**** DOJ threatens to withhold crime-fighting funds from four sanctuary cities


Attorney General Jeff Sessions is reinforcing threats to go after sanctuary cities, warning the administration may withhold federal crime-fighting funds for four places struggling with gun violence.

It is the latest threat made by Sessions in his public campaign to force cooperation between local authorities and federal immigration officials.

The Justice Department sent letters to police departments in Baltimore, Md., Albuquerque, N.M., Stockton and San Bernardino, Calif. telling them if they wanted federal help to root out drug trafficking and gang crime, they’d have to work with federal immigration authorities.

Among other things, the Justice Department said they must give the authorities access to jails and provide advance notice before releasing someone in custody who is wanted on immigration violations.

The four cities targeted had all expressed interest in the DOJ’s new Public Safety Partnership, which enlists federal agents, analysts and technology to help communities find solutions to crime.

“Based on our review, we have concluded that your jurisdiction has levels of violence that exceed the national average, that your jurisdiction is ready to receive the intensive assistance the Department is prepared to provide, and that your jurisdiction is taking steps to reduce its violent crime,” the Aug. 3 letter said.

The letter sent by the DOJ to the four prospective cities’ police departments also asks them for proof of their compliance to step up efforts to help detain and deport people in the United States illegally. The deadline is Aug. 18.

Separately last week, Sessions told jurisdictions they need to meet the same conditions or lose out on millions of dollars from a separate program that aims to send grant money to support law enforcement.

The attorney general rolled out the rules as part of his promised crackdown on sanctuary cities.

His threat didn’t sit well with some – prompting a defiant pushback on the request.

Under old rules, cities seeking grant money needed only to show that they weren't prohibiting local law enforcement from communicating with immigration authorities.

Police use the money for everything from bulletproof vests to body cameras.

Sessions unveiled the policy amid speculation about whether he would retain his job following President Trump's blistering public criticism for his recusal from the Russia probe. The terse warning from the president seems, for now, to have subsided.

X known MS-13 gang member wanted in connection with two homicides in Texas was caught in Arlington, Virginia.


Arlington County police, along with federal agents, arrested 20-year-old Douglas Alexander Herrera-Hernandez on Saturday, while he was walking near Four Mile Run Drive and Columbia Pike.

The Texas Department of Public Safety issued an all-points bulletin for Herrera’s arrest on July 26. Local law enforcement and ICE agencies received information that the suspect was possibly in Virginia.

Herrera is wanted in connection with two murders in the Houston area. The first warrant is for a shooting in Missouri City, Texas, on June 13, 2016; the second is in connection to a homicide on July 9, 2017.

Herrera, a Salvadoran national known as “Terror,” was one of the 10 most wanted fugitives in Texas, according to an ICE statement.

ICE records indicate that Herrera was arrested by U.S. Border Patrol in December 2014 when he entered the country illegally in Texas.

An immigration judge ordered his removal to El Salvador after Herrera failed to appear in court in June 2015 for his hearing.

Herrera is in jail in Arlington County, pending extradition to Texas.

****** 10 Illegal Aliens Are Dead Because of Sanctuary Cities, Says Texas Lt. Governor


Texas Lt. Governor Dan Patrick put the blame for the deaths of 10 illegal aliens packed in the back of an 18-wheeler on sanctuary cities.

“[Sunday’s] tragedy is why I made passing Senate Bill 4 to ban sanctuary cities — which is now law — a top priority,” the Republican Lt. Governor posted on Facebook. “Sanctuary cities entice people to believe they can come to America and Texas and live outside the law. Sanctuary cities also enable human smugglers and cartels.”

Initially, eight people lost their lives from exposure to the heat and lack of water after human smugglers left 39 people locked in the back of a refrigerated trailer with a failed air conditioner. The death toll rose to nine later on Sunday and then to 10 early Monday.

“[T]hese people paid a terrible price and demonstrate why we need a secure border and legal immigration reform so we can control who enters our country,” Patrick wrote. “We continue to pray for the families and friends of the victims.”

