Amid the hot debate over gun laws, the WBAL-TV 11 News I-Team reveals the steep challenge of reducing the supply of guns often used in crimes.

The problem: laws vary state to state.

It wasn't known at the time, but it turns out that a .40-caliber Glock handgun recovered during a traffic stop by Maryland State Police in Anne Arundel County in 2015 was part of a much larger conspiracy to funnel guns from one state to another.

"The firearm came back to a person who purchased it in the state of Georgia," Maryland State Police Sgt. Frank Lopez said.

Lopez runs the state police gun center, which traces guns and performs background checks on people arrested in possession of guns.

The Glock recovered in Anne Arundel County was actually one of 25 guns legally purchased by a man in Georgia, who then sold them to a man in Maryland. The buyer was Jaleel Wulu, an aspiring rapper known as Trill Castro.
The two men were convicted on federal charges of gun trafficking after some of the guns were recovered from other people during criminal investigations.

"This gentleman purchased many firearms, and they were turning up, the majority of them, in Prince George's County," Lopez said.

An unusual pattern? Not at all.

More often than not, guns seized by police in criminal investigations are coming from someplace other than Maryland.
"I would say approximately 60 percent statewide of firearms that are seized by Maryland law enforcement are not Maryland guns, that goes up exponentially in places like Baltimore City and Prince George's County," Lopez said.

Maryland has some of the toughest gun laws in the country. Buyers are required to wait seven days after purchase to actually take possession of a handgun.

There is no instant background check, and buyers are limited to one purchase per month.
Laws are far more lax in states to the south and west.

In West Virginia, Virginia, North Carolina, South Carolina and Georgia, background checks are instant, and there is no waiting period and no limit on how many guns you can purchase at once.

The disparity between gun laws state by state complicates the effort to reduce gun violence, currently an urgent priority in Baltimore.

There is no shortage of supply.

Shantay Guy, who runs the Community Mediation organization in Baltimore, said it is not hard to get a gun in Baltimore.

"It's not difficult at all," Guy said. "Not only are those that are involved in intentionally violent activities have quick access to guns, but even those kids that are fearful that if they are not protecting themselves, they could be another victim, but it's easy for them to get guns too."

Earlier this week, the Baltimore City Council opened debate on increasing the penalty for illegal gun possession in Baltimore.

Guy's organization, which files surveillance video of shootings, is taking on a much harder question: How do you head off people from using a gun to resolve conflict and dispute?

"There are a fair amount of folks in our city who have low levels, quite honestly, of emotional intelligence.

I would offer that I am still working on mine," Guy said. "The more folks that we could get involved in this work to help heal rifts and relationships that have been damaged in Baltimore City, the better likelihood we are going to have in significantly reducing the violence in Baltimore City."

To date, just over 1,000 illegal guns have been seized in Baltimore, and more than 520 people have been wounded or killed in gun violence.

The police chief in Aurora, Colo., said he is confident that massacre gunman James Holmes acted alone.

The police chief was dead wrong.

Standing at Holmes’ side as he unleashed an AR-15 assault rifle and a shotgun and a handgun was Wayne LaPierre, political enforcer of the National Rifle Association.

Standing at Holmes’ side as he sprayed bullets and buckshot into a crowded movie theater were Barack Obama and Mitt Romney, a President and a would-be President, who have bowed to the NRA’s dictates and who responded to the slaughter Friday with revolting, useless treacle.

Standing at Holmes’ side as he murdered 12 and wounded 59 were the millions of zealots who would sooner see blood flow and lives end than have to check a box on a gun registration form.

In a vain claim of innocence, the fanatics will say Holmes is a monster and a maniac, that he fired and fired and fired as a man possessed. Each protestation clamps their fingers with his around the trigger.

Because they made sure that virtually everyone, Holmes included, has unfettered legal access to heavy weaponry. And they made sure he was permitted by law to drive to the kill scene with a fully loaded arsenal.

Such is the conscienceless extremism of America’s gun lovers that they accept wholesale slaughter as akin to a fatal highway pileup. Accidents happen, in their grotesque view, and so do mass killings by firearms.

