Was JAHI MCMATH being used by OAKLAND CHILDREN'S HOSPITAL as a Human "Guinea Pig" to test a new SLEEP APNEA Device for the Gov't without Parental Consent???

This new Device must be Surgically-Implanted near the Heart.

It's a well-known fact that Hospitals do receive FEDERAL FUNDS for Medical Research.

So JAHI MCMATH was selected as the perfect "Candidate" aka "Medical Guinea Pig" for this new Surgically-Implanted SLEEP APNEA Device.

However apparently something went terribly WRONG.

Since this is a new Medical Device, it may have been Implanted Incorrectly.

Or......

JAHI MCMATH may have Suffered Adverse Side Effects from the Implanted Device.

Of course my analysis is purely Hypothetical, but as it relates to Medical Research for BIG BUCK$$$, Hospitals have a history of such acts.

Perhaps this explains why OAKLAND CHILDREN'S HOSPITAL Officials were trying to Murder JAHI to hide/ cover-up EVIDENCE.

ARTICLE: "Study Bolsters New Sleep Apnea Device"

A possible alternative for people who can't tolerate the traditional CPAP

A surgical implant to treat obstructive sleep apnea reduced major symptoms of the disorder by nearly 70%, according to a study published online Wednesday in the New England Journal of Medicine.

The new device stimulates a nerve at the base of the tongue, opening the airway. It is one of several new technologies being developed for sleep apnea, a disorder in which people stop breathing during sleep.

Sleep apnea already has a very effective treatment, CPAP, or continuous positive airway pressure.

But studies show that anywhere from 30% to more than one half of patients can't or won't use CPAP as directed by their doctors.

Some patients complain that CPAP machines, which deliver pressurized air through a face mask, are uncomfortable and unwieldy.

Sleep apnea, which is characterized by loud snoring and daytime sleepiness, is linked to a host of serious health problems, including an increased risk of heart disease, diabetes and stroke.

The new implants will "be for a subset of patients, not for all patients," says M. Safwan Badr, president of the American Academy of Sleep Medicine and chief of the division of pulmonary, critical care and sleep medicine at Wayne State University School of Medicine in Detroit, who was involved with the study.

Indeed, earlier studies with the implant showed that it didn't work as well in patients who were very obese or who had certain kinds of soft-palate collapse.

The current study excluded people with certain health conditions, a body mass index of more than 32 and particular types of airway collapse.

In the new study, 126 people with moderate to severe sleep apnea who had tried CPAP but couldn't tolerate it had the new device surgically implanted and were followed for 12 months.

The participants underwent overnight sleep studies before implantation and then again at two, six and 12 months.

After treatment, the number of times they stopped breathing, either completely or partially during sleep, was reduced by 68%, to nine times per hour, down from 29.3 times per hour.

Also, the number of times their blood-oxygen levels fell significantly, the so-called oxygen-saturation index, was reduced by 70% to 7.4 times per hour from 25.4 times per hour.

Two patients had to have a repeat procedure because of pain at the implantation site.

Other side effects included muscle soreness, temporary tongue weakness and tongue abrasions.

The study was funded by the device's manufacturer, Inspire Medical Systems Inc. of Maple Grove, Minn. Inspire's device is approved in Europe; the company is applying for U.S. Food and Drug Administration approval.

"Some patients we encounter, despite our best efforts, we cannot get them comfortable with [CPAP] therapy," said Patrick J. Strollo, professor of medicine and clinical and translational science at the University of Pittsburgh Medical Center and lead author of the study.

The new implantable device "has the promise that we really have another option to treat patients."

About 18 million Americans have sleep apnea, according to the National Sleep Foundation, a nonprofit research and advocacy group.

The new device is placed under the skin of the chest.

One electrical lead extends up the neck and encircles the hypoglossal nerve, which runs beneath the base of the tongue.

The other lead extends to the middle of the chest, where a sensor detects breathing.

The patient turns the device on with a remote control when ready for bed and turns it off upon waking.

During sleep, the device electrically stimulates the hypoglossal nerve with each round of breath.

ARTICLE: "Lawyer: Jahi McMath Improving"

Under the care of "optimistic" doctors, Jahi McMath -- whom a judge and other doctors have declared brain-dead, over her family's objections -- is "improving" days after her release from an Oakland, California, hospital, her family's lawyer said.

