Colorado theater shooting suspect makes first court appearance


The man accused of opening fire Friday in a packed movie theater in Aurora, Colorado, made his first court appearance Monday, giving the public its first look at the 24-year-old former doctoral candidate since his arrest.

James E. Holmes, his hair dyed various shades of red, looked downward, then straight ahead. He sat without blinking for long periods. At times, his eyes fluttered, then squeezed tight and reopened in a blank stare. Occasionally, his eyebrows arched, giving his face a mournful mien.

But the man who identified himself to police as "The Joker," dressed in a maroon jumpsuit over a white T-shirt, gave little indication that he was paying attention to the courtroom procedure that ensured he will be continue to be held without bond.

He is to be charged next Monday. Those charges are likely to include first-degree murder -- an offense that carries a possible death penalty, if he is convicted -- in the shooting deaths, given allegations over the weekend by police that there is evidence to suggest "calculation and deliberation" in the rampage.

Holmes is being held in connection with the early Friday shootings that left 12 dead and 58 wounded, and the subsequent discovery of his booby-trapped apartment, which authorities believe he rigged before leaving for the Century Aurora 16 multiplex.

Authorities have been tight-lipped about a possible motive in the case, and police spokesman Frank Fania told CNN late Sunday that Holmes has been uncooperative with investigators and requested an attorney.

Arapahoe County public defender James O'Connor has been assigned to the case. The Colorado Judicial Department declined to say whether Holmes requested a public defender. A telephone call by CNN to O'Connor's office was not immediately returned.

Holmes' court appearance will come a few hours before his family is expected to issue a statement.

Lisa Damiani, an attorney representing the family, told CNN the statement would be made at her San Diego office.

The family, which lives in San Diego, issued a statement Friday saying, "Our hearts go out to those who were involved in this tragedy and to the families and friends of those involved." It added, "We are still trying to process this information."

Over the weekend, Aurora Police Chief Daniel Oates told reporters that there was "evidence of, I think, some calculation and deliberation."

Holmes received deliveries over the past four months to his home and work addresses, which begins to explain how he may have obtained some of the materials used in the attack and those found at his apartment, Oates said.

As of late Sunday, at least 17 people remained hospitalized -- eight in critical condition -- in five area hospitals.

President Barack Obama met Sunday in Aurora with survivors and relatives of the dead, and thousands of residents gathered in the city for a prayer vigil that drew state and local officials.

"I confessed to them that words are always inadequate in these kinds of situations, but that my main task was to serve as a representative of the entire country and let them know that we are thinking about them at this moment, and will continue to think about them each and every day," Obama told reporters after the meeting at the University of Colorado Hospital.

"It reminds you that even in the darkest of days, life continues and people are strong and people bounce back and people are resilient," the president said, after describing the recovery of some victims. "Out of this darkness, a brighter day is going to come."

Though much attention has been paid to the "perpetrator of this evil act," that spotlight will fade, leaving behind just the good memories of those affected by the tragedy, he said.

Aurora is bracing for another emotional week as families begin making funeral arrangements. It was not immediately known when the coroner would release the bodies.

It also became clear that more people may have been killed if the gunman's semiautomatic rifle had not jammed.

Josh Nowlan suffered gunshot wounds but said he is happy just to be alive. "If that gun did not jam, I am full certain that I probably would not be here," he said Saturday from his hospital bed.

A law enforcement source, who spoke Sunday with CNN on condition of anonymity, said the rifle jammed because of a problem with the 100-shot magazine feeding it.

The military-style AR-15 had a separately purchased drum magazine, which can have trouble feeding bullets into the firing chamber if the gun is fired rapidly, the source said.

Investigators say the rifle was one of three guns used Friday by the suspect, along with a shotgun and a .40-caliber pistol.







Probe of shooting suspect James Holmes intensifies

A Computer, cellphone, homemade explosives and Batman mask all seized at the Colorado apartment of James Holmes could help shed light on the mind, motive and Modus Operandi of the suspected mass killer, a federal law enforcement official said Sunday.