Yes, they do. Massacres come and they go and nothing meaningful changes except that the body count goes up.

The big attacks leap to mind.

There was Columbine — amazingly, just down the road from Aurora — where two severely disaffected high school students gunned down 13.

There was Virginia Tech, where a student who had been diagnosed with a severe anxiety disorder murdered 32 and wounded 17 on two rampages.

Lower death tolls — two, three, four, five — in offices, parks and restaurants slip from memory as awful but routine, cause for momentary pain and nothing more.

The day-to-day mayhem of street-crime shootings, responsible for more deaths than all the mass carnage combined, makes it to the police blotter, the courts, the newspapers, the emergency rooms and the cemeteries.

Every Aurora-like spasm provokes the question: How did the killer get his guns?

Overwhelmingly, the answer is that he acquired them legally from a licensed dealer under the permissive laws of the local jurisdiction and the deliberately porous oversight of the federal government.

In Aurora, the authorities say someone lawfully bought the weapons used by Holmes and that he carried them lawfully until the moment he pulled a trigger. Even the purchase of the AR-15, a rapid-fire, military-style semi-automatic fit for nothing but combat, was by the books.

Once, federal law would have kept Holmes’ hands off a superdeadly weapon like the AR-15. In 1994, under President Bill Clinton, Congress outlawed the manufacture and possession of assault weapons, but the statute had a 10-year expiration date.

IN 2004, it went off the books to cheers from the NRA, led by LaPierre, who keeps Washington in line and who went to ground Friday, declining comment “until all the facts are known.” As if they aren’t already.

Obama postures as supporting a new assault weapons ban but has done exactly nothing to restore the prohibition. Nor has he moved to close the loophole that allows for gun purchases without background checks at weapons shows.

His statement about the Aurora massacre was a dodge. Obama said in part: “If there’s anything to take away from this tragedy, it’s the reminder that life is very fragile, our time here is limited and it is precious, and what matters at the end of the day is not the small things, it’s not the trivial things which so often consume us and our daily lives.”

With all due respect, the presidential takeaway should have been a drive for strengthened gun control, if only for the assault weapons ban. In righteous anger, Obama should have confronted the NRA’s political might regardless of polls that show a strong sentiment against restoring the prohibition.

So, too, Romney, who was no less saccharine than Obama in discussing Aurora and is no less craven on gun control. As governor of Massachusetts, he signed a state assault weapons ban and defended tough anti-gun statutes. Then, as a presidential candidate, he joined the NRA and has since professed fealty to the group’s positions.

Through their inaction and their silence, Obama and Romney have fallen into line with all those who enabled Holmes to take hold of that AR-15 and will enable others to do so in the future unless America’s political leaders develop the courage to fight to save lives.

"And instead of the two people -- President Obama and Gov. Romney -- talking ... about they want to make the world a better place, okay, tell us how."

Bloomberg's call to action on his WOR show with John Gambling came hours after a lone gunman turned a Colorado cinema showing "The Dark Knight Rises" into a shooting gallery.





New York Police Department increases security at movie theaters after 'Dark Knight Rises' shooting in Aurora, Colo.

The NYPD stationed officers at city theaters showing “The Dark Knight Rises” on Thursday as some Batman fans admitted the shooting at a Colorado cinema had left them unnerved.

“It was in the back of my head,” said Jim Thalman, 38, an actor who saw the film at the Regal Cinema in Union Square just hours after a gunman killed 12 people at a midnight screening of the movie outside of Denver.

“When a guy came in with a bag, I thought if he puts a mask on, I was going to crack him.” But his pal, Scott Nawrocki, 42, said he wasn’t worried about a replay of the ambush in Aurora.

“I’m so New York,” the Brooklynite said. “I’m jaded.” Two uniformed officers stood in the lobby of the Manhattan movie house. A total of 40 theaters around the five boroughs will getting extra police protection, Police Commissioner Raymond Kelly said.

“We're concerned that someone, perhaps seeking notoriety, will attempt to do something similar,” Kelly said adding that the security boost was meant “to address the potential of a copycat event and to reassure moviegoers, particularly parents.

“We know a lot of young people are going to see this movie,” he said. “These are judgments that we have to make. We think it’s appropriate at this time.”