Attorney Chris Dolan detailed some of what's happened to the 13-year-old girl since her release Sunday from Children's Hospital & Research Center Oakland.

Specifically, he said that after initially "doing poorly she is stabilizing," having had tracheotomy and gastrostomy tube procedures.

"She is doing very well and getting the treatment she should have gotten 28 days ago," Dolan said, referring to what happened to Jahi after a December operation.

"Doctors are optimistic that her condition has stabilized and that her health is improving from when she was taken from (the Oakland hospital)."

The family hasn't said where the eighth-grader currently is.

Dolan has declined to say if she had been transferred to another facility and, if so, to describe that facility.

Instead, they have chosen to lay low as they continue their efforts to care for Jahi.

Dolan said the family needs to "heal up from this whole experience" and have "some quiet time" away from media questions.

"The Family is seeking to focus attention on Jahi," added the lawyer.

CNN could not independently verify Dolan's account about what's happened to the young California teen.

Still, his account's upbeat nature adds yet another level of intrigue to what's been an emotional and complicated story.

Jahi underwent a December 9 operation at the Northern California hospital to remove her tonsils, adenoids and extra sinus tissue.

ARTICLE: "Hawaii Girl, 3, Dies After Dental Procedure"


Finley Boyle, a 3-year-old Hawaii girl who suffered massive brain damage after undergoing a dental procedure last month, died Friday night, a hospice said Saturday.

The girl died with her family by her side, said Kenneth L. Zeri, president and chief professional officer of Hospice Hawaii.

"There are few greater privileges in life than to accompany someone on their end-of-life journey, providing comfort and support not only to that person but also to their loved ones," the statement said. "As with all of our patients, we were truly blessed to be able to be there for The Boyle Family and for Finley at the end of her journey."

Finley's parents are suing a Kailua, Hawaii, dentist, alleging negligence and dangerous conduct.

The lawsuit, filed against Lilly Geyer and her practice, Island Dentistry for Children, alleges improper medications with incorrect dosages were administered to the girl on December 3, according to court documents filed this week.

"As a direct and proximate result of the medications administered to (Finley) by defendants, (Finley) suffered cardiac arrest during her dental procedure," the lawsuit says.

It alleges that, as a further result of improper medications, Finley "suffered severe and permanent brain damage."

Neither Geyer nor her attorney, John Nishimoto, responded to CNN's requests for comment.

The Island Dentistry website states it has been permanently closed and directs patients to an e-mail address.

The lawsuit, filed Monday in Hawaii's First Circuit Court, alleges that Geyer had no plan in place to respond to medical emergencies, such as the one Finley suffered.

It seeks unspecified damages.

Finley's mother, Ashley Boyle, said she first took her daughter to the dentist in November, when she was told her daughter needed six fillings and four root canals, she said.

They returned in December to undergo the root canals, Boyle said.

The parents allege that Finley was sedated and left unmonitored for 26 minutes.

Finley was moved from a hospital to the hospice in late December.

Finley's pediatric neurologist, Dr. Gregory Yen, said MRIs showed the girl suffered severe brain damage and that she was in a "persistent vegetative state."

JAHI MCMATH has been released from the OAKLAND, CALIFORNIA Hospital that Butchered this 13-year-old BLACK Child & then left her for DEAD.

Last weekend JAHI was released to her MOTHER via a Court Order & transferred to another Medical Facility where she will receive continued Medical care.

She was removed from the OAKLAND CHILDREN'S HOSPITAL on a Ventilator, but the Hospital REFUSED to Re-insert her FEEDING TUBE.

FYI: According to the Attorney representing JAHI'S Family (CHRIS DOLAN),
she is now receiving NUTRITION & ANTIBIOTICS at her new location.

Praise GOD! May the good LORD Bless CHRIS DOLAN for his dedication & hard work for JAHI'S Family.



However due to DEATH THREATS made against JAHI'S Family, the Medical Facility where JAHI was Transferred will remain Unidentified.

JAHI'S DEATH CERTIFICATE was signed by a CORONER, dated DECEMBER 12, 2013.

JAHI MCMATH is BRAIN DEAD but NOT Physically DEAD after a Routine TONSILLECTOMY Procedure.

Jahi McMath, a 13-year-old girl on a ventilator who was declared brain dead by California doctors after tonsil surgery, was released from a hospital to her mother Sunday night and moved to a facility willing to continue her care.