The official, who asked not to be identified because he is not authorized to comment publicly, said the computer could aid the effort to determine how long the suspect had been allegedly planning the attack and other details of the massacre.

A maze of incendiary devices arrayed inside Holmes' apartment included 10 gallons of gasoline that was likely intended to serve as an accelerant to any fire caused by an explosion inside, the official said.

The devices included about 30 aerial shells commonly used in commercial fireworks displays.

The official said the shells had been cannibalized, reconstructed and set up in the living room, where a stream of wires connected them to a "control box" in the unit's kitchen. The box was disabled Saturday by bomb technicians using robotic devices and a controlled detonating device.

Also Sunday, the University of Colorado said it is helping authorities determine whether Holmes used his position as a graduate student to order materials for the potentially deadly booby traps.

Police said Holmes received deliveries over four months to his Aurora, Colo., apartment and the school. They haven't identified the contents. University spokeswoman Jacque Montgomery said the school is looking into those packages received at the school.

The latest information represents more pieces to a puzzle authorities are constructing to determine what was happening inside the mind of the quiet, intellectually gifted neuroscience student suspected of morphing into a vicious killer.

Aurora Police Chief Dan Oates says Holmes, 24, has "lawyered up" and is not talking.

Was this killer mentally ill?

"It says a lot about the type of prejudice we have when we automatically go to the presumption that a clinical mental illness was the cause," says Praveen Kambam, a professor of psychiatry at the University of California-Los Angeles. "Even the surgeon general of the United States has said there's very little risk of violence or harm from a stranger who has a mental disorder.

"Not all bad behavior comes from mental illness. Sometimes it can simply be bad behavior."

In a résumé posted on Monster.com, Holmes listed himself as an "aspiring scientist" and said he was looking for a job as a laboratory technician.

The résumé, first obtained by The Press-Enterprise in Riverside, paints a picture of a brilliant young man brimming with potential: He worked as a summer intern at the Salk Institute for Biological Studies in La Jolla in 2006 and mapped the neurons of zebra finches and studied the flight muscles of hummingbirds while an undergraduate at the University of California-Riverside.

He also worked as a summer camp counselor to underprivileged children at a Jewish camp in Los Angeles in 2008.

In Rancho Peñasquitos, a community of picturesque hacienda-style homes surrounded by hills and canyons outside San Diego where Holmes grew up, residents have a hard time squaring the quiet teen who didn't call attention to himself with the violent image of Holmes emerging now.

Those who knew Holmes in the upscale San Diego community remember a polite young man who kept to himself and excelled academically.

"He was really talented, really smart," said Porsche Parkman, 19, who attended Westview High School with Holmes' younger sister, Chris. Holmes graduated from the school in 2006. "He was so nice and his family was always there for him. Nothing seemed wrong."

Her description of the young man seen with a ready smile in his high school yearbook photo stands in stark contrast to the 6-foot-tall gunman dressed in head-to-toe black body armor whom police say opened fire with multiple weapons in a crowded suburban Denver movie theater, killing 12 people and wounding 58.

Today, Aurora police portray Holmes as a suspect intent on killing, taking the violence even further by booby-trapping his apartment to kill the first person to enter, most likely a police officer.

"This apartment was designed to kill," Oates said. He said Holmes had a "high volume" of deliveries of materials and ammunition that could explain the aerial shells, trip wires and other explosive devices found in his apartment.

"What we're seeing here is some evidence, I think, of calculation and deliberation," Oates said Saturday. "If you think we are angry, we sure as hell are angry."

In the six months before the shooting, police said Holmes bought at least 6,000 rounds of ammunition, an AR 15 assault rifle, a Remington shotgun and two 40-caliber Glock handguns. He bought them legally, according to a federal law enforcement official who was not authorized to speak publicly.

