****** Supreme Court Deadlocks on Obama Immigration Plan. It Remains Blocked.

The Supreme Court on Thursday announced that it had deadlocked in a case challenging President Obama’s plan to shield millions of immigrants from deportation and allow them to work. 

The 4-4 tie left in place an appeals court ruling blocking the plan, dealing a sharp blow to an ambitious program that Mr. Obama had hoped would become one of his central legacies. 

Instead, even as the court deadlocked, it amplified the already contentious election-year debate over the nation’s immigration policy and presidential power.

The case, United States v. Texas, No. 15-674, concerned a plan to allow as many as five million unauthorized immigrants who are the parents of citizens or of lawful permanent residents to apply for a program that would spare them from deportation and provide them with work permits. 

The program was called Deferred Action for Parents of Americans and Lawful Permanent Residents, or DAPA.

Mr. Obama has said he took action in 2014 after years of frustration with Republicans in Congress who had repeatedly refused to support bipartisan Senate legislation to update immigration laws. 

A coalition of 26 states, led by Texas, promptly challenged the plan, accusing the president of ignoring administrative procedures for changing rules and of abusing the power of his office by circumventing Congress.

In February 2015, Judge Andrew S. Hanen of Federal District Court in Brownsville, Tex., entered a preliminary injunction shutting down the program while the legal case proceeded. 

The government appealed, and a divided three-judge panel of the United States Court of Appeals for the Fifth Circuit in New Orleans affirmed the injunction.

In their Supreme Court briefs, the states acknowledged that the president had wide authority over immigration matters, telling the justices that “the executive does have enforcement discretion to forbear from removing aliens on an individual basis.”

 Their quarrel, they said, was with what they called a blanket grant of “lawful presence” to millions of immigrants, entitling them to various benefits.

In response, Solicitor General Donald B. Verrilli Jr. told the justices that this “lawful presence” was merely what had always followed from the executive branch’s decision not to deport someone for a given period of time.

“Deferred action does not provide these individuals with any lawful status under the immigration laws,” he said. “But it provides some measure of dignity and decent treatment.”

“It recognizes the damage that would be wreaked by tearing apart families,” Mr. Verrilli added, “and it allows individuals to leave the shadow economy and work on the books to provide for their families, thereby reducing exploitation and distortion in our labor markets.”

The states said they had suffered the sort of direct and concrete injury that gave them standing to sue.

Judge Jerry E. Smith, writing for the majority in the appeals court, focused on an injury said to have been suffered by Texas, which he said would have to spend millions of dollars to provide driver’s licenses to immigrants as a consequence of the federal program.

Mr. Verrilli told the justices that Texas’ injury was self-inflicted, a product of its decision to offer driver’s licenses for less than they cost to produce and to tie eligibility for them to federal standards.

Texas responded that being required to change its laws was itself the sort of harm that conferred standing. 

“Such a forced change in Texas law would impair Texas’s sovereign interest in ‘the power to create and enforce a legal code,’” the state’s lawyers wrote in a brief.

Judge Hanen grounded his injunction on the Obama administration’s failure to give notice and seek public comments on its new program. 

He found that notice and comment were required because the program gave blanket relief to entire categories of people, notwithstanding the administration’s assertion that it required case-by-case determinations about who was eligible for the program.

The appeals court affirmed that ruling and added a broader one. The program, it said, also exceeded Mr. Obama’s statutory authority

House Speaker John Boehner promised on Friday that Congress would do something to stop President Barack Obama from forcing through his changes to the immigration system, though his caucus hasn't decided exactly what that will be yet.

'We will not stand idle as the President undermines the rule of law in our country,' Boehner said on Friday during a press conference, in which he accused Obama of 'damaging the presidency' and 'turning a deaf ear to the people he was elected to serve.'

'The President has taken actions that he himself has said are those of a king or an emperor, not an American president,' the GOP leader argued.

At the same time two Republican attorneys general pledged to sue the President for violating the Constitution and 'bestowing a legacy of lawlessness' on the country.

Republicans politicians are seething this week over the president's long-planned announcement that his administration will grants work permits to approximately 5 million migrants residing in the country illegally.

The president on Thursday night finally confirmed what news reports had been saying for days: parents of American citizen children and illegal immigrants brought to the U.S. before the age of 16 would be able to remain in the U.S. indefinitely as long as they meet certain conditions.