"We're very relieved that she got safely to where she needed to be, because we were all very afraid given the fragile condition as she wasted away at Children's that she might not make it," Attorney Chris Dolan told reporters Monday.

The move to an undisclosed location ends one chapter of a weekslong struggle between Children's Hospital & Research Center Oakland, which sought to remove Jahi from the ventilator after it and a judge concluded she was brain dead, and her relatives, who fought in court to keep her on life support and contended she showed signs of life.

The hospital released Jahi on Sunday to the Alameda County coroner, who then released her to her mother's custody, said David Durand, the hospital's chief of pediatrics. The hospital had previously said it needed the coroner's consent for the transfer because Jahi was legally dead.

Jahi -- who was declared brain dead December 12 after post-surgery complications that her family says included severe bleeding and cardiac arrest -- was moved from the hospital Sunday accompanied by a critical care team. She was attached to a ventilator, but with no feeding tube in place.

On Monday, Dolan said Jahi was being given antibiotics to fight infections and nutritional support.

"They're giving her everything that a person who would have a chance to live would be getting," he said.

He declined to provide details about the type of facility, citing privacy and security concerns.

"She's where she's going to be for a while," he said. "She needs to be medically stabilized, medically treated."

Although a New York facility has said it's ready to care for Jahi, Dolan told reporters Sunday night that her destination won't be announced.

"We've had people make threats from around the country. It's sad that people act that way," Dolan said. "So for Jahi's safety and those around her, we will not be saying where she went or where she is."

Let parents decide if teen is dead

But New Beginnings Community Center in Medford, New York, said it is an option.

"At this time we're named as the potential facility that Jahi and her family will be coming to, but we will know more details in a couple of hours, and we'll certainly be happy to let you know as we know," said Allyson Scerri, founder of New Beginnings, on Sunday.

On its website, the facility bills itself as an outpatient rehabilitation center for patients with traumatic brain injuries and says it plans to open a long-term care facility. According to her online biography posted on the facility's website, Scerri worked as a hair stylist for 25 years and founded the facility after her father sustained a traumatic brain injury in a motorcycle accident.

"We are aware of Jahi McMath's dire situation, and we are willing to open our outpatient facility to provide 24-hour care as an inpatient, long-term facility for Jahi with the required and appropriate medical staff that she depends upon," Scerri said in a letter included in court documents last week.

The surgery

Jahi's case drew national attention and fueled debate as a fierce court battle unfolded between devastated family members fighting to keep her on a ventilator and doctors arguing she'd already died.

Family members say the eighth-grader was alert and talking after doctors removed her tonsils, adenoids and extra sinus tissue in a surgery at the Oakland hospital on December 9.

Doctors had recommended the surgery to treat pediatric obstructive sleep apnea, a condition which made her stop breathing in her sleep and caused other medical problems.

Before the surgery, Jahi said she was worried that she would never wake up, according to her uncle. She seemed fine after the surgery, but asked for a Popsicle because her throat hurt.

Not long afterward, something went terribly wrong. In an intensive care unit, the girl began bleeding profusely, the family said.

According to family members, Jahi went into cardiac arrest. Days later, she was declared brain dead.

Hospital officials have said privacy laws prevent them from discussing details of the case.

The court battle and the medical debate

The family and the hospital disagreed over whether to disconnect her from a ventilator, and the issue wound up in Alameda Superior Court.

In court documents and public comments, the hospital maintained that there's no doubt that McMath is brain dead, describing the condition as irreversible.

"No amount of prayer, no amount of hope, no amount of any type of medical procedure will bring her back," Children's Hospital Oakland spokesman Sam Singer said last month. "The medical situation here in this case is that Jahi McMath died several weeks ago."

A judge on December 23 appointed Dr. Paul Fisher, chief of pediatric neurology at Stanford Children's Hospital, to evaluate Jahi.

Fisher concluded the next day that she met the criteria for brain death. According to a court filing, Fisher found that the girl's pupils were fully dilated and unresponsive to light and that she did not respond to a variety of intense stimuli.

His report also says Jahi showed no sign of breathing on her own when a ventilator was removed: "Patient failed apnea test." The report says her heart was beating only because of the mechanical ventilator.

In addition, an imaging test showed no blood flow to Jahi's brain, while another showed no sign of electrical activity.