Officials identified the driver of the truck as 60-year-old James Mathew Bradley, Breitbart Texas reported. He is a resident of Clearwater, Florida, according to the U.S. Attorney’s Office for the Western District of Texas. He is due in court Monday to face charges that will likely include murder and human smuggling.

Walmart employees became aware of the people being trapped in the trailer after one of the aliens approached them and asked for water. Police arrived at the scene shortly after midnight Sunday morning. At least 29 fire rescue units responded and two AirLIFE helicopters assisted in transporting the most critically ill patients.

Surveillance cameras showed a number of automobiles coming to pick up individuals in the trailer. Authorities suspect a human smuggling operation was underway.

Medical teams transported nearly two dozen people to local hospitals, including two 15-year-old males. All of the deceased illegal aliens are reported to be adult males.

***** Man going to prison for selling fake IDs to undocumented immigrants in Carolinas


A Mexican man was sentenced to two years and 10 months in prison on Wednesday for providing fake documents to undocumented workers and others in the Carolinas and Georgia.

Humberto Ginez-Edmundo, 27, charged $130 to $600 for the fake Social Security cards, state identification cards, driver’s licenses and permanent residence cards he produced beginning in November 2015, court records show.

Ginez-Edmundo was convicted of fraudulent identification document conspiracy and aggravated identity theft.

Chief U.S. District Judge Frank Whitney sentenced him in federal court in Charlotte.

Ginez-Edmundo will face deportation proceedings after serving his sentence, the U.S. Attorney’s Office in Charlotte said.

U.S. Immigration and Customs Enforcement Homeland Security Investigations led the investigation into the fake documents Ginez-Edmundo produced and sold.

~ More Sleet, Snow Expected For Charlotte Region

The first winter storm of the season left icy roads across the Charlotte region Friday, and forecasters said several more rounds of snow and sleet are expected before the precipitation comes to an end Saturday.

If there was a bright spot to the storm, which is expected to turn into a raging blizzard farther up the East Coast, it was that Charlotte appeared to escape the heavy freezing rain that meteorologists had feared.

Instead, the heaviest freezing rain as of Friday afternoon fell in the South Carolina Upstate and to the east in the North Carolina Sandhills.

Duke Energy, which had recruited more than 1,000 out-of-state utility workers for possible line repairs, reported at mid-afternoon that there were about 30,000 power outages in the Carolinas.

Nearly half those – about 13,000 – were in Greenville County, S.C.

Instead, Charlotte-area residents dealt with heavy sleet and, farther to the northwest, several inches of snow.

The National Weather Service says the winter storm warning for Charlotte will extend until 7 p.m. Saturday. Sleet and some freezing rain are expected to continue in the region Friday afternoon and evening, but the precipitation is forecast to change to snow in the early-morning hours Saturday.

The Weather Service’s computer guidance indicated a band of heavy snow could form early Saturday in the Piedmont and Foothills, perhaps bringing 2 or 3 inches to parts of the Charlotte area.

Clearing is forecast Saturday evening, and the weather is expected to be clear and cold Sunday for the Panthers-Cardinals NFC Championship Game in Charlotte.

Meteorologists had warned that a half-inch of ice could accumulate in Charlotte – enough to cause major problems with downed tree limbs and power lines. Instead, it was mostly sleet that fell from the bands of precipitation that moved across the region during the day.

Sleet does not create power outage problems but is a major headache for road crews.

Local and state officials urged area residents to remain on guard, despite the several hours of precipitation-free conditions that developed late Friday morning.

“The big message here is it continues to be a fluid situation,” Charlotte City Manager Ron Carlee said. “We’re in a lull. As it’s been suggested, we’re in halftime. But the second half could be worse, and it could go into overtime.”

Gov. Pat McCrory said in a news conference in Raleigh, “Now is not the time to let down your guard.”

The precipitation began, as expected, shortly before midnight Thursday evening as rain. It changed to sleet a few hours later in Charlotte, coating the streets with a layer of congealed ice pellets.