Oates said Holmes used a rifle, shotgun and one of the handguns during the attack.

At the same time that authorities say he was buying ammunition and weapons, Holmes was in the process of dropping out of the University of Colorado's graduate neuroscience program in Aurora. He had joined the program a year ago, but by June he had withdrawn, the university said in a statement.

Dan Meyers, spokesman for the University of Colorado School of Medicine, would not say why Holmes left.

Oates said the FBI Behavioral Analysis Unit is working with local police to try to determine a motive for the shooting.

Holmes seems to have little online presence. Unlike many people his age, he does not have accounts on Twitter, Facebook or other social media.

University of Colorado biology student Kaitlyn Fonzi, who was living below Holmes in a student-housing complex in northern Aurora, had seen Holmes in the building several times and remembers a student who looked like any other on the medical and academic campus across the street from their apartment building.

"You never really think anything like this is going to happen," Fonzi said after the building was evacuated when police tried to defuse the trip wires they said Holmes set up.

In Rancho Peñasquitos, the suspect's family still lives in the two-story white house with a red-tiled roof where he grew up.

Holmes, who graduated with high honors with a bachelor of science degree in neuroscience from the University of California-Riverside, was raised in a math and science household. His mother, Arlene, has been licensed as a registered nurse for more than 30 years. His father, Robert, is a mathematician who develops statistical models for financial services, specifically looking at fraud.

Theirs is a community where neighbors are friendly and know each other, said one neighbor, Rose To.

"We know the parents as good neighbors," said To, whose home is across the street. "We watch out for each other here."

Lindsay Van Leeuwen, 32, lives three doors away from the Holmes' family. She has lived there four years and said she was probably one of the newest residents in the neighborhood. She doesn't know the family well, she said, but she received a card from them when her twins were born two months ago.

"It's scary. I'm shocked that it's happened right down the street," Van Leeuwen said.

Parkman and her husband, William, 19, remember a friendly family who kept to themselves but were supportive one another.

She became friends with Holmes' sister during their freshman year at Westview, about 3 miles from where the Holmes family lived.

"Her dad was really smart. Their mom was nice, quiet. They let (their children) be who they were," Porsche Parkman said.

William Parkman marveled at how Holmes had gone from a proud example of a successful graduate of their high school to one of the most hated people in the country.

"The news reports you hear about him, it's as if people are talking about one person in San Diego and one in Colorado," he said. "Who he is now is not who he was in San Diego."

On Sunday, ABC News aired a video showing Holmes as a shy, thin teen speaking at a science camp at Miramar College in San Diego when he was 18.

His presentation is on "temporal illusion," which he defines as "an illusion that allows you to change the past."

A woman who introduces Holmes in the video says he wants to become a researcher and make scientific discoveries.

She says his dream is to own a Slurpee machine, eliciting laughter from the audience and a smile from Holmes.

James Holmes: Colorado Shooting Suspect Had Few Digital Fingerprints

Since the tragedy in Colorado, authorities, news organizations, and people around the country have been trying to find out all they could about the suspected shooter, James Holmes.

A logical place to look was online. However, it appeared, at least early on, that Holmes had very few digital footprints.

No Facebook account. No Twitter account. Not even a mention of him in an article or Google search. No physical address listing. So far ABC News has only been able to find his email address at the University of Colorado Denver. TMZ reported it was also able to dig up an old MySpace photo, though it said he apparently had no real MySpace friends.

Holmes may be different from other alleged shooters. The man arrested in the Gabrielle Giffords shooting, Jared Loughner, had a MySpace page and a YouTube account. Anders Breivik, accused of killing 77 people in Norway, published a manifesto online. Holmes, in contrast, appears to be what some call "Web dead."

While it is possible that Holmes simply didn't have much of an online identity, it seems unlikely that he had no online fingerprints at all. Some experts suggest an online identity under a pseudonym may emerge, or that Holmes, as a tech-savvy graduate student, limited himself university communications that were password-protected.