Fisher's conclusion: "Overall, unfortunate circumstances in 13-year-old with known, irreversible brain injury and now complete absence of cerebral function and complete absence of brainstem function, child meets all criteria for brain death, by professional societies and state of California."

After seeing Fisher's report, Alameda Superior Court Judge Evelio Grillo concluded on December 24 that Jahi was brain dead. But Grillo twice ruled that the hospital had to hold off on disconnecting Jahi from life support, ultimately giving the family and the facility until January 7 to come to a resolution.

The Alameda County coroner issued a death certificate for Jahi on Friday, listing December 12 as the date of death. The certificate still needed to be accepted by the health department to become official.

Medical ethicists, meanwhile, say the high-profile case fuels a misperception: that "brain death" is somehow not as final as cardiac death, even though, by definition, it is. The case is "giving the impression that dead people can come back to life," Arthur Caplan, director of the Division of Medical Ethics at NYU Langone Medical Center, told CNN last month.

Family members say they've seen reason for hope

Jahi's family members maintain that they're hoping for a miracle and want her care to continue elsewhere.

Her mother told CNN last month that she'd seen improvements, including indications from a hospital monitor that she said suggest her daughter was trying to breathe on her own.

The girl's uncle, Omari Sealey, told reporters last week that Jahi moves when her mother speaks and touches her. Sealey also said that a pediatrician has seen Jahi and has sworn she is not dead.

Hawaii girl, 3, dies after dental procedure

When asked about the girl's possible movement, Singer, the hospital spokesman, said he would not comment directly on any claims the family makes, citing privacy laws. However, Singer said it is "quite common" for the muscles of brain dead patients to move, stressing it's "not a sign of life."

So far the family has raised more than $50,000 on GoFundMe.com to move her. According to the site, more than 1,300 people have donated money in 10 days.

"We're very grateful, very proud," said Sealey, Jahi's uncle. "We want to thank everyone that supported us, everyone that stood in our corner, everyone that prayed for us, everyone that helped donate to make this possible. Without you guys, none of this would be possible."

Scerri of New Beginnings told CNN on Sunday that the girl just needs to be given a chance to recover.

"Her brain needs time to heal. It's a new injury," Scerri said. "We believe in life after injury. All of us here at New Beginnings have firsthand experience because we have a loved one that was in the same situation as Jahi."

Dolan said moving Jahi to a new care facility is critical to her recovery.

"We're very pleased to announce that Jahi McMath has been taken from Children's Hospital and brought to a place where they will use her name instead of calling her a body, and where she can get to the starting line instead of where Children's has left her the past four weeks almost, at the finish line."

In releasing Jahi, the hospital said: "Our hearts go out to the family as they grieve for this sad situation and we wish them closure and peace."

ARTICLE: "Fighting For Jahi McMath’s Life: “Brain Dead” Term Too Loosely Used"

I have been following the tragic case of Jahi McMath, who went to Oakland Children’s Hospital for a tonsillectomy and suffered a catastrophic complication, resulting in cardiac arrest. According to the media, her doctors later declared her “brain dead” and told the parents she would be removed from life support. After a lawyer’s letter, Jahi’s life support continues.

“Brain dead” is a popular term, not a medical one–and it is too loosely used. Some use it to denigrate the moral value of profoundly disabled patients such as Terri Schiavo, who we now know may be aware and able to recognize family. Slinging “brain dead” as an epithet justifies dehydrating them to death or castigating family members, like the Schindlers, who fight to keep such patients alive–which they legally and biologically are.

In Jahi’s case, brain dead actually means a declaration of “death by neurological criteria,” one of the two legal methods for declaring the bona fide death of a human being.

To be declared dead by neurological criteria does not mean there are no brain cells remaining alive.

Rather, it means that medical tests, observation of the patient post injury, and history of the case demonstrate that the patient’s brain and each of its constituent parts have irreversibly ceased to function as a brain. As one doctor told me, it is as if the patient was functionally decapitated.

Death by neurological criteria is controversial. Some pro lifers see it as an excuse to harvest organs from living patients, and oppose its use as a clinical method of determining death.

Many bioethicists–of the type who once assured a wary public that brain dead was truly dead–agree, but because they want access to the organs of patients with clearly working brains, such as a patient diagnosed as unconscious but who can breathe without medical assistance. In other words, they want to allow killing for organs and they believe that undermining the public’s belief in “brain death” can help them achieve that end.

