On Wednesday, students nationwide left class to honor the 17 teenagers who died in the Parkland shooting, and to protest lax gun control laws in the United States.

But on #NationalWalkoutDay, 16-year-old Justin Blackman realized that he was the only student at Wilson Preparatory Academy in Wilson, North Carolina to participate in the protest.

"It's National Walkout Day, I'm the only one from my school out here," he said in a video he tweeted. “I’m just going to be chilling here for the next 15 minutes.”

According to CNN, about 700 students attend Wilson Preparatory Academy. Blackman was the only student to leave class. He spent 17 minutes outside, one for every person who died at Stoneman Douglas High School last month, and then walked back to his Spanish class.

The school declined to comment on the issue, but told CNN Blackman is an "independent thinker."

He didn't think that anyone would care. “There’s going to be like six people watching this hopefully," he said in the video.

Instead, Blackman received an outpouring of support from people around the country.

Lindsay Knauf, who's from Newtown, Connecticut, where the Sandy Hook school shooting occurred in 2012, thanked Blackman for standing up.

"Seeing the action that is finally taking place means the world to all of us here," she tweeted at him.

Filmmaker and A Wrinkle In Time director Ava DuVernay retweeted Blackman's video with a Martin Luther King Jr. quote: "The ultimate measure of a man is not where he stands in moments of comfort and convenience, but where he stands at times of challenge and controversy."

Alexis Tracton, a freshman at Stoneman Douglas, thanked Blackman. "I'm inspired by you for being a leader," she tweeted at him, "Every little thing makes a difference."

Since it was posted, Blackman's video was viewed more than 2.6 million times at the time of writing, and has received more than 11,000 comments.

Blackman isn't the only student to walk out alone at school; second grader Leonardo Aguilar joined the high schoolers in San Jose because he was reportedly the only one to leave his classroom.

And school officials in Sayreville, New Jersey threatened Rosa Rodriguez with suspension for leaving class, but she did it anyway.

This may be the start of Blackman's career in leadership. The high schooler runs a YouTube channel for gaming, but he's thinking about starting one dedicated to politics.

"I'm young and I HAVE A VOICE!!!!" he tweeted.

I have been following the tragic case of Jahi McMath, who went to Oakland Children’s Hospital for a tonsillectomy and suffered a catastrophic complication, resulting in cardiac arrest. According to the media, her doctors later declared her “brain dead” and told the parents she would be removed from life support. After a lawyer’s letter, Jahi’s life support continues.

“Brain dead” is a popular term, not a medical one–and it is too loosely used. Some use it to denigrate the moral value of profoundly disabled patients such as Terri Schiavo, who we now know may be aware and able to recognize family. Slinging “brain dead” as an epithet justifies dehydrating them to death or castigating family members, like the Schindlers, who fight to keep such patients alive–which they legally and biologically are.

In Jahi’s case, brain dead actually means a declaration of “death by neurological criteria,” one of the two legal methods for declaring the bona fide death of a human being.

To be declared dead by neurological criteria does not mean there are no brain cells remaining alive.

Rather, it means that medical tests, observation of the patient post injury, and history of the case demonstrate that the patient’s brain and each of its constituent parts have irreversibly ceased to function as a brain. As one doctor told me, it is as if the patient was functionally decapitated.

Death by neurological criteria is controversial. Some pro lifers see it as an excuse to harvest organs from living patients, and oppose its use as a clinical method of determining death.

Many bioethicists–of the type who once assured a wary public that brain dead was truly dead–agree, but because they want access to the organs of patients with clearly working brains, such as a patient diagnosed as unconscious but who can breathe without medical assistance. In other words, they want to allow killing for organs and they believe that undermining the public’s belief in “brain death” can help them achieve that end.

Under the law, brain dead is “dead” when it connotes death by neurological criteria. In such circumstances, if accurately determined, there is no legal right to continue life support of what is, essentially, a cadaver. This isn’t true–yet–of patients thought to be permanently unconscious. But that may be coming, my pretties. That may be coming.

A huge problem in this field is that there are no uniform criteria for declaring death by neurological criteria, with testing requirements varying from state to state, and in some instances, hospital to hospital.

That needs to change.

"Judge Extends Life Support For Jahi McMath Until Jan. 7"

The family of the 13-year-old Oakland, Calif. girl who was declared brain-dead after a tonsillectomy was desperately trying to move her to a New York facility until a judge extended her life support at the Children's Hospital in Oakland Monday.