First, they must have arrived in America before January 1, 2010. They must also pay their back taxes and a fine and undergo national security and background checks.

Then, Obama told them, 'you’ll be able to apply to stay in this country temporarily, without fear of deportation.'

"You can come out of the shadows and get right with the law", he noted.

Although the president plans to sign an executive order today during a Las Vegas event making the directive official, and immigration officials will be 'immediately' instructed to stop removing qualifying migrants from the country, the mandate will not take effect until next year.

Immigrants applying for a reprieve through the president's already established Deferred Action for Childhood Arrivals (DACA) program will be able to file formal paperwork with the government in 90 days.

Those with citizen children must wait six months to obtain an application for delayed deportation.

Republicans hope to foil the Obama administrations plans before that provision of the order is allowed to take effect, however. They have been strategizing ways to block executive action on immigration for weeks, with conservatives aggressively pushing their colleagues to back a plan to defund the Department of Homeland Security if Obama doesn't rethink executive action.

In that situation, core agencies within DHS would continue to function, including Customs and Border Patrol and Immigration Customs and Enforcement, as their activities are considered 'essential' to maintaining order.

Non-essential operations such as the allotment of green cards and work permits would cease until the president agreed to sign legislation counteracting his immigration order.

Republicans in the House and Senate who prefer that approach have been unable to fully convince their colleagues to sign on, though.

Asked today if his caucus come to a consensus on how to best impede Obama, Boehner indicated that they had not.

'But I will say to you, the House will in fact act,' he told reporters.

Senate Minority Leader Mitch McConnell said yesterday on the Senate floor that the upper chamber had not agreed on a game plan, yet, either.

'We are considering a variety of options,' he said, making it clear that he'd like his members to hold off an a major spending fight during the lame-duck session.

GOP governors and other state leaders were more sure of their plan action by the time Obama had given his national address on Thursday night.

At an annual conference this week in Boca Raton, Florida, the chief executives of both Wisconsin and Texas previewed lawsuits they may launch against Obama over immigration.

'I would go to the courts,' Wisconsin's Scott Walker said Wednesday during a panel at the annual Republican Governors Association gathering. 'This is illegal.

'I think you would be hard-pressed to find anybody -- other than a partisan Democrat -- who wouldn't say this is illegal,' Walked claimed, according to CNN.

Rick Perry, whose time as Texas governor is coming to an end, said his state may also sue Obama.

'I think that’s probably a very real possibility,' Perry, said, arguing that Obama was 'sticking his finger into the eye of the American people.'

'The cost to the people of the state of Texas is an extraordinary amount of money that this President is exacerbating with his announcement that he's going to allow for this executive order,' he said.

It costs Texas roughly $12 million a month to protect the border, he explained.

After Obama's speech on Thursday incoming Texas Governor and current Attorney General Greg Abbott followed up on Perry's threat of legal action with a guarantee that his state would haul Obama to court.

'President Obama has circumvented Congress and deliberately bypassed the will of the American people, eroding the very foundation of our nation’s Constitution and bestowing a legacy of lawlessness,' Abbott said in a statement.

'Texans have witnessed firsthand the costs and consequences caused by President Obama’s dictatorial immigration policy and now we must work together toward a solution in fixing our broken immigration system.

'Following tonight’s pronouncement, I am prepared to immediately challenge President Obama in court, securing our state’s sovereignty and guaranteeing the rule of law as it is intended under the Constitution.'

Oklahoma AG Scott Pruitt also committed to a court battle on Thursday night, even before Obama's remarks.

'It is anticipated tonight’s speech will again prove our President sees himself as above the law,' he said. 'Regardless of what the President thinks the law ought to be, our constitution dictates that Congress makes the law, it is the Presidents duty to faithfully execute those laws.

'If the President takes an executive action that violates his constitutional duty to faithfully execute the immigration laws passed by Congress, we will take action to hold him accountable.'

In his speech on Thursday evening Obama acknowledged that the group of people he was now rewarding with work permits had in fact broken the law and needed to pay their debt to society.

Still, he argued it would be better for immigration officials to focus their resources on deporting criminals than it would for them to unnecessarily tear families apart.

'Felons, not families. Criminals, not children. Gang members, not a mother who’s working hard to provide for her kids. We’ll prioritize, just like law enforcement does every day,' he said.