Kelly said most of the theaters would have at least two cops and a vehicle posted in front. At the AMC Empire 25 theater on W. 42nd St., Heidi Harding, 32, said she was “not scared” as she waited on line to purchase tickets for an evening showing.

“You don't have any control over these types of situations,” said the Bronx assistant teacher. “You just have to live your life.

This is just one crazy individual."

12 Killed in Shooting at Colorado Theater

A gunman dressed head to foot in body armor and brandishing three weapons, including an assault rifle, opened fire in a theater crowded with families and children at a midnight showing of the Batman movie “The Dark Knight Rises” in a Denver suburb early Friday morning, killing at least 12 people and wounding 59 others, police and federal officials said.

The suspect, James Holmes, 24, told the police after his arrest that he had booby-trapped his Aurora apartment with explosive devices, leading the police to evacuate five buildings in the neighborhood as they sought to disable what they described as “incendiary devices” rigged to trip wires.

Mr. Holmes’s only criminal history was a traffic summons, said Aurora’s police chief, Dan Oates. Mr. Holmes earned a bachelor’s degree with honors in neuroscience in 2010 from the University of California, Riverside.

During the attack, witnesses said Mr. Holmes had entered through a side door of the packed theater and first set off at least two smoke devices before firing randomly at audience members, who had just settled into their seats. Within minutes, he was arrested in a parking lot behind the theater near his car, the police said.

Mr. Holmes had apparently planned the attack for some time: He wore a gas mask, body armor, a tactical helmet and was dressed completely in black. He entered the theater with an AR-15 assault rifle, a Remington 12-guage shotgun and a 40-caliber Glock handgun. A fourth gun, another Glock pistol, was found in his car. The authorities believe that Mr. Holmes acted alone, and that the death toll may increase because some of the injuries were serious.

The police and witnesses described a scene of utter chaos inside the darkened, smoke-filled theater as bullets resounded loudly around them, and people who had gone to see a PG-13-rated action movie were suddenly forced to scramble to safety as friends and loved ones were felled around them.

Chief Oates said he did not know how many shots Mr. Holmes had fired, saying only that it was “many, many rounds.”

Jordan Crofter, 19, said he had felt lucky to have snagged a seat in the front row at the midnight screening. But about five minutes into the movie, he said, a side door swung open and a man in black wearing a gas mask calmly strode through.

At first, Mr. Crofter thought perhaps the man was part of the movie. But within a few seconds, he said, the man hurled two gas canisters down the theater aisle.

“He walked in so casually, like he knew what he was doing,” said Mr. Crofter. “I heard two pops. Everyone was distracted. That was when the panic and the chaos started.”

Mr. Crofter said that once he noticed that the man was also carrying a rifle, he ran in the opposite direction as fast as he could.

“He started shooting, and everyone ducked and started screaming,” he said. “He looked like he was ready to go into battle, It was like he was walking around and having fun. Emotionless.”

With the investigation in its earliest stages, the authorities said they were unsure what prompted the attack, or whether Mr. Holmes had ties to any hate groups.

“No motivation yet,” one senior law enforcement official said, adding, “The kid’s not talking.”Mr. Holmes however, did tell the police that he had explosives at an Aurora residence, which led F.B.I. agents, along with agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives and the local police to cordon off a north Aurora neighborhood, focusing attention on a third-floor apartment in a red brick building.

Firefighters perched on a cherry picker were seen breaking the window with an ax.

The police described the apartment as being full of wires.

“It’s something I’ve never seen before,” said Chief Oates.

John Priest, who lives in the neighborhood, said that his 21-year-old son had been in the movie theater with two friends during the shooting, but was unharmed. The two friends, however, had been wounded — one was hit by a bullet in the buttocks and grazed in the leg, and the other was shot in the leg. Neither injury is life threatening, he said.

“How could people do something like this?” he said. “I don’t understand this.”

Aurora, which has a population of about 325,000, had only six killings in all of 2011, according to F.B.I. crime data.

At Gateway High School, where the authorities have directed people to gather to get news about friends and family members, Rosemary Ratcliff said she had so far been unable to find her son, Abdullah, 17, who she believes had been at the midnight screening.