"It could be that he is using a different name online or some variation of his name or another name entirely," Eva Galperin, International Freedom of Expression Coordinator at the Electronic Frontier Foundation, told ABC News. "He could have a significant online presence and we would not know about it."

Other sources, who asked not to be quoted by name, made the same point.

Many sites and social media services, like Facebook and Google Plus, have policies requiring users to go by their real names. However, if the name you use looks real and isn't flagged, you can easily get away without giving away your true identity.

There is also the possibility that Holmes worked hard to erase his identity online, but experts think that's unlikely.

"It is very hard to have no digital footprint right now," Michael Fertik, the CEO and founder of Reputation.com, told ABC News. "What my company stands for is creating the digital footprint you want."

Fertik said it would be very hard for Holmes to have left no online or digital traces over recent years. "It would be very unusual for a 24-year-old to have nothing on the Internet. My guess is that we don't know what name he was using online."

A service like Reputation.com or Removeyourname.com would help clear some of the history, but not all of it, Fertik said.

James Holmes is a common name, which complicates things. In the hours after Holmes was named as the suspect, people flocked to Facebook and Twitter to learn more about Holmes. Another James Holmes living in Littleton, Colorado had his Facebook page flooded with comments.

"I appreciate the fact that you are trying to become better-informed about the occurrences last night in Aurora, but you have been somewhat mislead, in that I am not the man who did it," the other James Holmes wrote on his Facebook wall. "I am not a 24-year-old gun-slinging killer from Aurora, I am a 22-year old book-slinging mass eater from Littleton." He signed the message "Regards, A different guy named James Holmes."

Whether he has a common name or not, James Holmes does have a background. It may just not be one easily found through a computer.

"Generally the way intelligence surfaces is by looking at the person's social networks -- not Facebook or Google Plus -- but looking at their friends or real-life contacts," Eva Galperin said.

Born John Allen Williams on December 31, 1960, in Louisiana, John Allen Muhammad became an infamous figure in American culture as part of a sniper team, with Lee Boyd Malvo, that terrorized the Washington, DC, area for several weeks in October 2002. Making a sniper nest out of the trunk of his car, he and Malvo killed 10 people and injured 3. Muhammad was executed in November 2009.

Mass murderer. Born John Allen Williams on December 31, 1960, in Louisiana. John Allen Muhammad became an infamous figure American culture as part of a sniper team that terrorized the Washington, D.C. area for several weeks in October 2002. He was raised by an aunt in Baton Rouge, Louisiana, after his mother died when he was 4.

After high school, Muhammad got married to Carol Kaglear and joined the Louisiana Army National Guard. They had a son named Lindbergh. At first, his military career seemed promising. He was described as personable and outgoing by one of his commanders, but by the early 1980s cracks were beginning to show in his faade. He got into trouble twice—once for failing to report for duty and another time for hitting an officer.

Muhammad changed his life around in 1985. He separated from his wife, converted to Islam, and joined the U.S. Army. He was stationed in Washington State and later married Mildred Green. The couple had three children. The army seemed to be a good fit for Muhammad, at least for a time. He became a skilled marksman and served in Germany and the Middle East during the Gulf War.

Becoming restless, Muhammad left the military in 1994. He tried to start his own business twice, first with an auto mechanic shop and then a karate school, but both ventures failed. In 1999, his second wife Mildred filed for divorce, and the next year she got a restraining order against Muhammad because the threats he made against her.

Shortly after the order was issued, Muhammad fled with the couple's three children. He took them to Antigua. It believed that this is also where met his future accomplice Lee Boyd Malvo. Muhammad later returned to the United States settling in Bellingham, Washington, with his children. Soon, however, police officers found him and returned the children to their mother's custody. She moved with them to Maryland.