To the north and northwest, the precipitation fell as snow. The National Weather Service said it received several reports of 8 inches or more in and around Asheville, and there were widespread reports of 4-7 inches along the Interstate 40 corridor.

Col. William Grey, head of the N.C. Highway Patrol, said troopers helped 100 motorists get their stranded vehicles off roads Friday morning. The Highway Patrol responded to 571 collisions through Friday morning and 800 calls for service.

Hickory police were investigating a fatal crash that might have been weather-related. Police said one person was killed when a car went off a roadway in the early-morning hours. Snow was falling at the time.

“We strongly encourage everyone not to travel unless absolutely necessary,” Grey said.

Charlotte Department of Transportation director Danny Pleasant said 72 crew members, divvied among 36 trucks, were working 12-hour shifts to cover area roads with salt and brine.

Duke Energy had called in 2,800 crew members from Florida, Georgia, Missouri, Michigan, Indiana, Oklahoma and Texas to help manage outages in the Carolinas, said district manager Tim Gause. “The full impact of the storm system is unknown at this time, but I want you to be prepared,” he said.

American Airlines canceled all flights in and out of Charlotte Douglas International Airport on Friday.

The airline operates more than 90 percent of the daily flights in Charlotte, so air travel to and from the city was largely stopped until Saturday morning, when American plans to resume air service from the city.

Flights were also canceled Friday for Delta, United, Southwest, Lufthansa, Air Canada, ViaAir and JetBlue.

Schools across the region canceled classes, and the Charlotte-Mecklenburg Schools announced that SAT testing scheduled for Saturday would not take place.

The NASCAR Hall of Fame’s induction dinner and ceremony scheduled for Friday evening was postponed until 1 p.m. Saturday, said executive director Winston Kelley.

Charlotte area postal officials suspended mail collection from the family blue collection boxes Friday.

Mail delivery was suspended Friday for customers in ZIP codes beginning with 280, 281, 282, 287, 288 and 297.
Retail services also were suspended.

On Monday morning, Nashville was 40 degrees colder than Albany, New York. Memphis, Tennessee, was 20 degrees colder than Anchorage, Alaska. And Atlanta was colder than Moscow.

But the U.S. South was downright balmy compared to the Great Lakes region, where temperatures hovered in the negative 20s -- before wind chill, which dropped temps to the negative 50s, making it very dangerous to go outside.

The bitter cold that a "polar vortex" is pushing into much of the United States is not just another winter storm. It's the coldest in 20 years in many areas, and breaking some records.

More than 3,500 flights nationwide were canceled by noon ET Monday, according to flightaware.com.

Illinois Gov. Pat Quinn declared a statewide disaster and activated the Illinois National Guard to help provide aid.

While the current weather patterns gave the Northeast a bit of a reprieve, it's in for a brutal drop as the arctic air works its way east. New York, where it was about 50 degrees with wind chill Monday morning, could go as low as minus 7 on Tuesday, said CNN meteorologist Indra Petersons. The region could face a 60-degree temperature change in a single day.

The temperature spread within the United States is a stunning 130 degrees, CNN meteorologist Dave Hennen said, with wind chill putting northern Minnesota at 60 below zero, while Key West, Florida, basks in its dreamy 70 degrees. Much of the West can also expect relatively pleasant weather through Tuesday.

But from Minneapolis to Chicago to Milwaukee, people are under health warnings to stay indoors. Many schools have closed.

"Skin freezes in just five minutes with a wind chill of minus 50," said HLN meteorologist Bob Van Dillen.

Frostbite occurs in 10 minutes with wind chills of minus 35, Hennen added.

Over the past week, at least 13 people have died of weather-related causes. Eleven people died in road accidents; one man in Wisconsin died of hypothermia, and an elderly woman with Alzheimer's disease who wandered away from her home in New York state was found dead in the snow in a wooded area about 100 yards away.

Rare warning

In a very rare move, Minneapolis issued a "Particularly Dangerous Situation" warning about the "historic and life-threatening cold." Such warnings are typically issued for tornadoes, said Petersons.