A judge extended life support for a brain-dead 13-year-old girl in Oakland until 5 p.m. on Jan. 7.

Jahi McMath suffered complications from a routine tonsillectomy at the Children's Hospital of Oakland on Dec. 9 to treat sleep apnea. She bled heavily and went into cardiac arrest.

Alameda County Superior Court Judge Evelio Grillo ruled to extend her time on a ventilator shortly before 5 p.m. Monday Pacific time, when she was scheduled to be taken off life support.

The family wants the life support to continue in case there is a possibility for recovery.

The girl's mother, Nailah Winkfield, said she cried and hugged her relatives outside the hospital when she heard the ruling.

"Who wants to know the date and the time their child would die?" she said, according to the Associated Press.

Up until that point, McMath's family was frantically trying to transfer the girl to a New York hospital.

The family's attorney Chris Dolan said he was waiting to hear from the New York facility, which he did not identify because he did not want media attention to influence its decision.

Dolan said other facilities in California have declined to take McMath and the New York hospital is the "last, last hope."

"The family is together, and today everybody is praying and being together," Dolan said Sunday.

The Children's Hospital in Oakland sent a letter to the family Sunday stating they have yet to hear from a New York hospital about taking Jahi.

The Oakland facility said it would need to discuss transportation and other legal issues before it can release the patient.

"We need to be able to talk to the other facility to understand what it is they are capable of doing," Cynthia Chiarappa, a spokeswoman for Children's Hospital, said. "This is not transferring an individual in a vegetative state, but a dead body."

Her family has set up a gofundme account to accept donations to move Jahi.

With an hour to spare, a judge ordered a stay on the restraining order against the hospital that was scheduled to take the 13-year-old girl rendered brain-dead by elective surgeries in California off life support Monday evening.

Jahi McMath is allowed to remain on life support until Jan. 7, a California judge ruled.

Jahi underwent a tonsillectomy and other operations to alleviate her sleep apnea on Dec. 9. She started bleeding profusely and went into cardiac arrest shortly after.

The young girl’s family has been in a legal battle with Children’s Hospital in Oakland since Doctors at the hospital declared her brain-dead three days later.

The family gained a restraining order preventing doctors from removing Jahi from a ventilator keeping her alive, but Superior Court Judge Evelio Grillo revoked the order Tuesday after hearing testimony from an independent physician who also ruled Jahi met “all criteria for brain death," according to NBC Bay Area.

Grillo said Children’s Hospital would have allowance to remove Jahi from life support at 8 p.m. local time Monday (5 p.m. ET) unless the family filed a formal appeal.

The family filed an appeal just before 4 p.m. (7 p.m. ET) on Monday, according to NBC Bay Area.

"We are hopeful that one of these actions will forestall the hospitals rush to extinguish Jahi's chance at life," said Jahi's uncle, Omari Sealey.

Jahi’s parents have insisted that their daughter is alive, regardless of doctors’ opinions that Jahi’s condition is irreversible.

"I would probably need my child's heart to stop to show me that she was dead. Her heart was still beating, so there's still life there," Jahi's mother, Nailah Winfield said Friday, according to the Associated Press.



In efforts to keep Children’s Hospital from removing Jahi from the machine that was supporting her basic life functions, her family tried to move her to other facilities in California, but doctors at both facilities refused to treat someone who had been declared dead.

An unnamed hospital in New York agreed to take the teenager, but only after she underwent more medical procedures, according to the Associated Press.

David Durand, chief of pediatrics at Children's Hospital said administrators did “not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice.”

On Friday Winfield wrote on a fundraising page, “My family and I are still striving to find a location that will accept her in her current condition … Let us pray that some one (sic) will have the heart to accept her despite what Children's Hospital says. So that we can get her air lifted away from this place as soon as possible.” On Monday, donors had contributed over $25,000 to Jahi’s cause.

NBC Bay area reported that Sealey said that a hospital in New York had agreed to admit Jahi and on Monday, the family was organizing for an air ambulance to transfer the teen across the country.

While many people get their New Year's countdown clocks ready, Jahi McMath's family is scrambling as a darker deadline looms.