Enraged over the loss of his children, Muhammad began to fixate on Malvo who had moved to Bellingham with his mother, Una James, that October. They together lived in a homeless shelter and developed a disturbing father-son dynamic. Muhammad seemed to control every aspect of Malvo's life, imposing an exercise program and a special diet, one that reportedly consisted of honey and crackers at one point.

Malvo and James were taken into custody by immigration officials in December 2001 for being in the country illegally. But they were released while waiting for a hearing, and Muhammad was soon reunited with Malvo.

He began to teach Malvo how to use a gun, and they used a tree stump

in a friend's yard for target practice.

By the fall of 2002, Muhammad and Malvo had moved on from tree stumps to real-life victims. They were involved in a liquor store shooting in Alabama before beginning their assault on the Washington, D.C. area in October. Muhammad's ex-wife Mildred and his three children lived in nearby Maryland and there were reports that Muhammad stalked the family around the time of sniper attacks.

A skilled mechanic, Muhammad put his talents to evil use,

making a sniper nest out of the trunk of his car. He and Malvo worked as team in the shooting with one man firing the rifle while the other watched the victims. They often targeted people doing simple, everyday tasks, such as pumping their gas or leaving a store. In total, they killed 10 people and injured three others in the D.C. area.

After several killings, Muhammad and Malvo began to taunt the police. They left a note on a tarot card that read: "Mister policeman, I am God" after one shooting. The police were stumped as there seemed to be no motive or pattern to the attacks. Then the snipers demanded $10 million to stop shooting. But the real break in the case came from phone calls to a tip line and to two priests from someone claiming to be the sniper. He pointed them in the direction of an earlier Alabama shooting. At the scene of that crime, Malvo had dropped a brochure, which had one of his fingerprints on it. That fingerprint was matched on file with the immigration records, giving the authorities their first suspect.

On October 24, more than 20 days after the rampage began, the authorities surrounded the vehicle in which Muhammad and Malvo. They were taken into custody and arrested. Since they committed their crimes in several states, the authorities had to decide where the pair should be tried first. Muhammad and Malvo had separate trials.

In his defense, his lawyers pointed to Malvo as the sole triggerman. Still a 2003 jury for the murder of Dean Harold Meyers recommended that he be sentenced to death. And he was convicted on six counts of murder in another trial in Maryland in 2006. Malvo testified against Muhammad during this trial, saying that Muhammad had pulled the trigger on the first six shootings.

Muhammad served his sentence at Sussex I State Prison in Virginia, until his death by lethal injection on November 10, 2009.

D.C.-area sniper executed in Virginia


John Allen Muhammad was executed Tuesday night for the sniper attacks in 2002 that left 10 dead and spread such fear people were afraid to go shopping, cut grass or pump gas.

The three-week killing spree in Virginia, Maryland and Washington, D.C., was carried out with a teenage accomplice who is serving life in prison without parole. Muhammad, 48, died by injection at 9:11 p.m. EST after he exhausted his court appeals and Gov. Tim Kaine denied clemency.

Muhammad's attorneys earlier had asked Kaine to commute his sentence to life in prison because they said he was severely mentally ill.

"I think crimes that are this horrible, you just can't understand them, you can't explain them," said Kaine, a Democrat known for carefully considering death penalty cases. "They completely dwarf your ability to look into the life of a person who would do something like this and understand why."

Muhammad had been sentenced to death for killing Dean Harold Meyers at a gas station in northern Virginia. He and his accomplice, Lee Boyd Malvo, also were suspected of fatal shootings in Alabama, Arizona, Louisiana and Washington state.

Muhammad was offered a choice for his last meal, which he accepted and requested that details not be released to the public, NBC News reported.

Prosecutors chose to put Muhammad and Malvo on trial in Virginia first because of the state's willingness to execute killers. He and Malvo were also convicted of six other murders in Maryland and both were sentenced to six life terms.

Death ruled out for Malvo

The death penalty was later ruled out for Malvo because the U.S. Supreme Court barred the execution of juveniles, who was 17 during the killing spree.