The National Weather Service adopted the Twitter hashtag "#Chiberia" for Chicago, where temperatures were at 14 below zero. (Parts of the vast Siberian region, such as Tobolsk, had Fahrenheit temps in the low teens Monday, though other parts had temperatures of 50 below zero.)

Some of the greatest concern surrounds the tens of thousands of Midwesterners without electricity.

More than 15,000 customers in Indiana, 6,800 in Illinois and 2,200 in Missouri didn't have power overnight, according to utility companies.

Chicago opened up 12 centers for residents to seek warmth, one of which was to stay open all night through Tuesday.

Libraries and some other city facilities would also be open, said Evelyn Diaz of the city's Department of Family and Support Services.

Illinois Gov. Pat Quinn said 100 warming centers were open statewide.

In an expected but significant move, Immigrations and Customs Enforcment (ICE) announced today that they would halt all deportations to Haiti in "response to the devastation caused by yesterday's earthquake."

The impoverished island nation was hit by a magnitude 7.0 earthquake 10 miles off its shore Tuesday evening. The death toll is not known, though some Haitian officials say it could be in the hundreds of thousands.

More than 32,000 Haitians reside illegally in the US, according to a May 2009 story in the Boston Globe. Haiti is the poorest country in the Western Hemisphere – 80 percent of the 9 million on the island live below the poverty line, according to the CIA World Factbook – and remittances are a primary source of foreign exchange and nearly a quarter of Gross Domestic Product (GDP). After four hurricanes and major storms in 2008, Haiti's government asked the US to give its illegal immigrants Temporary Protected Status (TPS), which would shield them from deportation and allow them to work legally.

Though images of Haitian "boat people" are fresh in the American memory, Haitians do not have a 'wet-foot dry-foot' policy similar to Cubans, which eases their immigration to the US. (Under US law, Cuban nationals who reach the US by boat and make it to land have the right to stay whether or not they have a visa.)

Speaking with reporters in Miami, Haitian-born Florida state rep. Yolly Roberson said of Haitian immigrants long-standing desire to be granted TPS: "If there is ever a time for the federal government to consider granting Temporary Protected Status to Haitians, this is now. This is not the time to send Haitians back to Haiti.''

N.C. native wrongly deported to Mexico

Federal investigators ignored evidence the man is a U.S. citizen, documents show

The U.S. government admitted in April that it had wrongly deported an N.C. native, but newly released documents show that federal investigators ignored FBI records and other evidence showing that the man was a United States citizen.

At the time of Mark Lyttle's deportation, Immigration officials had criminal record checks that said he was a U.S. citizen. They had his Social Security number and the names of his parents. They had Lyttle's own sworn statement that he had been born in Rowan County.

None of this stopped them from leaving Lyttle, a mentally ill American who speaks no Spanish, alone and penniless in Mexico, where he has no ties.

Lyttle's 350-page U.S. Department of Homeland Security file, released to The (Raleigh) News & Observer, shows that the government deported him based entirely on some of his own conflicting statements, even though agents knew that Lyttle is bipolar and has a learning disability.

“I tried to tell them I was a U.S. citizen born right here in Rowan County,” Lyttle says now. “But no one believed me.”

Lyttle is one of a growing number of people who have been swept up in the federal immigration detention system since 2001, when terrorist attacks prompted an unprecedented effort to find and deport illegal immigrants. The U.S. government deported 350,000 people in the fiscal year that ended in October 2008.

When The News & Observer first reported on Lyttle's case in April, officials with U.S.Immigration & Customs Enforcement or ICE, said that Lyttle had caused the mistake declaring that he was from Mexico. They maintain that position now.

“Individuals who misrepresent their true identity and make false statements to ICE officers create problems both for law enforcement and themselves,” ICE spokesman Ivan Ortiz-Delgado said in a written statement.

Lyttle swore to immigration agents on two occasions that he was Mexican, but he also swore that he was a U.S. citizen born in Rowan County. His Homeland Security file does not reflect any attempt by ICE officials to confirm Lyttle's citizenship claims.