A judge's ruling will allow a hospital to disconnect life support machines at 5 p.m. Monday from the 13-year-old girl, whom doctors declared brain dead after she suffered complications from tonsil surgery earlier this month. Jahi's family, who wants to transfer her somewhere else, told CNN affiliate KGO that they spent Sunday working the phones, trying to line up another option.

The case has drawn national attention and sparked protests from some local leaders who say the hospital that treated her should have provided better care.

Medical ethicists, meanwhile, say the high-profile case fuels a misperception: that "brain death" is somehow not as final as cardiac death, even though, by definition, it is. The case is "giving the impression that dead people can come back to life," Arthur Caplan, director of the Division of Medical Ethics at NYU Langone Medical Center, told CNN last week.

But Jahi's family members maintain that they're hoping for a miracle and want to transfer the girl from Children's Hospital Oakland to another facility. A statement released by family members Saturday and provided to KGO says they are weighing several options.

"Our attorney is in discussions with two facilities that have expressed preliminary approval for accepting Jahi on a ventilator," the statement said. "One is in Southern California, the other is in New York."

Doug Straus, an attorney representing Children's Hospital Oakland, said in a letter to the family's lawyer Sunday that officials are still awaiting specifics from the family.

"To date, there has been no communication from any facility named by you regarding a transfer or requirements for transfer with any of the medical professionals at Children's. The family has not identified any facility with which Children's can have this dialogue.

Nor have we been provided with a transportation plan or coroner authorization," he wrote. "As your email and your statements about the facility in the Los Angeles area acknowledge, discussion about performing medical procedures upon a dead body presents unusual and complicated questions. Until there is a definite commitment by a facility to accept Jahi's body upon specified terms, I don't think I can tackle those issues. Please let me know if the family is able to identify a facility."

Jahi was declared brain dead by doctors at the hospital on December 12, three days after tonsil surgery.

Family members and hospital officials fought over her future in court. Last week, a judge ruled she was brain dead and urged both sides to work together to resolves the situation.

But the sparring showed no sign of slowing over the weekend, with family members sharply criticizing the hospital's handling of the matter.

"We wish to acknowledge that Jahi's case, and our stance regarding her right to life, and her mother's right to make decisions regarding her child, has stirred a vibrant, sometimes polarizing, national debate. This was never our intention," the family's statement said. "We have our strong religious convictions and set of beliefs and we believe that, in this country, a parent has the right to make decisions concerning the existence of their child: not a doctor who looks only at lines on a paper, or reads the cold black and white words on a law that says 'brain dead' and definitely not a doctor who runs the facility that caused the brain death in the first place."

The hospital's statement Sunday said they were supporting Jahi's family.

"We continue to do so despite their lawyer's criticizing the very hospital that all along has been working hard to be accommodating to this grieving family," the hospital said.

"FAMILY MUST ARRANGE JAHI TRANSFER"

The hospital at the center of a battle over a brain-dead Oakland teen on Friday sent a letter to the girl's family, saying they can move the 13-year-old to another facility, if her relatives will arrange it.

Chris Dolan, the attorney for Jahi McMath’s family, said Friday afternoon Children’s Hospital Oakland has expressed to him that doctors will allow an outside physician to come to the hospital to perform the procedures necessary to safely transport Jahi to a long-term care facility.

Dolan said the family has been in talks with a facility in Southern California, where Jahi could be moved.

Jahi's uncle, Omari Sealey, also said the family is in talks with additional nursing homes -- another in Los Angeles and one in New York -- that may be willing to take her.

A San Francisco Bay Area nursing home that had agreed to provide long-term care for Jahi backed out after the Children's Hospital refused to insert the breathing and feeding tubes necessary for her long-term care.

The Alameda County Coroner's Office on Friday told NBC Bay Area that it will not block the transfer of Jahi to another facility.

Earlier in the day, the hospital said doctors planned to take Jahi off life support on Monday, barring a court order, according to Sam Singer, president of a San Francisco public relations firm hired by the hospital. Jahi's family is due in court Monday and has already said they will ask the judge for more time.

Children's Hospital Oakland Chief of Pediatrics Dr. David Durand indicated that until he knows which facility Jahi is going to, and whether it will accept a brain dead person, then the hospital can't do much to help.

The letter asks the family to give the name of the facility willing to take Jahi. It also says the family must identify a transportation plan, including the name of the company that will move the girl.

"Children's is willing to cooperate in this regard even though Judge (Evelio) Grillo has confirmed that Jahi is deceased and that statutory patient transfer procedures do not apply here," the letter says.