“I haven’t heard from him, and none of his friends are picking up their phones,” she said in a near-whisper as she left the school.

The authorities have not released the names of victims, but Pentagon officials said that some members of the military were among the casualties. The officials said they did not yet have an accurate count, or know what branches of the service the victims were from, or whether they were dead or injured.

The injured were sent to six hospitals in the region, including Children’s Hospital Colorado and the University of Colorado Hospital.

“The entire emergency department staff was called in,” said Dr. Comilla Sasson, who said that even though the emergency room was full before the shooting happened, it admitted 20 victims who ranged in age from 3 months to 45 years. The victims’ injuries included gunshot wounds and shrapnel injuries, Dr. Sasson said. Nine people were in critical condition.

At least three other people were in critical condition at other hospitals, officials said.

The shooting erupted at the Century 16 Theater during the first showings of “The Dark Knight Rises.” Throngs had gathered, some dressed as characters from the highly anticipated Batman sequel.

The police and witnesses said after the gunman entered the theater through an exit door that there was the smell of either pepper spray or tear gas in the theater as gunshots rang out.

Chief Oates said the device made “a hissing sound” before starting to emit smoke.

President Obama, in southern Florida as part of a campaign swing, was notified of the shooting by his top counterterrorism adviser, John O. Brennan, at 5:26 a.m., the White House said. He later released a statement saying that he and his wife, Michelle, were “shocked and saddened by the horrific and tragic shooting in Colorado,” and vowed to bring those responsible to justice.

Mr. Obama was briefed Friday morning by Mr. Brennan, Robert S. Mueller III, the F.B.I. director, and Jacob Lew, the White House chief of staff. “We do not believe at this point there was an apparent nexus to terrorism,” Jay Carney, the White House press secretary, told reporters on Air Force One.

Mr. Obama returned to Washington on Friday afternoon, cutting short his Florida trip, his campaign said.

In remarks in Fort Myers, Fla., Mr. Obama talked in highly personal ways about the tragedy. “My daughters go to the movies,” he said. “What if Malia and Sasha had been in the theater as so many of our kids do every day? Michelle and I will be fortunate enough to hug our girls a little tighter tonight.”

He reflected on the fragility of life and the triviality of so much of what passes for daily existence, calling on the country to remember what really matters. “The people we lost in Aurora loved and were loved,” he said. “They were mothers and fathers, they were husbands and wives, sisters and brothers, sons and daughters, friends and neighbors. They had hopes for the future and they had dreams that were not yet fulfilled.”

He asked for a moment of silence and asked the crowd to “spend a little time thinking about the incredible blessings that God has given us.”

Both Mr. Obama and Mitt Romney, the presumed Republican presidential nominee, said they planned to pull television campaign advertisements in Colorado.

The movie studio Warner Bros., which is owned by Time Warner, released a statement Friday morning, saying that the company and the filmmakers were “deeply saddened” and “extend our sincere sympathies to the families and loved ones of the victims at this tragic time.”

Mayor Michael R. Bloomberg of New York, who has waged a national campaign for stricter gun laws, called on President Obama and Mr. Romney to more concretely address the issue of gun violence in their campaigns.

“You know, soothing words are nice,” Mr. Bloomberg said during his weekly radio program, “but maybe it’s time that the two people who want to be president of the United States stand up and tell us what they are going to do about it, because this is obviously a problem across the country.”

On Friday morning, television images showed several ambulances moving about and dozens of police officers gathered at the Century 16 complex in the early morning darkness. A police robot could be seen inspecting a white compact sedan, its two doors and trunk wide open, in the parking lot of the movie complex, television images showed, though it was unclear whether the car belonged to the gunman.

Cellphone video appeared to show the traumatic scene outside of the large multiplex immediately after the shooting. Some people wandered away with bloodstained shirts as others could be heard screaming, “Get out of here!”




We’ve Seen This Movie Before

JAMES HOLMES, who opened fire before the midnight premiere of “The Dark Knight Rises,” could not have seen the movie. Like many whose misery is reflected in violence, he may simply have been drawn to a highly publicized event with a big crowd. In cynical terms, he was seeking a publicity tie-in. He was like one of those goofballs waving in the background when a TV reporter does a stand-up at a big story.