The agent who took Lyttle's statement that he was born in North Carolina dismissed it, saying in a report that Lyttle “does not possess any documentation to support his claim.”

A few dozen pages were withheld from the file released by ICE. But the file provided to The News & Observer shows no search for a Rowan County birth certificate and no attempts to reach the family members Lyttle named before his initial deportation.

The ICE file states that Lyttle's Mexican citizenship “was established based on interview results and numerous background system checks.” But repeated background checks, from an FBI fingerprint database and the National Crime Information Center, showed he was an American citizen.

Asked by The News & Observer why they had not accepted the findings in these background checks, ICE officials said they were reviewing their information and could not provide a response after a week.

The inconsistencies in his case were not discussed when Lyttle appeared before an Atlanta immigration judge and was ordered deported on Dec.9. On Dec. 18, he was loaded onto a plane and left at an airport just across the border from Hidalgo, Texas.

On Dec. 29, he returned to the U.S. border threatening to hurt himself and the border patrol agents. “Subject appears to be mentally unstable,” the report notes.

Lyttle, who now lives with his mother in Georgia, says that during his travels he didn't take medications that treat his mental illness and was subject to cycles of manic activity and depression.

Lyttle again told immigration agents he had been born in Rowan County. This time the file shows that they checked for his birth certificate there. They didn't find it because Lyttle is adopted. In cases of adoption, birth certificates are stored in Raleigh, said Shirley Stiller, the deputy register of deeds in Rowan County.

Lyttle was deported a second time, within hours. With no documents to prove legal residency in any country, he soon found himself on an international odyssey.

Mexican authorities sent him to Honduras, where he was imprisoned before being sent to Guatemala.

In late April, he found the U.S. Embassy in Guatemala City. Within a day, officials there contacted Lyttle's brother at the military base where Lyttle told them he was serving, got copies of his adoption papers and issued him a U.S. passport.

Three days after his arrival in Guatemala City, his brother had wired him money and Lyttle was on a flight to Atlanta.

U.S. Immigration officials worked Lyttle's case for 31/2 months and held him in immigration detention for more than six weeks.

“This is not rocket science,” said Jacqueline Stevens, a professor at the University of California at Santa Barbara who brought Lyttle's case to light on her blog and is now writing a book about it. “It took someone in Guatemala one day to prove he was a citizen.”

Lyttle, 32, has spent much of his adulthood bouncing among mental institutions, halfway houses and prisons. He has been convicted of more than a dozen crimes, including assault and sexual battery.

He also lost touch with his mother, who had moved during his time in prison, and did not have phone numbers for his two brothers, who are in the military. His father is deceased.

When he entered prison, his country of birth was listed as Mexico. Prison officials say Lyttle made that claim, but in an interview with The N&O, Lyttle said he never invented such a story. Regardless, he was flagged for a federal immigration check.

In September and November 2008, he met with immigration agents three times, each time signing a different sworn statement.

Lyttle says he claimed to be Mexican at the first interview because he thought it was pointless to argue with the agent, who was convinced that he was an illegal immigrant. His birth father was Puerto Rican, and Lyttle says he is often mistaken for Mexican.

He says he figured he would take a free trip to Mexico.

287(g) Is Being Replaced By ICE's "Secure Communities" Program...287(g) In High Heels??

If you recall I published two posts last week entitled "Ruthless Gangs are taking over North Carolina" and "Forbes Ranks Charlotte 14Th Most Dangerous U.S. City".

Those stories explain how Gang activity often related to the Illegal Immigrant population (not always but frequently enough), has negatively impacted American communities.

Previously the only Federal resource available to assist local Law Enforcement agencies with Illegal Immigration regulation was the controversial 287(g) program.

287(g) established in 1996, is a component of the Federal ICE (United States Immigration and Customs Enforcement) department. ICE falls under the umbrella of Homeland Security currently managed by Janet Napolitano.

The mission of ICE is to protect National Security by enforcing our nation's Customs and Immigration laws.

