other voting-related changes in advance of the November election.
The Supreme Court on Thursday rejected a challenge to a race-conscious admissions program at the University of Texas at Austin, handing supporters of affirmative action a major victory.
The vote was 4-3.
Only seven justices participated in the decision, as Justice Elena Kagan had recused herself for prior work on the case as United States solicitor general and the late Justice Antonin Scalia’s seat remains vacant.
Justice Anthony M. Kennedy wrote the majority opinion, joined by Justices Ruth Bader Ginsburg, Stephen G. Breyer and Sonia Sotomayor.
Chief Justice John G. Roberts Jr. and Justices Clarence Thomas and Samuel A. Alito Jr., dissented.
The case concerned the University of Texas’ idiosyncratic admissions program.
Most applicants from within the state are admitted under a part of the program that guarantees admission to top students in every high school in the state.
(This is often called the Top 10 Percent program, though the percentage cutoff can vary by year.)
The Top 10 Percent program has produced significant racial and ethnic diversity. In 2011, for instance, 26 percent of freshmen who enrolled under the program were Hispanic, and 6 percent were black. Texas is about 38 percent Hispanic and 12 percent black.
The case challenged a second part of the admissions program.
Under it, remaining students from Texas and elsewhere are considered under standards that take into account academic achievement and other factors, including race and ethnicity.
Many colleges and universities base all of their admissions decisions on such holistic grounds.
In Grutter v. Bollinger in 2003, the Supreme Court endorsed free-standing admissions programs, saying it was permissible to consider race as one factor among many to achieve educational diversity.
Writing for the majority in that case, Justice Sandra Day O’Connor said she expected that “25 years from now,” the “use of racial preferences will no longer be necessary.”
The case, Fisher v. University of Texas, No. 14-981, was brought by Abigail Fisher, a white woman who said the university had denied her admission based on her race.
She has since graduated from Louisiana State University.