James Holmes must also have been insane, and his inner terror expressed itself, as it often does these days, in a link between pop culture and firearms. There was nothing bigger happening in his world right now than the new Batman movie, and in preparation for this day, or another like it, he was purchasing firearms and booby-trapping his apartment. When he was arrested after the shootings, he made no attempt at resistance. His mission was accomplished.

I’m not sure there is an easy link between movies and gun violence. I think the link is between the violence and the publicity. Those like James Holmes, who feel the need to arm themselves, may also feel a deep, inchoate insecurity and a need for validation. Whenever a tragedy like this takes place, it is assigned catchphrases and theme music, and the same fragmentary TV footage of the shooter is cycled again and again. Somewhere in the night, among those watching, will be another angry, aggrieved loner who is uncoiling toward action. The cinematic prototype is Travis Bickle of “Taxi Driver.” I don’t know if James Holmes cared deeply about Batman. I suspect he cared deeply about seeing himself on the news.

Should this young man — whose nature was apparently so obvious to his mother that, when a ABC News reporter called, she said “You have the right person” — have been able to buy guns, ammunition and explosives? The gun lobby will say yes. And the endless gun control debate will begin again, and the lobbyists of the National Rifle Association will go to work, and the op-ed thinkers will have their usual thoughts, and the right wing will issue alarms, and nothing will change. And there will be another mass murder.

That James Holmes is insane, few may doubt. Our gun laws are also insane, but many refuse to make the connection. The United States is one of few developed nations that accepts the notion of firearms in public hands. In theory, the citizenry needs to defend itself. Not a single person at the Aurora, Colo., theater shot back, but the theory will still be defended.

I was sitting in a Chicago bar one night with my friend McHugh when a guy from down the street came in and let us see that he was packing heat.

“Why do you need to carry a gun?” McHugh asked him.

“I live in a dangerous neighborhood.”

“It would be safer if you moved.”

This would be an excellent time for our political parties to join together in calling for restrictions on the sale and possession of deadly weapons. That is unlikely, because the issue has become so closely linked to paranoid fantasies about a federal takeover of personal liberties that many politicians feel they cannot afford to advocate gun control.

Immediately after a shooting last month in the food court of the Eaton Centre mall in Toronto, a young woman named Jessica Ghawi posted a blog entry. Three minutes before a gunman opened fire, she had been seated at the exact place he fired from.

“I was shown how fragile life was,” she wrote. “I saw the terror on bystanders’ faces. I saw the victims of a senseless crime. I saw lives change. I was reminded that we don’t know when or where our time on Earth will end. When or where we will breathe our last breath.”

This same woman was one of the fatalities at the midnight screening in Aurora.

The circle of madness is closing.

Zimmerman released after posting bail


George Zimmerman was released from jail on Friday, one day after a Florida judge set bail at $1 million.

Judge Kenneth R. Lester Jr. found that Zimmerman's deceit over cash holdings at his first bond hearing in April was not enough to hold him without bail.

However, he also said he believed the suspect may have been planning to flee the country to avoid prosecution in the killing of Florida teen Trayvon Martin.

Zimmerman had to post 10% of the $1 million -- or $100,000 -- to meet the requirement for release.

He wore a white dress shirt under a gray suit as he walked out of jail and into a waiting SUV.

"We are confident and comfortable that George will be safe," Zimmerman's attorney, Don West, told CNN outside the jail following his client's release.

"We were hoping the bail would be considerably less than what it was. And we will take the judge's comments to heart, but we don't necessarily agree with them and we will decide what is next," he said.

An initial bond of $150,000 was revoked last month after Lester learned that Zimmerman and his wife, Shellie, had failed to disclose more than $150,000 in donations from the public.

The judge's order Thursday said that the new $1 million bail order was not a punishment but an amount that assured the court that Zimmerman would not abscond.

In his ruling, Lester wrote about the first bond hearing and noted an undisclosed second passport kept in Zimmerman's safe deposit box.