287(g)'s initial purpose 287(g) was to equip and authorize state and local law enforcement agencies with the legal tools necessary to perform similar duties of Federal Immigration Law Enforcement. In other words assist the "Immigration Feds" with doing their jobs.

Well now due to abuse of the program's mission, 287(g) has come under fire from the ACLU and many Latino/ Hispanic organizations who claim that 287(g) was in fact being used by Racist Sheriff and Police Departments nationwide to deport Latinos/Hispanics who only committed Minor Offenses.

The ACLU and Latino/Hispanic organizations had good reason to be concerned. Why?

The Bush Administration while pre-occupied with the "War on Terror", failed to properly regulate the Dept of Homeland Security. That failure then created a myriad of other problems, which resulted in more complaints of abuse.

Several years ago there was a best-selling Children's book authored by Laura Joffe Numeroff. It was titled "If You Give a Mouse a Cookie". The moral of that story was if you give a mouse a cookie, he's going to eat it, which can then set off a snowball effect for other related problems. What else can you expect from a mouse right?

This same concept can also be applied to a bunch of Hick, Trigger Happy Law Enforcement officials just itching to practice Racial Profiling in the name of "Illegal Immigration Enforcement".

Of course you had Hispanics and Latinos being deported for Minor Criminal Offenses or DWL (Driving while Latino)!

For example: Getting a Speeding Ticket. What did you think those kind of Officers and Deputies were going to do?

This situation is no different than how the Black Community has been treated for decades in this country.

Whenever the Feds authorize State and Local Law Enforcement agencies without proper regulation to practice Enforcement, you will always have a few nuts (Police Officers, Sheriffs, Deputies, etc.,) with the propensity to demonstrate how much they hate Blacks or Hispanics, to show their true colors.

On the other hand, when investigating such claims one still has to do their homework.

While its true there were some Latino/Hispanic residents arrested in the U.S. and deported due to having only committed Minor Criminal Offenses, upon completion of an International Criminal background check conducted by ICE personnel, it was later discovered that many of them were also wanted by Law Enforcement officials in their native countries for having committed more serious crimes. For example: Murder, Manslaughter, Human and Drug Trafficking, Robbery, etc.,

In defense of the U.S. Deportation Policies, if those same people were in the United States LEGALLY or in possession of VISAs, they would not have been deported right?

So you have to consider both sides of the scale when listening to such claims.

Nevertheless, obviously the Federal Government received enough negative reports about 287(g) because now another program is being rolled out called "Secure Communities".

(Sidebar: Imagine that! The Black Community has been speaking out about Racial Profiling for years but neither the Federal Government nor state/local Law Enforcement agencies have ever listened to us.)

Secure Communities is supposed to be provide more comprehensive Illegal Immigration with a broader range of Federal Regulation, to ensure that state and local enforcement agencies are not abusing the purpose of the program's mission while identifying the most Violent Illegal Immigrant criminals.

However the Latino/Hispanic community isn't buying it. They basically see Secure Communities as a dressed up version of 287(g) wearing high heels.

The Latino/Hispanic population is fearful that Secure Communities will just give state and local Law Enforcement officers more motive to target their ethnic group.

To that I say welcome to the club hombre!

By the same token this extra Illegal Immigration Regulation should encourage those residents living here unlawfully to step up and begin the process of becoming LEGAL citizens.

People living here ILLEGALLY can't expect to have their cake and eat it too!

If your tired of being Tasered often for NO apparent reason other than just because of your physical appearance, STOP complaining and go down to your nearest Immigration office to find out how to begin the U.S. Citizenship process. (You can also call them @1-800-375-5283)

And....STOP committing Violent Crimes or participating in Gang activity!

In the mean time AFTER you've taken that FIRST step, if you strongly believe the Cops or Sheriff Deputies in your region are using you as their latest poster child for Racial Profiling seminars, THEN and only then do you contact the ACLU regarding filing a Violation of Human Rights Lawsuit.

As it relates to the "Secure Communities" program, I won't judge a book by its cover unless the content inside doesn't match up with the title and proves itself to be a fraud.