Under the law, brain dead is “dead” when it connotes death by neurological criteria. In such circumstances, if accurately determined, there is no legal right to continue life support of what is, essentially, a cadaver. This isn’t true–yet–of patients thought to be permanently unconscious. But that may be coming, my pretties. That may be coming.

A huge problem in this field is that there are no uniform criteria for declaring death by neurological criteria, with testing requirements varying from state to state, and in some instances, hospital to hospital.

That needs to change.

"Terri Schiavo's Family Joins Family Of Teen Jahi McMath In Fight Over Life Support"


The family of Terri Schiavo has joined the battle over Jahi McMath, a 13-year-old girl on life support who has been declared dead by doctors.

"Together with our team of experts, Terri's Network believes Jahi's case is representative of a very deep problem within the U.S. healthcare system -- particularly those issues surrounding the deaths of patients within the confines of hospital corporations, which have a vested financial interest in discontinuing life," the Terri Schiavo Life & Hope Network said in a prepared statement.

The organization said it has been overseeing the efforts of several groups to help get Jahi transferred out of Children's Hospital Oakland and brought "to a safe place."

Jahi's family said Tuesday it had found a facility in New York willing to take her. The Oakland hospital "refused to agree to allow us to proceed in that matter," Jahi's uncle Omari Sealey said.

The hospital denied the accusation.

"We have done everything to assist the family of Jahi McMath in their quest to take the deceased body of their daughter to another medical facility," hospital spokesman Sam Singer said.

"To date, they have been unwilling or unable to provide a physician to perform the procedures necessary, transportation, or a facility that would accept a dead person on a ventilator. Our hearts and thoughts go out to them in this tragic situation, but the statements being made by their attorney and some family members are misleading and untrue."

Family attorney Christopher Dolan had accused the hospital of being "hell bent" on ending Jahi's life.

A judge has declared Jahi brain dead as well. Doctors say there's no chance she will come back to life.

Omari Sealey, Jahi's uncle, said Wednesday that the family still hopes to move her to another facility.

He accused the hospital of starving his niece by not using a feeding tube to provide her with nutrients.

Singer said a judge Tuesday had dismissed the family's request for additional medical procedures, including a feeding tube.

A deadline loomed Monday as a judge had said the hospital could disconnect the machines after 5 p.m. (8 p.m. ET). But shortly before Jahi could have been cut off, that same judge extended his order to 5 p.m. (8 p.m. ET) on January 7.

Terri Schiavo died in 2005, nearly two weeks after doctors removed the feeding tube that had sustained her for more than a decade. She was severely brain damaged and became a national focal point in the right-to-die battle.

Her husband and guardian, Michael Schiavo, said she wouldn't have wanted to live in her condition, which Florida courts deemed a "persistent vegetative state." Her parents fought to have her kept alive.

Schiavo's parents, brother and sister created the Life & Hope Network.

The statement Wednesday about Jahi included a quote from Bobby Schindler, Terri Schiavo's brother and executive director of the organization.

"Families and individuals must make themselves aware of what so-called 'brain death' is and what it is not," he said.

"Every person needs to understand that medical accidents happen every day. Families and individuals must be more aware of the issue of accountability and patient rights."

Last month, Jahi had surgery to remove her tonsils, adenoids and extra sinus tissue. Doctors had recommended the surgery to treat pediatric obstructive sleep apnea, a condition that made her stop breathing in her sleep and caused other medical problems.

Before the surgery, Jahi said she was worried that she would never wake up, according to her uncle. She seemed fine after the surgery and asked for a Popsicle because her throat hurt.

It wasn't long before something went terribly wrong. In the intensive care unit, the girl began bleeding profusely -- an image that her mother told CNN would be forever seared in her mind.

According to family members, Jahi went into cardiac arrest.

Days later, she was declared brain dead.

Hospital officials have said privacy laws prevent them from discussing details of the case.

"Jahi McMath’s Mother Claims Hospital Is Starving Supposedly Brain-Dead Daughter"

The mother of a California girl declared brain-dead claims the hospital is starving her daughter while the family fights to keep her on life support.

"To watch my daughter just sit there and not have food ... I'm just so happy that she is kind of a thick girl so she still looks good," Nailah Winkfield told ABC’s "Good Morning America." "I tell her every day, 'Jahi, you losin' weight girl, but you still look good.' I just think it's inhumane to not feed my child, to not refer to her by her name, and stop us in our tracks."