"Notably, together with the passport, the money only had to be hidden for a short time for him to leave the country if the defendant made a quick decision to flee," the judge said. "It is entirely reasonable for this court to find that,

but for the requirement that he be placed on electronic monitoring, the defendant and his wife would have fled the United States with at least $130,000 of other people's money."

Lester wrote the defendant's plans to flee were "thwarted."

Since news of the judge's decision broke, roughly $20,000 was donated to Zimmerman's defense, according to a website set up to raise funds.

Zimmerman, 28, is charged with second-degree murder in Martin's February 26 shooting death. Under Florida law, second-degree murder is a bondable offense.

Speaking to reporters in New Orleans before Zimmerman left jail, Martin's parents said they are struggling, but have faith all will end well.

"As we said from the beginning, we have strong faith in God," said Tracy Martin, Trayvon's father. "And we'll continue to lean on God and ask Him to give us the strength and continue to give us the faith in the justice system, and justice will prevail."

Lester imposed new restrictions on Zimmerman that he did not face when he was out on bond the first time.

Zimmerman must report to officials every two days, cannot open or maintain a bank account and cannot be on the property of an airport. He also cannot apply for or obtain a passport.

He must abide by a curfew from 6 p.m. to 6 a.m., and like before, will be monitored electronically.

Zimmerman, a Sanford neighborhood watch volunteer, acknowledged fatally shooting the unarmed Martin after calling police to report a suspicious person. Zimmerman said Martin attacked him.

Darrell Issa And Eric Holder Meeting Over Operation Fast And Furious


A Republican House committee chairman said Tuesday he is prepared to follow through on a contempt vote against Attorney General Eric Holder unless the Justice Department provides Congress with documents on a flawed gun-smuggling probe.

The likelihood of a contempt vote on Wednesday rose after Rep. Darrell Issa, R-Calif., and Holder failed to reach agreement in a 20-minute meeting at the Capitol.

"If we receive no documents, we'll go forward," Issa told reporters.

Holder told reporters he would not turn over documents on the gun-smuggling probe called Operation Fast and Furious unless Issa agreed to another meeting.

The attorney general said he would explain what is in the materials at that time. Holder wants an assurance from Issa that the transfer of the records would satisfy a subpoena from the House Oversight and Government Reform Committee that Issa chairs.

"We have offered to make materials available, documents available ... to brief on those documents, to answer any questions that might come up with regard to the documents that we produced," the attorney general said.

"The ball's in their court," Holder said. "We made what we thought was an extraordinary offer."

Issa took a different view: "After this meeting I cannot say that I am optimistic" for avoiding a contempt vote, he said.

Issa spokesman Frederick Hill said that at the meeting, "The attorney general indicated he would only be willing to produce a subset of documents that numbered fewer than 1,300 pages if the committee would first agree that the production of these documents would end the committee's investigation of the Justice Department."

Issa declined the offer.

Holder said he is prepared to turn over material detailing how the department arrived at the conclusion that federal agents engaged in a risky tactic called gun-walking. It resulted in hundreds of weapons purchased at gun shops in Arizona ending up in Mexico, many of them at crime scenes. Initially, the department denied that gun-walking had taken place.

"It's a whole variety of material, and it's consistent with what we have already made available – emails, documents of that nature – that really go into the way in which the department handled itself from February of 2011 until December of 2011," Holder said.

The material "pretty clearly demonstrates that there was no intention to mislead, to deceive," Holder said.

Relying on the gun-walking tactic, federal agents from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives abandoned their usual practice of intercepting all weapons they believed to be illicitly purchased. Instead, the goal of gun-walking was to track such weapons to high-level arms traffickers, who had long eluded prosecution, and to dismantle their networks.

Gun-walking has long been barred by Justice Department policy, but federal agents in Arizona experimented with it in at least two investigations during the George W. Bush administration before Fast and Furious.

These experiments came as the department was under widespread criticism that the old policy of arresting every suspected low-level straw purchaser was still allowing tens of thousands of guns to reach Mexico. A straw purchaser is an illicit buyer of guns for others.

The agents in Arizona lost track of many of the weapons in Operation Fast and Furious. Two of the guns that "walked" in the operation were found at the scene of the slaying of U.S. border agent Brian Terry.