Boehner said on Friday that by pardoning millions of law breakers, the president was sending the wrong message to other non-citizens,

'The action by the president yesterday will only encourage more people to come here illegally, and putting their lives at risk,' Boehner said. 'We saw the humanitarian crisis at our border last summer, how horrific it was. Well, next summer it could be worse.

'And this action also punishes those who have obeyed the law and waited their turn,' he added.

The Ohio Republican said he agreed with the president that America's immigration system is broken. 'But fixing it starts with a commitment to working through the democratic process and enforcing the laws that the president is sworn faithfully to execute,' he said.

Obama is 'making it impossible to build the trust necessary to work together,' he contended.

'You can’t ask the elected representatives of the people to trust you to enforce the law if you’re constantly demonstrating that you can’t be trusted to enforce the law.

Defending himself on Thursday, Obama said his actions were 'not only lawful, they're the kinds of actions taken by every single Republican President and every single Democratic President for the past half century.'

'And to those members of Congress who question my authority to make our immigration system work better, or question the wisdom of me acting where Congress has failed, I have one answer: Pass a bill.'

If president thinks House Republicans were slow to enact the kinds of reforms he wanted to see before, there's no chance they'll take them up now, Boehner said Friday, reminding reporters of his numerous warnings to Obama that unilateral executive action would not be welcomed by the GOP.

'With this action, the president has chosen to deliberately sabotage any chance of enacting bipartisan reforms that he claims to seek. And, as I told the president yesterday, he’s damaging the presidency itself,' Boehner said.

Boehner's comments on Friday while direct were substantially more toned down than those of some of his Republican colleagues in the House who blasted Obama in a flood of statements before and after his Thursday night after speech.

One of the most colorful digs came from Texas Rep. Louie Gohmert, who denounced the president for issuing an 'oral royal decree that will be followed by a written regal decree, as any good monarch would do.'

'This president is single-handedly creating a constitutional crisis and hurting the citizens he took an oath to protect and defend.

'President Obama’s regal proclamation is literally gambling away jobs for hard-working Americans, so naturally he would go to Las Vegas, perhaps Caesar’s Palace,' he said, referencing a popular Vegas casino.

On Wednesday retiring Minnesota Rep. Michele Bachmann slammed Obama for creating 'illiterate' Democratic voters with his executive action.

'The social cost will be profound on the U.S. taxpayer – millions of unskilled, illiterate, foreign nationals coming into the United States who can’t speak the English language,' Bachmann told reporters gathered in the Capitol, the Washington Post reported.

'Even though the president says they won’t be able to vote, we all know that many, in all likelihood, will vote,' she said.

Former GOP presidential nominee and sitting Arizona Sen. John McCain encouraged his fellow Republican lawmakers on Thursday to steer clear of charged language like Bachmann's, cautioning them that it will turn Hispanic voters off to the GOP's message.

'It only takes a couple' of insensitive comments, he said, for voters to develop a negative perception of Republicans.

'That’s the trouble with having some of these new young punks around here,' he told the Post. 'They ought to listen to us old geezers.'

President Obama in a prime-time address to the nation Thursday night trumpeted his executive action to protect 5 million undocumented immigrants from deportation, saying the most extensive overhaul to the immigration system in decades would limit "real amnesty" in the United States.

Ignoring GOP cries of executive overreach, the president opted to move ahead with unilateral action that adds fuel to the simmering feud over the limits of his executive authority.

The centerpiece of Obama’s executive blueprint is the deferral of deportations for roughly 4.1 million undocumented immigrants whose children are American citizens or permanent residents. Under the president’s plan, the parents must have lived in the U.S. for at least five years to receive work permits.

"I know some of the critics of this action call it amnesty," Obama said. "Well, it’s not. Amnesty is the immigration system we have today — millions of people who live here without paying their taxes or playing by the rules, while politicians use the issue to scare people and whip up votes at election time."

While Obama’s move alienated conservatives, progressives largely fell in line with the president, arguing his hand was forced by House Republicans' unwillingness to take up a Senate-passed immigration bill.

"Had the House of Representatives allowed that kind of a bill a simple yes-or-no vote, it would have passed with support from both parties, and today it would be the law," Obama insisted. "But for a year and a half now, Republican leaders in the House have refused to allow that simple vote."

Under the presidential directive, the Obama administration is also expanding a program that granted certain Dream Act-eligible immigrants a reprieve from deportation, saying that minors who arrived in the U.S. before 2010 would not face prosecution. Previously, Obama limited such protections to young immigrants who arrived in the country before 2007.