Relatives of 13-year-old Jahi McMath are locked in a legal battle with Children’s Hospital Oakland over the girl’s future. The family’s lawyer says the hospital has blocked their attempts to have feeding and breathing tubes inserted— a crucial step in the family’s quest to transfer the Jahi to a long-term facility.

Hospital officials say McMath is dead, and they can’t operate on a corpse.

"Performing medical procedures on the body of a deceased human being is simply not something Children's Hospital can do or ask its staff to assist in doing," hospital attorney Douglas Straus said.

Jahi went into cardiac arrest on Dec. 9 at the hospital following tonsil surgery to treat sleep apnea.

Children’s Hospital doctors declared her brain-dead three days later, but the girl’s family insists she is still alive.

The family has received support from a New York-based neurological foundation that was sending doctors to California to examine the girl.

Dr. Jonathan Fellus, chief medical officer with the International Brain Research Foundation, said Jahi needs time to heal from the cardiac arrest before doctors can make a definitive conclusion.

“Basically we need the dust to settle,” Fellus told the Daily News on Tuesday.

Winkfield claims her daughter moves at the sound of her parents’ voices and she says the hospital has been insensitive.

"I hate it that they refer to her as just the body or the deceased," Winkfield told ABC’s "Good Morning America." “That is my child that they're talking about.

They don't even use her name."

Children’s Hospital was set to unhook Jahi’s ventilator on Monday, but a court order in the final hours extended the deadline to Jan. 7.

The family has been desperately searching for another facility to take Jahi before time runs out.

KWinkfield’s lawyer, Christopher Dolan, said the New Beginnings Community Center in Medford, N.Y., is a possibility, but Children’s Hospital is making it difficult by denying their attempts to bring in doctors to insert breathing and feeding tubes.

"They're speaking out of both sides of their mouths,” Dolan said. “They say one thing and we go down that road, and then they say something else. The hospital said, 'Bring us a doctor,' and we said, 'Tell us the conditions,' and now, they've wasted a half a day of our time. We don't have much time."

A hospital spokesman said the family hasn’t produced any doctors willing to perform the surgeries.

With an hour to spare, a judge ordered a stay on the restraining order against the hospital that was scheduled to take the 13-year-old girl rendered brain-dead by elective surgeries in California off life support Monday evening.

Jahi McMath is allowed to remain on life support until Jan. 7, a California judge ruled.

Jahi underwent a tonsillectomy and other operations to alleviate her sleep apnea on Dec. 9. She started bleeding profusely and went into cardiac arrest shortly after.

The young girl’s family has been in a legal battle with Children’s Hospital in Oakland since Doctors at the hospital declared her brain-dead three days later.

The family gained a restraining order preventing doctors from removing Jahi from a ventilator keeping her alive, but Superior Court Judge Evelio Grillo revoked the order Tuesday after hearing testimony from an independent physician who also ruled Jahi met “all criteria for brain death," according to NBC Bay Area.

Grillo said Children’s Hospital would have allowance to remove Jahi from life support at 8 p.m. local time Monday (5 p.m. ET) unless the family filed a formal appeal.

The family filed an appeal just before 4 p.m. (7 p.m. ET) on Monday, according to NBC Bay Area.

"We are hopeful that one of these actions will forestall the hospitals rush to extinguish Jahi's chance at life," said Jahi's uncle, Omari Sealey.

Jahi’s parents have insisted that their daughter is alive, regardless of doctors’ opinions that Jahi’s condition is irreversible.

"I would probably need my child's heart to stop to show me that she was dead. Her heart was still beating, so there's still life there," Jahi's mother, Nailah Winfield said Friday, according to the Associated Press.



In efforts to keep Children’s Hospital from removing Jahi from the machine that was supporting her basic life functions, her family tried to move her to other facilities in California, but doctors at both facilities refused to treat someone who had been declared dead.

An unnamed hospital in New York agreed to take the teenager, but only after she underwent more medical procedures, according to the Associated Press.

David Durand, chief of pediatrics at Children's Hospital said administrators did “not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice.”

On Friday Winfield wrote on a fundraising page, “My family and I are still striving to find a location that will accept her in her current condition … Let us pray that some one (sic) will have the heart to accept her despite what Children's Hospital says. So that we can get her air lifted away from this place as soon as possible.” On Monday, donors had contributed over $25,000 to Jahi’s cause.