Issa's committee has been investigating Fast and Furious for the past year and a half. Holder says the Justice Department has already turned over 7,600 pages of documents.

Issa said he was willing to postpone Wednesday's contempt vote if the attorney general first provided the documents the panel still seeks.

In addition to Holder and Issa, the participants in the meeting were Deputy Attorney General James Cole; Senate Judiciary Committee chairman Patrick Leahy, D-Vt.; Sen. Chuck Grassley, R-Iowa, the ranking Republican on the Senate Judiciary Committee, and Rep. Elijah Cummings of Maryland, the ranking Democrat on Issa's committee.

Zimmerman Back in Police Custody

Six weeks after being released from jail on bond, George Zimmerman, who is facing second-degree murder charges in the death of Trayvon Martin, is back in police custody.

Mr. Zimmerman turned himself in to the authorities in Sanford, Fla., early Sunday afternoon, according to a blog post from his lawyer, Mark O'Mara. Judge Kenneth R. Lester Jr. had revoked his bond two days earlier and gave him 48 hours to surrender to the authorities.

In revoking the bond, Judge Lester found that Mr. Zimmerman had misled the court about his finances, with the help of his wife, during his April bond hearing.

At the time, Mr. Zimmerman had access to as much as $135,000 from a PayPal account that collected donations through a legal defense Web site. But Mr. Zimmerman’s wife testified that she was unaware of how much money had been collected through the site. Because it was believed that Mr. Zimmerman had no money, he was released on a low bond of $150,000.

As evidence, prosecutors presented transcripts at Friday’s hearing of telephone conversations between Mr. Zimmerman, who was in jail, and his wife. They said the two were discussing in code what to do with the money.

Mr. O’Mara said that he was unaware of the money at the time of the first hearing and that he planned to ask for another bond hearing so that Mr. Zimmerman could explain himself to the judge.

“Judge Lester runs a very tight courtroom, as well he should,” Mr. O’Mara said after the ruling. “He didn’t believe they were being as straightforward and honest as he wanted them to.”

The death of Mr. Martin, 17, on Feb. 26 created a national controversy after the police declined to arrest Mr. Zimmerman for over a month, raising questions about racial profiling and Florida’s self-defense law.

Mr. Zimmerman said that the unarmed teenager attacked him and that he was in such fear for his life that he was forced to shoot Mr. Martin. Mr. Zimmerman had a license to carry a concealed weapon.

While witnesses heard shouts and saw figures fighting outside their windows, the rain and darkness made it difficult to see clearly. As a result, Mr. Zimmerman’s account of what happened that evening as Mr. Martin walked through a gated community in Sanford back to the home of his father’s girlfriend is critical to Mr. Zimmerman’s self-defense case.

Judge Lester’s reversal on the bond will allow prosecutors to cast doubt on Mr. Zimmerman’s story, experts said.

“The fact George Zimmerman was dishonest is very important because his credibility is the most important thing in this entire case,” Benjamin Crump, the Martin family lawyer, said after Friday’s court session.

Mr. O’Mara said that Mr. Zimmerman’s safety was still a concern. He has been in hiding since shortly after the shooting. While he was in jail awaiting his April bond hearing, he was kept in solitary confinement to protect him from other prisoners.

“We are very concerned about safety still, and we will maintain that concern,” Mr. O’Mara said after learning his client would be forced to return to jail. “There are ongoing threats and concerns and complaints. I don’t know where along the spectrum they become true threats. We have begun to process and analyze a number of the statements he has given to the police.”






George Zimmerman back in Fla. jail

George Zimmerman' has returned to a Florida jail, after a judge revoked bond for the man accused in the shooting death of Trayvon Martin.

Zimmerman wore a white plaid shirt and jeans when he arrived at the jail in a white unmarked minivan with a police official. He did not answer questions from reporters.

On Sunday afternoon, about 40 minutes before the 2:30 p.m. deadline to surrender, Zimmerman was listed as an inmate on the jail website. He was marked as being held without bail and having $500 in his jail account.