However, the parents of so-called Dreamers do not qualify for the new benefits outlined by the president.

The federal government will begin taking applications from undocumented immigrants in the spring 2015, administration officials said.

For their part, Republicans accused the president of killing any hopes of bipartisan compromise on the hot-button issue.

“Instead of working together to fix our broken immigration system, the president says he’s acting on his own. That’s just not how our democracy works,” said House Speaker John Boehner, R-Ohio. "The president has said before that he’s not [a] king and he’s not an emperor, but he’s sure acting like one. And he’s doing it a time when the American people want nothing more than for us to work together.”

The unilateral action is part of a broader campaign by the Obama administration to reserve deportations for the most violent criminals, not those convicted of lesser offenses. Obama’s plan will replace the Secure Communities law-enforcement program, which checks the fingerprints of all inmates with the Department of Homeland Security to verify their immigration status — and requires the detention of undocumented immigrants for lengthy periods of time.

Obama is also making more high-tech visas available, a provision long sought by Silicon Valley. The administration will grant visas to the spouses of H-1B visa recipients without it counting against the overall limit.

Obama’s high-profile address was delayed until after the November midterms, part of a failed attempt to retain Democratic control of the Senate. The president faced major pressure from Latino activists to flex executive muscle on immigration, though some advocates insist Obama could have done even more to halt a record number of deportations under his watch.

A major challenge Obama faced Thursday night was convincing the American public of the legality of his actions — he framed them as a matter of prosecutorial discretion.

"The actions I’m taking are not only lawful, they’re the kinds of actions taken by every single Republican president and every Democratic president for the past half-century," Obama said. "And to those members of Congress who question my authority to make our immigration system work better, or question the wisdom of me acting where Congress has failed, I have one answer: Pass a bill.”

Yet, multiple recent polls have shown that many Americans are opposed to his executive action. Aware of that political reality, Obama will travel to Las Vegas Friday to promote his immigration efforts.

But Republicans predict Obama will regret going it alone on immigration.

"President Obama is not above the law and has no right to issue executive amnesty,” Sen. Rand Paul, R-Ky., said. “His actions blatantly ignore the separations of powers and the principles our country was founded on. I will not sit idly by and let the president bypass Congress and our Constitution."

"For Obama, Executive Order on Immigration Would Be a Turnabout"

President Obama is poised to ignore stark warnings that executive action on immigration would amount to “violating our laws” and would be “very difficult to defend legally.”

Those warnings came not from Republican lawmakers but from Mr. Obama himself.

For years, he has waved aside the demands of Latino activists and Democratic allies who begged him to act on his own, and he insisted publicly that a decision to shield millions of immigrants from deportation without an act of Congress would amount to nothing less than the dictates of a king, not a president.

In a Telemundo interview in September 2013, Mr. Obama said he was proud of having protected the “Dreamers” — people who came to the United States illegally as young children — from deportation. But he also said that he could not apply that same action to other groups of people.

“If we start broadening that, then essentially I’ll be ignoring the law in a way that I think would be very difficult to defend legally,” Mr. Obama told Jose Diaz-Balart in the interview. “So that’s not an option.”

But Mr. Obama is set to effectively reverse position from that statement and now says he believes that such actions can be “legally unassailable,” as a senior White House official put it last week. Mr. Obama is expected to announce plans soon to expand the program for Dreamers to shield up to five million people from deportation and provide work permits for many of them.

The president insisted over the weekend that he had not changed his position. During a news conference in Australia, he said that his earlier answers about the limits of his executive authority were prompted by people who asked him whether he could enact, by fiat, a bipartisan immigration bill that had passed the Senate, which would have provided a path to legalization for more of the 11 million unauthorized immigrants here.

“Getting a comprehensive deal of the sort that is in the Senate legislation, for example, does extend beyond my legal authorities,” Mr. Obama said Sunday. “There are certain things I cannot do.”

In fact, most of the questions that were posed to the president over the past several years were about the very thing that he is expected to announce within a matter of days: whether he could do something to reduce deportations and keep families together if Congress would not act.

The president was pressed on that very issue during a Google Hangout in February 2013. An activist asked whether he could do more to keep families from being “broken apart” while Congress remained gridlocked on immigration legislation.