The motive for the shootings in the nation's capital region remains murky. Malvo said Muhammad wanted to use the plot to extort $10 million from the government to set up a camp in Canada where homeless children would be trained as terrorists. But Muhammad's ex-wife has said she believes the attacks were a smoke screen for his plan to kill her and regain custody of their three children.

Muhammad has never testified or explained why he directed the attacks that terrorized the Washington region, with victims gunned down while doing everyday chores. People stayed indoors, and those who had to go outside weaved as they walked or bobbed their heads to make themselves less of a target.

The terror ended Oct. 24, 2002, when police captured Muhammad and Malvo as they slept at a Maryland rest stop in a car they had outfitted so a shooter could hide in the trunk and fire through a hole in the body of the vehicle.

Muhammad had been in and out of the military since he graduated from high school in Louisiana and entered the National Guard. A convert to Islam, John Allen Williams would later change his name to Muhammad.

He joined the Army in 1985 and trained in Washington state as a combat engineer. He did not take special sniper training but earned an expert rating in the M-16 rifle — the military cousin of the .223-caliber Bushmaster rifle used in the sniper shootings.

Life full of failures

However, his life was full of failure. He was twice divorced, and after serving in the first Iraq war, he could never find financial stability.

He opened a karate school but it didn't last; neither did his car repair shop. The man who looked for self-discipline in exercise and Islam found himself living in a homeless shelter in 2001 and a few months later was accused of shoplifting food.

Muhammad met with family members in the hours before his execution but did not have a spiritual adviser, Virginia Department of Corrections spokesman Larry Traylor said. One of Muhammad's attorneys, J. Wyndal Gordon, described the convicted killer as fearless and insisted he was innocent.

"He is absolutely unafraid and he will die with dignity — dignity to the point of defiance," Gordon said.

The families of those killed had prepared for execution day.

Cheryll Witz was one of several victims' relatives who planned to watch the execution. Malvo confessed that, at Muhammad's direction, he shot her father, Jerry Taylor, on a Tucson, Arizona, golf course in March 2002.

"He basically watched my dad breathe his last breath," Witz said. "Why shouldn't I watch his last breath?"

Death penalty opponents had planned vigils across the state, and some were headed for Jarratt, about an hour south of Richmond, for the execution at Greensville Correctional Center.

Beth Panilaitis, executive director of Virginians for Alternatives to the Death Penalty, said those who planned to protest understand the fear that gripped the community, and the nation, during the attacks.

"The greater metro area and the citizens of Virginia have been safe from this crime for seven years," Panilaitis said. "Incarceration has worked and life without the possibility of parole has and will continue to keep the people of Virginia safe."

Vigils planned across the state

Kaine, Virginia's first Roman Catholic governor, has openly expressed his faith-based opposition to capital punishment, but promised as a candidate in 2005 that he would carry out Virginia's death penalty law despite his beliefs.

In September, Kaine delayed the October execution of a former Army intelligence worker from Maryland convicted of killing a northern Virginia couple, saying he needed more time to consider the case. That execution is scheduled for next week.

Gov. Tim Kaine denied clemency Tuesday for sniper John Allen Muhammad, clearing the way for him to be executed for the attacks that terrorized the nation's capital region for three weeks in 2002.

Muhammad is set to die by injection Tuesday night at Greensville Correctional Center in Jarratt. His attorneys had asked Kaine to commute his sentence to life in prison because they say he is mentally ill. The U.S. Supreme Court turned down his final appeal.

"I find no compelling reason to set aside the sentence that was recommended by the jury and then imposed and affirmed by the courts," Kaine, who is known for carefully considering death penalty cases, said in a statement. "Accordingly, I decline to intervene."

Muhammad was sentenced to death for killing Dean Harold Meyers at a Manassas gas station during a three-week spree that left 10 dead across Maryland, Virginia and Washington, D.C.