Zimmerman's lawyer said he hopes his client's voluntary return to Florida to turn himself in will show that he's not a flight risk.

A judge revoked Zimmerman's bond last week, suggesting he and his wife had not been honest about their finances. The neighborhood watch volunteer is charged with second-degree murder in the fatal shooting of unarmed 17-year-old Trayvon Martin.

Zimmerman's lawyers say their client returned to the state to meet this afternoon's deadline. They say they will ask for a new bond hearing.

During a bond hearing in April, Zimmerman and his wife indicated they had limited funds. But prosecutors say Zimmerman had raised thousands through a website he had set up for his legal defense.

His lawyers said in a press release that the money Zimmerman has raised is in an independent trust and cannot be directly accessed by Zimmerman or his attorneys.

Zimmerman credibility may be hurt by bond dispute

Zimmerman has pleaded not guilty to the second-degree murder charge. He maintains he shot Martin in self-defense under Florida's so-called "stand your ground" law because the teen, who was unarmed, was beating him up after confronting Zimmerman about following him in a gated community outside Orlando.

Zimmerman's credibility could become an issue at trial, legal experts said, noting the case hinges on jurors believing Zimmerman's account of what happened the night in February that Martin was killed.

Zimmerman wasn't charged in the case until more than a month after the shooting. Protests were held across the nation, and the case spurred debate about whether race was a factor in Zimmerman's actions and in the initial police handling of the case. Martin was black; Zimmerman's father is white and his mother is from Peru.

Police in Sanford did not immediately arrest Zimmerman, citing the Florida law that gives wide latitude to use deadly force rather than retreat in a fight if people believe they are in danger of being killed or seriously injured.

The questioning of Zimmerman's truthfulness by the judge on Friday could undermine the defendant's credibility if it is brought up at trial. It also may complicate how his defense presents him as a witness, said Orlando-area attorney Randy McClean, a former prosecutor.

"The other key witness, unfortunately, is deceased," McClean said. "Basically, Zimmerman is going to be asking the jury to believe his version of the facts. ... As the case stands now, his credibility is absolutely critical to the case."

Jail authorities in central Florida, where the case arose, said Zimmerman had not turned himself in there by early Sunday. He must do so by Sunday afternoon.

Zimmerman went into hiding in the weeks after the shooting and his exact whereabouts since he bonded out of jail remain unclear. It was not immediately clear exactly where Zimmerman would surrender.

Witness accounts of the rainy night that Martin was shot are spotty. There is no video of the fight, though photos released by prosecutors show Zimmerman with wounds to his face and the back of his head.

Zimmerman's credibility would be important if his attorney, Mark O'Mara, tries to get a judge without the jury to dismiss the charges based on the law, said Orlando defense attorney David Hill.

"If he was in on something that was not truthfully revealed to the judge, when there is a `stand your ground' hearing, of course you're going to second-guess him," Hill said.

Both McClean and Hill said O'Mara would be able to challenge the admissibility of the bond revocation at trial by questioning its relevance.

Zimmerman was arrested 44 days after the killing, and during a bond hearing in April, his wife, Shellie, testified that the couple had limited funds available. Zimmerman took the stand at the hearing and apologized to Martin's parents.

Prosecutors pointed out in their motion that Zimmerman had $135,000 available then. It had been raised from donations through a website he had set up. They suggested more has been collected since and deposited in a bank account.

Shellie Zimmerman was asked about the website at the hearing, but she said she didn't know how much money had been raised. Circuit Judge Kenneth Lester set bail at $150,000. The 28-year-old was freed a few days later after posting $15,000 in cash — which is typical.

Prosecutor Bernie De la Rionda complained Friday, "This court was led to believe they didn't have a single penny. It was misleading and I don't know what words to use other than it was a blatant lie." The judge agreed and ordered Zimmerman returned to jail by Sunday afternoon.

The defense countered that Zimmerman and his wife never used the money for anything, which indicated "there was no deceit."

The judge said he would schedule a hearing after Zimmerman is back in custody so he could explain himself.

Benjamin Crump, an attorney for Trayvon Martin's parents, Tracy Martin and Sybrina Fulton, said his clients have always said Zimmerman should remain in jail until trial.