“This is something that I have struggled with throughout my presidency,” Mr. Obama said. “The problem is, is that I’m the president of the United States, I’m not the emperor of the United States. My job is to execute laws that are passed.”

The president has at times hinted at his ability to make changes to the way immigration laws are enforced. In an interview in January 2013, Mr. Obama said that “we’ve got some discretion. We can prioritize what we do.” At a forum in March of this year, Mr. Obama talked about the need to focus enforcement on criminals and gang members, and not on others.

White House officials said Monday that the change in the president’s comments over the years reflects a change in emphasis, not a change in opinion. They said Mr. Obama’s previous comments emphasized the limits of his authority because at the time he was actively making the case for Congress to pass an immigration overhaul. Now, he emphasizes his ability to act.

Officials have said the president could announce a series of executive actions as early as this week. The move comes after a concerted lobbying campaign by immigration advocates demanding presidential action in the face of 400,000 deportations every year. And it reflects the president’s frustration that Republicans have blocked all efforts to pass immigration legislation.

At the news conference in Australia over the weekend, Mr. Obama implored Congress to pass a bill that would secure the border, revamp the legal immigration system and legalize many of the 11 million unauthorized immigrants living in the United States.

“Give me a bill that addresses those issues,” he said at the Group of 20 summit meeting in Brisbane, Australia. “I’ll be the first one to sign it and, metaphorically, I’ll crumple up whatever executive actions that we take and we’ll toss them in the wastebasket.”

White House officials said the House speaker, John A. Boehner, made it clear that Republicans, who control both chambers in Congress next year, have no intention of passing a bill that the president could agree with.

They note that Mr. Obama delayed any executive action throughout 2013 and 2014, hoping that Mr. Boehner would allow a vote in the House on a bi-partisan bill that passed the Senate.

When that did not happen by the summer, officials said, Mr. Obama decided he should act on his own.

That decision puts the president in a different public posture from the one he offered in numerous interviews and speeches since 2010.

In those settings, Mr. Obama was repeatedly urged to act on his own to reduce the number of families that were being separated by deportations. He rejected that idea and urged people to pressure Republicans in Congress to pass a bill.

In an immigration speech in San Francisco last November, protesters repeatedly interrupted the president, yelling, “Stop deportations!” Mr. Obama told the protesters that he respected their “passion,” but insisted that only Congress had the authority to do what they wanted.

“The easy way out is to try to yell and pretend like I can do something by violating our laws,” he said. “And what I’m proposing is the harder path.”

And at a Town Hall in March of 2011, months before taking action to keep the Dreamers from being deported, Mr. Obama said the nation’s laws were clear enough “that for me to simply, through executive order, ignore those congressional mandates would not conform with my appropriate role as president.”

Republicans have seized on Mr. Obama’s past statements as evidence of what they call a shaky legal foundation for the president’s expected actions. In an email to reporters, the Republican National Committee on Monday asked, “When did we add a ‘politically convenient clause’ to the Constitution in the last four years?”

During the news conference, Mr. Obama said that in recent months he received legal advice from Attorney General Eric H. Holder Jr. about the limits of what he could do to reshape the immigration system.

What seems clear is that the legal advice will support Mr. Obama’s current statements about his executive powers, not his previous ones.

“I would be derelict in my duties if I did not try to improve the system that everybody acknowledges is broken,” he said Sunday.

You know I've often wondered if U.S. House Speaker JOHN BOEHNER is secretly working with the OBAMA Admin behind closed doors because some things just don't add up Politically.

BOEHNER will appear on International television either CRYING or THREATENING Pres OBAMA, and the next I know is BOEHNER will give Pres OBAMA exactly whatever He asks for.

Former U.S. House Majority Leader ERIC CANTOR was a JEW and a Strong Opponent of the OBAMA Admin.

CANTOR was also breathing down BOEHNER'S neck because he did NOT like the Political Deals BOEHNER was making OBAMA.

Suddenly after 13 years of being on Top, CANTOR was Mysteriously wiped out by DAVE BRAT.

Where did DAVE BRAT come from??

JOHN BOEHNER has been on Capitol Hill for several Decades and is a very Powerful Man!

OBAMA has only been on Capitol Hill for one Decade and OBAMA is a BLACK Man.

There is NO way OBAMA could do the things he has done while in the WHITE House, without the help of a Powerful Capitol Hill Politician like JOHN BOEHNER.