NBC Bay area reported that Sealey said that a hospital in New York had agreed to admit Jahi and on Monday, the family was organizing for an air ambulance to transfer the teen across the country.

"FAMILY MUST ARRANGE JAHI TRANSFER"

The hospital at the center of a battle over a brain-dead Oakland teen on Friday sent a letter to the girl's family, saying they can move the 13-year-old to another facility, if her relatives will arrange it.

Chris Dolan, the attorney for Jahi McMath’s family, said Friday afternoon Children’s Hospital Oakland has expressed to him that doctors will allow an outside physician to come to the hospital to perform the procedures necessary to safely transport Jahi to a long-term care facility.

Dolan said the family has been in talks with a facility in Southern California, where Jahi could be moved.

Jahi's uncle, Omari Sealey, also said the family is in talks with additional nursing homes -- another in Los Angeles and one in New York -- that may be willing to take her.

A San Francisco Bay Area nursing home that had agreed to provide long-term care for Jahi backed out after the Children's Hospital refused to insert the breathing and feeding tubes necessary for her long-term care.

The Alameda County Coroner's Office on Friday told NBC Bay Area that it will not block the transfer of Jahi to another facility.

Earlier in the day, the hospital said doctors planned to take Jahi off life support on Monday, barring a court order, according to Sam Singer, president of a San Francisco public relations firm hired by the hospital. Jahi's family is due in court Monday and has already said they will ask the judge for more time.

Children's Hospital Oakland Chief of Pediatrics Dr. David Durand indicated that until he knows which facility Jahi is going to, and whether it will accept a brain dead person, then the hospital can't do much to help.

The letter asks the family to give the name of the facility willing to take Jahi. It also says the family must identify a transportation plan, including the name of the company that will move the girl.

"Children's is willing to cooperate in this regard even though Judge (Evelio) Grillo has confirmed that Jahi is deceased and that statutory patient transfer procedures do not apply here," the letter says.

On Thursday, Children's Hospital doctors said they would not perform a tracheotomy or other surgeries, including one to give her a gastric tube for nutrition, on the 8th grader, who was declared legally dead by a judge just before Christmas.

"Children's Hospital Oakland does not believe that performing surgical procedures on the body of a deceased person is an appropriate medical practice," Durand stated earlier.

Friday's letter addressed to the family's attorney, Dolan, brings up this unique legal and medical matter.

"At a minimum, the Alameda County Coroner needs to consent to any proposed transfer since we are dealing with the body of a person who has been declared legally dead," the letter states.

Jahi went in for a tonsillectomy and two other tissue-removal procedures on Dec. 9 in an attempt to cure her sleep apnea. She suffered unknown complications about 30 minutes after the surgery, when she started coughing up blood and suffered a heart attack.

Jahi was first declared brain dead on Dec. 12, and her extended family and Dolan have been fighting in court and the media to keep her alive since then.

Before Children's Hospital sent the letter on Friday, Sealey told reporters that his family was "willing to fight" in court to move her to an unnamed long-term care facility in the Bay Area.

Sealey did not want to say where but added on Friday that there were "several" options open to the family. He also said Jahi's mother, Latasha "Nailah" Winkfield, had been "considering" moving her daughter even without the surgeries.

Jahi's family members are devout Christians who believe the girl is still alive because brain death is not true death and that if her heart is beating, even with the aid of a ventilator, there is still room for a miracle.

Winkfield has launched a fundraising effort to help pay to fly Jahi to a facility out of state. Details can be found on the "Keep Jahi McMath on Life Support" Facebook page.

The goal is to raise $20,000, and as of 8:00 p.m. Saturday, the family has raised over $5,000.

On the site, Winkfield wrote, “I am raising money for my daughter Jahi Mcmath so that she can be airlifted to a hospital out of state. Her insurance does not cover it and Children’s Hospital is going to remove her off life support if I can’t get her out of this hospital. “

Jahi's family reached out to Dr. Paul Byrne, a retired neonatologist in Ohio and the former president of the Catholic Medical Association, for help in this matter and formally asked him to speak on their behalf in court.

Byrne has not formally been called in to testify.

But in an exclusive on-air interview with NBC Bay Area on Friday, Byrne said he last talked to Dolan on Thursday and last talked to a family member "several days ago."