On Thursday, Children's Hospital doctors said they would not perform a tracheotomy or other surgeries, including one to give her a gastric tube for nutrition, on the 8th grader, who was declared legally dead by a judge just before Christmas.

"Children's Hospital Oakland does not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice," Durand stated earlier.

Friday's letter addressed to the family's attorney, Dolan, brings up this unique legal and medical matter.

"At a minimum, the Alameda County Coroner needs to consent to any proposed transfer since we are dealing with the body of a person who has been declared legally dead," the letter states.

Jahi went in for a tonsillectomy and two other tissue-removal procedures on Dec. 9 in an attempt to cure her sleep apnea. She suffered unknown complications about 30 minutes after the surgery, when she started coughing up blood and suffered a heart attack.

Jahi was first declared brain dead on Dec. 12, and her extended family and Dolan have been fighting in court and the media to keep her alive since then.

Before Children's Hospital sent the letter on Friday, Sealey told reporters that his family was "willing to fight" in court to move her to an unnamed long-term care facility in the Bay Area.

Sealey did not want to say where but added on Friday that there were "several" options open to the family. He also said Jahi's mother, Latasha "Nailah" Winkfield, had been "considering" moving her daughter even without the surgeries.

Jahi's family members are devout Christians who believe the girl is still alive because brain death is not true death and that if her heart is beating, even with the aid of a ventilator, there is still room for a miracle.

Winkfield has launched a fundraising effort to help pay to fly Jahi to a facility out of state. Details can be found on the "Keep Jahi McMath on Life Support" Facebook page.

The goal is to raise $20,000, and as of 8:00 p.m. Saturday, the family has raised over $5,000.

On the site, Winkfield wrote, “I am raising money for my daughter Jahi Mcmath so that she can be airlifted to a hospital out of state. Her insurance does not cover it and Children’s Hospital is going to remove her off life support if I can’t get her out of this hospital. “

Jahi's family reached out to Dr. Paul Byrne, a retired neonatologist in Ohio and the former president of the Catholic Medical Association, for help in this matter and formally asked him to speak on their behalf in court.

Byrne has not formally been called in to testify.

But in an exclusive on-air interview with NBC Bay Area on Friday, Byrne said he last talked to Dolan on Thursday and last talked to a family member "several days ago."

ARTICLE: "Family Seeks To Move Brain-Dead Girl"


A judge has concluded that Jahi, who suffered complications after tonsil surgery, is brain dead.

"Yesterday we spent Christmas together as a family -- doing a lot of prayers and trying to have some fun, hoping for a miracle, and looks like we may have gotten our miracle.

We found out that someone is willing to take Jahi away from Children's Hospital to a facility nearby here in the Bay Area to treat her," Jahi's uncle, Omari Sealey, told reporters Thursday.

"So right now, we're asking Children's Hospital to work with us to make that possible," he said, referring to Children's Hospital & Research Center Oakland.

Sealey declined to identify the other facility.

Jahi was declared brain dead by doctors at the hospital on December 12, three days after tonsil surgery.

The case has drawn National attention and sparked protests from some local leaders who say the hospital should have provided better care.

On Monday, a judge appointed Dr. Paul Fisher, chief of pediatric neurology at Stanford Children's Hospital, to evaluate Jahi as an independent expert.

Fisher testified Tuesday that Jahi meets the criteria for brain death.

Alameda Superior Court Judge Evelio Grillo previously ruled that the hospital must hold off on any decisions regarding discontinuing life support until December 30, and the judge encouraged both sides to work together.

Family attorney Christopher Dolan told reporters Thursday that Jahi would need to have tracheostomy and gastrostomy tubes put in before she could be moved.

"The most logical people are the ones in the hospital where she's sitting who have the ability to do that.

If they refuse to do that, and insist upon moving towards this deadline of pulling the plug, then we'll just continue to do what we've been doing," he said.

Chief of Pediatrics David Durand responded in a statement for Children's Hospital.

"Judge Grillo was very clear on Tuesday December 24. He ruled Jahi McMath to be deceased and instructed the hospital to maintain the status quo. Judge Grillo did not authorize or order any surgical procedures or transfer to another facility.

"Children's Hospital Oakland does not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice.

Children's Hospital Oakland continues to extend its wishes for peace and closure to Jahi McMath's family," he said.
